HomeMy WebLinkAbout1986-04-10 - Minutes• • • • MINUTES OF THE SUBDIVISION COMMITTEE A meeting of the Fayetteville Subdivision Committee vas held on Thursday, April 10, 1986 at 4:00 P.M. in Room 030 of the City Administration Building, 113 West Mountain Street, Fayetteville, AR. 72701 MEMBERS PRESENT: Ernie Jacks, Sue Madison, Stan Green and B.J. Dow MEMBERS ABSENT: None ARKANSAS WESTERN GAS LSD 1001 SHIN - STAN GREEN The first item of business was the approval of the large scale development for Arkansas Western Gas to be located at 1001 Sain Street; represented by AWG Controller, Stan Green and architect, Gary Ryel. Green noted he would abstain from voting. Chairman Jacks noted that the drainage from the south side parking lot was requested to be taken to a ditch on the east side (per plat review minutes). Ryel advised a swale is on the east boundary and the drainage will empty into it. Jacks referred to plat review comments regarding the cul-de-sac and Green replied there is an ordinance vacating the Sain Street r/w back to Joyce Street which is not effective until a cul-de-sac is built. He said the road will eventually be extended and AWG does not wish to build a cul-de-sac at this time. Carlisle noted Clayton Powell has recommended the street be constructed to its conclusion with a cul-de-sac. Jacks advised the Commission has sometimes allowed a "t" installed in place of a cul-de-sac. Green noted there was no time limit placed on the ordinance. He asked if installing the cul-de-sac was a code requirement and Jacks requested this issue be researched. Madison asked about an existing fire hydrant and whether adjoining property owners have been notified and Ryel replied an ad in the local newspaper would be published on Friday, April llth. Jacks advised that a fire truck could turn around in the area provided. Jacks inquired about parking and Carlisle advised it is acceptable. MOTION Madison moved to recommend approval of this LSD to the Planning Commission subject to: 1. notification of adjoining property owners before Planning Commission meeting; and 2. a recommendation the cul-de-sac not be • • • • Subdivision Committee April 10, 1986 Page 2 constructed. Dow seconded and the motion passed 3-0-1, Green abstaining. Carlisle noted 10% landscaping is required between the parking area' on the south side and Front Street. Green said Attorney McCord has expressed an opinion that the ordinance did not apply in this case because it specifies property abutting the street while this parking area is more than 500" from the street. COTNER WINERY — LSD HIGHWAY 112 NORTH OF 71 BY—PASS The second item on the agenda was a request for approval of the large scale development for a winery submitted by Warren Cotner for 1.5 acres of C-2 property located on Highway 112 north of the 71 by-pass. Jacks verified that the entrance will be along the north/south portion of Highway 112 across from Ozark Window. Cotner said the gravel road will go through to the east/west portion of Highway 112. Madison asked if the fire hydrant will be located on the east/west portion of 112 and Cotner said it would. Cotner said he has complied with all requirements set out by the State Highway Department. Jacks inquired into street dedication requested by Powell and Cotner replied it was already dedicated in 1984. Carlisle said there was noting in the file showing said dedication. She advised if an easement or right-of-way were dedicated, it would be on record in the Court House. Cotner said he paid to bring the sewer line into the existing easement and received an easement from Mr. McBride. He explained that his wife tried to record that easement and was refused by both the City and the County. He said he thought the utility companies use the Planning Department as a leverage to get easements. Cotner said the gas company has requested a 25" easement to serve the develop- ment. He said he would provide a copy of the dedicated gas easement. Green said if the easement were already dedicated it could be shown on the plans. Jacks noted it is not shown and Jorgensen said he needs to verify that it is there. Cotner reiterated the gas line currently extends across his property to this development. Green suggested Cotner notify the gas company that he wishes to retain the gas line as a private line to his development. Jorgensen stated that gas, water, electric and telephone lines have been extended to the development. He said he would verify this condition with a written statement. Jacks inquired into parking and Carlisle noted that all parking shown is "off-site" and requires the approval of the Planning Commission. Jorgensen said all but six spaces will be off-site. tip Subdivision Committee April 10, 1986 Page 3 Madison said that, even though Cotner owns all of the property surrounding his proposed development, she felt the adjoining property owner to the west, Jim Sandlin, should be notified. as he had originally expressed opposition to the project because of the possibility of glaring lights from the parking lot. Jacks requested Sandlin be given notification. Carlisle asked if the parking lot would be lit and if sidewalk will extend from the lot to the building. Cotner answered affirmatively. MOTION Madison moved approval of this lsd subject to 1. approval of the proposed off-site parking; 2. notification to Mr. Sandlin; 3. utility easements be worked out to the satisfaction of the utility companies; and 4. a bill of assurance recommended for sidewalk along Highway 112. Cotner expressed concern regarding the possibility of installing a sidewalk at some time. Jacks replied that only the City Board has the authority to waive said requirement. He questioned whether sidewalk requirement would apply in this case as the development is a property within a property. Madison withdrew her motion as the surfacing of the driveway had not been shown as being durable and dustfree. Jorgensen pointed out that the drive has been noted as private, maintained by the owner. Cotner said he originally wanted the parking on-site but the size of the rezoning for his development was reduced to a minimum. Madison said she did not want to excuse a sidewalk from this location. Green suggested an opinion from the City Attorney as to whether the sidewalk requirement applies in this case. Jacks requested Carlisle research the requirement for paved private drives and she replied a bill of assurance may be accepted. Green suggested a private drive need not be paved if it is over a certain length. Jacks said this development will be considered by the full body of the Planning Commission at their meeting Monday, April 14th. VALLEY ADDITION (SUBDIVISION) BUD TOMLINSON - OLD WIRE SOUTH OF ELMWOOD The third item of consideration was a request for approval of Valley Addition submitted by Bud Tomlinson. The property, located on Old Wire Road south of Elmwood Street, consists of 8.75 acres and is zoned R-1. Tomlinson representing. Jacks inquired into r/w along Old Wire and Tomlinson said there was none required. Tomlinson said City Street Department people agreed with him that a street would not logically come through the east end of his proposed development. Jacks said he felt the area to the east would be developed at some time and that he would feel more comfortable with an easement located so the street could be extended. Green said he did not feel strongly about extending the street because there is a 30' private drive leading to the house of the only property owner to the east. He said he would be concerned only if that property would be landlocked and that the City's obligation is protected by the existing access strip. Madison said she thought Mathias may try to sell some of the property to the east at some time and added her concern that a network of streets is needed, not a proliferation of culs-de-sac. Jacks said he thought the area was a nightmare with hardly any access. Madison said it would be better for Winwood and Overerest to have traffic access from two ways. Green thought a solution would be to widen the private lane. Madison said she was distressed with the number of drives exiting onto Old Wire Road. Tomlinson said he has talked to others and felt that what he is presenting is the best possible design. Madison expressed concern regarding the drainage ditch which had standing water the day after a rain. Tomlinson said he made a study of the area and is not filling a 24" pipe or overflowing any banks. He said the water does not come from Old Wire as reported by Clayton Powell. He added there is a holding file on Bob Hall's property which retains some of the run-off and added that a 50 year flood could not load the 24" pipe, including the street and drives. When asked about the rock headwall on the south side of the private lane, Tomlinson said Powell had requested it replaced while Tomlinson would like to repair it. He said he will put a concrete apron in front of it and rip -rap the ditch along the private lane. Tomlinson said the water running along the road is generated in Mathias' yard and down the private lane. He explained the electric service can loop around the boundary of the development but not underground in a drainage ditch. He said he could use overhead service if necessary. • • • Subdivision Committee April 10, 1986 Page 5 Madison said she would prefer to take this plan to the full Commission after speaking with Powell and Traffic Superintendent, Franklin, regarding the drives onto Old Wire. Tomlinson noted Lot 4 will be restricted to exiting onto Amber Drive and that the Fire Department has talked about a fire station on one of the lots facing Old Wire. Jacks asked if the fire hydrant situation has been satisfied and Tomlinson said he has relocated it as requested. Jacks asked about notifying adjoining property owners and Carlisle replied it is taken care of. Madison referred to Powell's plat review comments noting the drainage ditches are ragged and silt -full. Tomlinson said he is doing what was requested by Powell. Madison requested the sidewalk be placed at the property line instead of at the curb. (Not required by code). She said she would vote against approval of this development unless a stub -out to the east is given. Jacks referred to off-site improvements required including street improvements beginning at centerline of the existing r/w of Old Wire Road and extending 15.5' towards the property with a sidewalk. Tomlinson requested the cul-de-sac be left in the plans. Jacks said he would like to see an easement there which could be returned if no connection is needed in the future. Green asked about the sewer line and why it prevents future building in that area. Carlisle said she would check with the City Engineer regarding the sewer line. Madison requested a delay of approval until Planning Commission meeting Monday, April 14th. She said she had problems with the stub -out and the drives onto Old Wire. WffION Green moved approval of this addition subject to 1. determination by the Planning Commission of whether the cul-de-sac should be extended. Jacks seconded and the motion passed 2-1-0, Madison voting "nay". Tomlinson noted he will be installing street improvements right away. There being no further discussion, the meeting adjourned at 5:45 P.M. 015
