HomeMy WebLinkAbout1985-09-05 - Minutes• • • MINUTES OF THE SUBDIVISION COMMITTEE OF THE FAYETfEVILLE PLANNING COMMISSION A meeting of the Subdivision Committee of the Fayetteville Planning Commission was held at 4:00 P.H. on Thursday, September 5, 1985 in Room 111 of the City Administration Building, 113 Weat Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Ernie Jacks, Sue Madison, Joe Tarvin and Stan Green MEMBERS ABSENT: None Chairman Jacks called the meeting to order and the minutes of the meetings of July 18th, August 8th and August 23rd were considered. MINUTES Green made the following correction to the minutes of July 18th: In the motion regarding the changes in Lindsey's Retail & Office Center, Green abstained because the company he works for owns the property in question. With this correction, the minutes of all three meetings stood approved as distributed. LSD — LITTLE ITALY RESTAURANT JOHN MCLARTY 724 SYCAMORE The first item of consideration was the large scale development plan submitted by John McLarty for Little Italy Restaurant located at 724 W. Sycamore and represented by Ery Wimberly. At Jacks' request, Jones outlined several of the concerns put forth by representatives at the Plat Review meeting: a 25' utility easement requested outside of the street r/w on Sycamore; discussion of extending the sewer line from the east; landscaping on the west property line; and, proof of notification. Jacks said he had not considered the existing vegetation when he looked at this property. Madison said that she had noticed some gaps that will need to be addressed. Mclarty volunteered to fill in the gaps with additional view obscuring plants. Wimberly advised that proof of notification has been submitted. Madison inquired as to Street Superintendent Powell's comments regarding the improvement of Chestnut Street. At Jacks request, Wimberly explained that Helen Edmiston had previously owned much of this and the surrounding property and had verbally agreed to improve Chestnut. He said that 10 Subdivision Committee September 5, 1985 Page 2 after Sycamore was improved, Edmiston decided not to proceed because she found she had access to all of her property other than from Chestnut. Wimberly noted that this property does not abut Chestnut and added that the owner of Soap and Suds on the east side of the Chestnut stub -out has agreed to improve his half of Chestnut at the call of the City. Madison commented that there are many apartments in the vicinity that might wish to use Chestnut for access to the restaurants on Sycamore. MOTION Tarvin moved to approve this LSD subject to Plat Review comments. Seconded by Green, the motion passed 4-0-0. LSD - LLOYD HOBBS- MOTEL 1255 S. SHILOH DRIVE, S. OF HWY.62 The second item of consideration was the large scale development plan for Hobbs' Motel to be located at 1255 S. Shiloh, south of Highway 62 West. Ery Wimberly representing. Jacks noted that there may be controversy regarding the access for this property. He cited several comments from Plat Review minutes and Wimberly replied that there were no problems. Wimberly noted that he may have to request a variance from the Board of Adjustment for the proposed canopy but he also advised that the building plan can be altered if the variance is not granted. Jacks asked if adjoining property owners have been notified and Wimberly replied that they have. Wimberly presented a drawing of the property including a gravel drive which serves Hulett and Smith, property owners along 15th Street. He explained that the drive runs at an angle while the r/w of 15th Street is reflected in the plat book as running due east/west. Wimberly said the likelihood of 15th Street ever extending through the mobile home park to the west of subject property is practically none. He said he felt it was absurd to dedicate additional r/w that will never be used. He also said that about half of the r/w runs through a 5' deep 15-20' wide draw. Wimberly said that 15th Street in no way serves this tract of land. He said he will leave the natural drainage in its natural channel. Wimberly advised that the drive in question is 30' of land between deed descriptions which has never been dedicated to either the City or the County. In answer to Madison's question, Wimberly said that Powell has requested additional r/w or the vacating of the drive. Wimberly said that property owner Smith would not understand the process to vacate. Green advised that a street cannot be vacated if it has never been dedicated. Wimberly said that Hobbs does not own the 30' • Subdivision Committee September 5, 1985 Page 3 and therefore cannot dedicate it. Jones inquired whether 15th Street was the alternate access for Washington Mountain Estates. Madison advised that, when this property was re -zoned, an assumption was made that the mobile home park would become a R-0 buffer zone for the C-2 property. She said she did not think it could now be assumed that the mobile home park would remain. Wimberly said that Powell had stated that there is not enough r/w for Shiloh Drive but Wimberly noted that he has determined the property lines from the Highway r/w monuments which is more r/w than the City Master Street Plan calls for. Jones asked if Wimberly had been informed by SWEPCO that service will come from the north and he replied that he had. Wimberly said that there is a tree line between this property and the mobile home park where there is a requirement for screening. He noted that he has not provided parking for the planned atrium space and Madison said she preferred that Wimberly reduce the amount of parking spaces as there are about 50 spaces over that required. MOTION Madison moved approval of this LSD subject to Plat Review comments with no requirements for improvements to 15th Street and noting that the r/w for Shiloh as shown on this plat is sufficient. Green seconded and the motion to approve passed 4-0-0. The Committee also recommended that the developer reduce the number of parking spaces. No recommendation was made for screening on the west property line. LEO WATSON - 118 N. WASHINGTON REQUEST FOR SETBACK VARIANCE The third item on the agenda was consideration of a request submitted by Leo Watson to reduce sideyard setbacks for property located at 118 N. Washington as per an amendment to the Code of Ordinances which was approved at the City Board meeting of September 3, 1985. Watson said that he tore down the old bathroom of his house because it had rotted so badly. He said he would like to replace the bathroom exactly as it was without increasing the size. Watson said the bath is in the rear of the house away from the street. Jones presented a drawing from the Sandborn maps from 1930 and she said that, according to this map, Watson's lot is 48' wide. • • • Subdivision Committee September 5, 1985 Page 4 Green asked what the procedure would be if the recent ordinance amendment had not passed and Jones replied that Watson would have had to request a variance from the Board of Adjustment She said that if the room could have been repaired in some way, it would not have needed approval from this Committee but, because the room was removed, it may not be rebuilt except under the provisions of the new ordinance (if it can be applied) or with a variance from the Board of Adjustment. In answer to Green's question, Carlisle stated that she had spoken to City Attorney McCord who had advised that the ordinance was in affect immediately. Green noted that the ordinance refers to "new" single family dwellings and Jones replied that this is the type of situation that the Board of Adjustment was hoping that the Subdivision Committee could address. Madison advised that when the Update Committee revised this ordinance, they had not specified the word "new". Green said he anticipated that this amendment would cover a vacant lot in a platted subdivision which was smaller than the norm but where all the other houses were in conformance with older setbacks. MOTION Tarvin moved approval of this request. The motion died for lack of a second. NOTION After further discussion, Tarvin moved approval of this request contingent upon the City Attorney specifying that this Committee has the authority to approve variances such as that being requested. Green seconded and the motion passed 4-0-0. Green proposed a recommendation that the Planning Commission consider a means for variances, such as that being considered, be handled in the Planning Office. JOSIE FLOWERS - 16 N. WILLOW REQUEST FOR SETBACK VARIANCE The fourth item of consideration was a request submitted by Josie Flowers to reduce the required setback for property located at 16 N. Willow. Granting this variance would allow Flowers to add a bathroom and porch to her home. Carlisle explained that Flowers wishes to add a bathroom and porch to her home and can only provide 7' of setback from her property line instead of a required 8'. • • • Subdivision Committee September 5, 1985 Page 5 Jacks said he thought the purpose of City code was to get rid of buildings that do not meet the requirements and build them back within conformance. He inquired as to the nature of the ordinance with regards to this situation and Carlisle advised that it is subject to Subdivision Committee approval. Madison added that the judgement call is whether or not the request will be in keeping with existing neighborhood standards. MOTION Tarvin moved approval contingent upon McCord's statement that this Committee has the authority to approve it. Madison seconded and the motion to approve passed 4-0-0. OTHER BUSINESS CONCEPT PLAT FOR 33 ACRES HWY.112 AT HWYS. 71 AND 471 Wimberly introduced a Concept Plat explaining that there are plans to construct a commercial subdivision at this location with an auto and truck center on one lot. Jacks said that now that the Board of Directors has shoved this parcel down Commissioner's throats, he requested that the name be changed to be more appealing than truck stop. Wimberly said he will be presenting very soon and he noted that the middle concerns surrounding. plans for this "traveler's center" lot would be a motel with commercial Wimberly said his main point of presentation was to note the u -shaped drive layout which lines up with Trucker's Drive on the west side of Highway 112. He said r/w would be provided for the extension of the access road north through Tomlinson's property. He said he has spoken to the Highway Department and they have no problem with the plan. Jones suggested checking the buildable depth on some of the lots that appear to be very short. Wimberly said the lots were large enough. T p 0 p his Committee thought the Concept Plat looked fine and Wimberly requested ermissionto present same to the Planning Commission at their meeting f September 9. Wimberly next requested that the re -zoning for J.B. Hays' roperty on Mt. Comfort Road be tabled at the same Sept. 9th meeting. There being no further business, the meeting adjourned at 5:15 P.M. ‚IPS
