MINUTES OF A SUBDIVISION COMMITTEE MEETING
A meeting of the Fayetteville Subdivision Committee was held on Thursday,
February 20, 1986 at 4:00 P.M. in Room 111 of the City Administration
Building, 113 West Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Ernie Jacks, Stan Green and Sue Madison
MEMBERS ABSENT: B. J. Dow
ST. JOHN'S LUTHERAN CHURCH - LSD
TOWNSHIP RD. & HWY. 265 - CARL RUSSELL
The first item of consideration was the prelimanay plat for St. John's
Lutheran Church, large scale development. The property consists of
eleven acres and is zoned A-1, Agricultural. Carl Russell and Pastor
Dave Splatt represented this large scale development.
Chairman Jacks questioned the drainage easement requested by Clayton
Powell, Public Works. Russell said he could see no drainage easements
on City plats for the subdivision adjacent to this property on the
west side. He expressed concern that the easement provided on the
church property would become stopped up at the west boundary. He
added that the drainage easement on church property has been anotated
as requested. Russell said the easement will follow along ten feet
on either side of the natural flow line. He said concern regarding
the drainage has been expressed to Powell.
Russell said he will be requesting a temporary access permit from
Kit Core of the State Highway Department, for a drive onto Hwy. 265.
He said the drive will be used primarily for construction and possibly
for the congrgation if Township Road is not readily accessable.
Jacks asked if the church would execute a bill of assurance for the
required sidewalk along Highway 265 or if the sidewalk would be installed.
Russell elected the bill of assurance.
Russell said a septic tank will be installed as there is no sewer
line available at this time.
Madison inquired into fire hydrants and Russell said the existing
one is in the middle of the intersection although the fire department
has requested one be installed internally which has been anotated
on the plat.
Madison asked about parking and Carlisle explained that she has re-
computed and has requested parking per seating area. Russell said

he has added several spaces including one additional handicap site.
Madison asked the size of the congregation and number of services
planned on. Splatt replied there is one service with a congregation
of about 200 people. He said the average Sunday attendance is approxi-
mately 100 and that part of the congregation will remain at the present
location of Arkansas and Dickson. It was noted that one space per
1500 sq. ft. is provided for the daycare space.
In reply to Jacks' question, Russell replied that a legal notice has
been published in the paper to notify adjoining property owners of
the LSD.
MOTION
Madison moved approval of the LSD for St. John's subject to 1. proof
of temporary drive permit from the State Highway Department; 2. a
bill of assurance being executed for sidewalk along Highway 265.
Green seconded and the motion passed 3-0-0. The Committee recommended
further contact with Powell to work out drainage plans along the west
property line between this development and Cedarwood.
Re -zoning the property was discussed and Madison said she felt it
would be to the church's advantage. Carlisle noted that a Conditional
Use for the church school may still be required. Russell said he preferred
to pursue the conditional use request for now. Madison advised that
a re -zoning would reflect the actual use of the property on the map
while a conditional use will not. Jacks advised examination of the
zoning ordinance by the church to assist them in making a final deeission
regarding this issue.
CEDAR CREEK SUBDIVISION - FINAL PLAT
EAST OF OLDWIRE AND SOUTH OF TOWNSHIP
Second item of consideration was the final plat for Cedar Creek Subdiv-
ision. This property consists of 8.81 acres and is zoned R-1, Low
Density Residential District. Paul Tunstall and Larry were present
to represent the final plat for Cedar Creek.
Chairman Jacks questioned if the monuments had been set, Larry said
that they set the corners with all the pins, Jacks said that he was
questioning if the monuments had been set and when do you set them
before or after the final, Jacks also stated that the monuments had
not been set at the last inspection.

Jacks asked what had been done on green space and parks fees, Carlisle
stated that all green space fees had been paid.
Jacks wants to know about the street names and if they had been changed,
Carlisle stated that there would not be a Susan Circle, and that Susan
Drive would extend straight through and Creek wood taking a jog to
the East and then continuing North. Carlisle explained that the final
plat showed all the street changes. Jacks saying that there is really
no problems with it then.
Sue Madison expressing some problem about a no mans land, a strip
of property where it was questionable to who owned it, Paul Tunstall
stated Jerry Sweetser gave a quit claim deed to the other property
owners, Tunstall saying it had all been taken care of. Madision quest-
ioning the sidewalk at the curb or property line, Tunstall stated
it would be put in on the property line as shown on the plat, Madison
wanting sidewalk setback from the curb as to have some buffer there,
and asking if that was going to happen or not, Larry stating yes
that were the pin is from the property line to the curb. Jacks asking
if they were still going to make it four feet wide or five feet wide,
Tunstill stating it would be four foot wide.
NOTION
Madison moved approval of the final plat for Cedar Creek Subdivision,
Green seconded the motion passed 3-0-0
