MINUTES OF THE SUBDIVISION COMMITTEE
OF THE FAYETTEVILLE PLANNING COMMISSION
A meeting of the Subdivision Committee of the Fayetteville Planning
Commission was held at 3:00 P.N. on Friday, August 23, 1985 in Room
111 of the City Administration Building, 113 West Mountain Street
Fayetteville, Arkansas.
MEMBERS PRESENT: Ernie Jacks, Joe Tarvin, Sue Madison & Stan Green
MEMBERS ABSENT: None
JEFFERSON ELEMENTARY SCHOOL ADDITION
612 S. COLLEGE, BETWEEN 6TH & 7TH
The first item of consideration today was the proposed addition to
Jefferson Elementary School located at 612 S. College between 6th
& 7th and represented by Charles Berger of Hailey-Powers-Froning.
Jones indicated that the School Board has made a joint request to
go before the Board of Directors and the Board of Adjustment for either
a reduction or waiver of the rights-of-way requirements or a variance
in the building setbacks requirements. She said that additional 28'
of r/w is required along 6th St. and Berger said the School Board
had no problem with that. She said an additional 10' of r/w are required
along 7th St., 10' additional r/w on College and a 2' alley running
under the existing building needs to be vacated.
Jacks noted that the Street Superintendent has not recommended any
off-site improvements other than sidewalk on 6th St. Berger was in
agreement with this requirement. Jones advised that the existing
sidewalk on 6th St. is asphalt and the City requires concrete.
Jones pointed out the unloading zone on 6th St. and the off -set of
the driveway on 6th St. to Washington Avenue (on the North) as possible
problems. Jacks said he thought the off -set was acceptable.
Berger explained the existing and proposed driveways and parking lots
and Jones advised that there is no standard for off -set of drives
to intersections. Discussion ensued regarding the possibility of
the unloading zone being in the street r/w at a future date. Jones
expressed her concern that someone might be trying to exit the parking
lot as the bus was unloading, creating a conflict.
Madison expressed concern that main access to this school is either
by foot or bus with no provision for private cars to load or unload.

MOTION
Green made a motion to recommend approval of this plan subject to:
1. the Planning Commission's recommendation to the City Board that
r/w requirement be waived due to practical difficulties as outlined
in the ordinance; 2. a recommendation that the alley under the building
be vacated; and, 3. sidewalk be installed along 6th Street. Tarvin
seconded the motion which resulted in a tie, two for (Green and Tarvin)
and two against (Jacks and Madison).
LEVERETT ELEMENTARY SCHOOL ADDITION
CLEVELAND AT GARLAND
The second item of consideration was the proposed addition to Leverett
Elementary School located at Cleveland and Garland and represented
by Charles Berger.
Jacks noted that an additional 15' of r/w is required on Garland,
an additional 5' on Cleveland and that Powell recommends no other
off-site improvements. He asked Berger if the 75' between outdoor
play area and adjoining residential property line has been met and
Berger replied that it has if the Parks and Recreation Department
accepts the area on the west side of the building as park land.
Jones advised that she is considering this school's requirements in
the same light as she does churches (recreational, educational and
institutional uses in or abutting residential zones) which will require
a building setback of 50' if fully air conditioned and 100' if it
1s not. Berger said he meets that requirement. He added that screening
will be provided along the west property line by the school if they
are the party responsible for this improvement. Jones noted that the
Planning Commission has the authority to waive said screening requirement
and request 10% plants in lieu of screening. She said the Commission
may also waive the requirement of 75' from play area to property line.
Jones advised that the driveway/unloading zone along Garland is in
the existing State Highway r/w and she added that driveway does not
meet the requirement of being 40' from an intersection. Berger replied
that the State Highway Department and City Traffic Superintendent,
Franklin, do not have a problem with the situation. Jones added that
the developer may wish to pursue the closing of Eagle Street to the
north. Madison said she thought it would be better if Eagle dead -ended
into school property.
MOTION
Tarvin moved to recommend approval of this plan subject to 1. Plat
Review comments; 2. a recommendation that screening requirement be
waived with 10% of the area in plants in lieu of said screening; 3.
a recommendation of the setback requirement being waived for the minimum

distance from the play area to the west property line; and, 4. the
requested r/w on Garland and Cleveland. Green seconded and the motion
passed 3-1-0. Madison voting "nay".
BATES ELEMENTARY SCHOOL ADDITION
601 S. BUCHANAN
The third item of consideration was the proposed addition to Bates
Elementary School located at 601 S. Buchanan and represented by Berger.
Berger requested a Bill of Assurance be accepted for the required
sidewalk along W. 6th Street and Stone.
MOTION
Madison moved to recommend approval of this plan subject to 1. Plat
Review comments; 2. a recommendation that Bills of Assurance be accepted
for sidewalk required along W. 6th and Garland; and 3. requested r/w
being dedicated along W. 6th Street and Stone. Tarvin seconded and
the motion passed 4-0-0.
WALNUT GROVE ADDITION - FINAL PLAT
N. OF WEDINGTON AND WEST OF HWY. 71 BYPASS
The fourth item of consideration was the final plat of Walnut Grove
Addition located North of Wedington Drive, West of Hwy.71 Bypass and
represented by Ervan Wimberly of Northwest Engineers.
Jacks asked if rough -grading dedicated street stubs not for immediate
development was a new Planning Commission policy. It was determined
that it was not policy but intended for this subdivision only.
Jones advised that she had received a signature plat noting that all
utility companies approve of the further division of lots resulting
in two additional lots. She added that she has spoken to the developer
(Bryce Davis) who is considering another increase in lots between
Lots 105 and 111. It was determined that the plat would need to go
back through the plat review process if the additional lot was desired.
Jacks noted that the PRAB has requested land from this developer for
City park. He inquired about the drainage proposal and Wimberly said
that he has proposed a temporary drainage ditch on the east side of
Salem Road in the area of future development. He said he did not
want to indicate it on the plat but agreed to execute a temporary
easement for the ditch by separate instrument.
• Jones noted that Street Superintendent, Powell, had expressed concerns
that the proposed future phases of this subdivision and that of Michelle

Addition to the north may not be constructed, resulting the bridge
over Hamestring Creek not being built, and, subsequently, Salem Road
not going through from Wedington to Mt. Comfort. Madison and Green
said that they had' not heard mention of the bridge construction before.
Jones read comments from the minutes of the preliminary Plat Review
meeting in which no mention was made regarding approval of Phase I
of this development being based on construction of the bridge over
Hamestring Creek. She said that other conditions reflected in the
Subdivision Committee minutes of April 5, 1985 (Preliminary Plat)
were that 1. the shoulders adjacent to Salem be compacted for emergency
vehicle access; 2. clarification be noted as to responsibility for
maintenance of the storm water detention ponds (Street Department
or Parks & Recreation); 3. dedication of additional street r/w extending
from the west end of Street "E" (into the park) which has been eliminated;
4. dedication of a 16' pedestrian easement between Lots 124 & 125
with a sidewalk and prohibition against cross fencing of that easement.
Wimberly said that the sidewalk across the pedestrian easement is
under contract, although that easement has not been included on this
plat. He added that sidewalks and compacted shoulders along both
sides of Salem will be provided.
Jacks inquired about a requested Bill of Assurance dedicating 60'
of r/w for Salem Road and limiting density to 12 families per acre
in a specified area of this development. Jones noted that the Bill
of Assurance has been submitted but does not stipulate the r/w extending
to the north property line of the project. Wimberly said it would
be no problem to take care of this dedication.
Wimberly asked that the exact location of the dedication of park land
be noted upon completion of Phase I as the design of the detention
basin may conflict with it.
Jacks inquired about, a note to be added to the plat as requested by
Jones regarding zoning districts and Wimberly said that has been taken
care of. He requested a waiver of streetlight spacing and the Committee
agreed that spacing as shown was acceptable.
Cheryl Miller, a property owner (adjacent) to ,the east presented a
visual aid demonstrating the relationship of a proposed street stubbed
off of Salem Rd., to. Dorothy Jean about one-quarter mile to the east.
She noted that the present location of the street stub is off -set
to Dorothy Jean and she requested that it be placed so as to line
up with Dorothy Jean and her property's north border.
Wimberly said there would be no problem relocating said street stub
and Jones pointed out that this would create a jog between the street
stub and the continuation of that street on the west side of proposed
Salem Road.

MOTION
Madison moved to recommend approval of this subdivision subject to:
1. Plat Review comments; 2. a B111 of Assurance submitted stating
the appropriate acreage for park use to be dedicated upon completion
of Phase I improvements; 3. a temporary drainage easement to be dedicated
by separate instrument for as long as it is needed; 4. the submittal
of a Bill of Assurance stating that 60" of r/w will be dedicated for
Salem Road extending to the north property line of this development;
5. a pedestrian easement dedicated between Lots 124 & 125 with no
cross fencing; 6. recommendation that the streetlight spacing be waived
in lieu of that shown on the plat; 7. the eastern street stub (formerly
Gumwood) will be eliminated and replaced by dedication of a street
stub just to the south of the old street stub, placed with the north
r/w line aligning with the north r/w line of Dorothy Jean and that
there will no drives having access to said street stub until it is
constructed; 8. recommendation of waiving the jog distance between
the proposed eastern street stub and the intersection. Seconded by
Tarvin, the motion passed 4-O-0.
There being no further discussion, the meeting adjourned at 4:30 P.M.
