HomeMy WebLinkAbout1985-04-05 - MinutesMINUTES OF THE SUBDIVISION COMMITTEE A meeting of the Subdivision Committee of the Fayetteville Planning Commission was held on Friday. April 5, 1985 at 11:00 a.m. in Room 111 of the City Administration Building, 113 West Mountain Street, FayettevillE, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Barbara Crook and Sue Madison Joe Tarvin and Ernie Jacks Ervan Wimberly, Bryce Davis, Bobbie Jones and Paula Brandeis The regularly scheduled meeting of the Subdivision Committee was called to order at 11:00 a.m. by Chair, Barbara Crook. WALNUT GROVE ADDITION PRELIMINARY PLAT WEDINGTON DRIVE WEST OF BY-PASS The first item of consideration today wa§ the preliminary plat for Walnut Grove Addition located on Wedington Drive west of the by-pass and represented by Ervan Wimberly and Bryce Davis. Crook asked if there were any problems with the comments made by the futility representatives at the plat review meeting and Davis replied that he has meet each request made. Crook noted that the Parks and Recreation Advisory Board has recommended that acreage, as offered by Davis, be accepted by the City for a public park and that credit be given Davis for future development within this project because the acreage being given is more than required. Wimberly advised that some lots have been indicated as being appropriate for 4-plex dwellings and that if they are developed as fewer units, additional parks fee credit will be given. Crook said she saw no problem with approving of the recommendation from the PRAB and Madison agreed. Crook noted that Powell, Street Superintendent, expressed concern regarding drainage on this project and Davis replied that there is less than 10 ft. of fall on Betty Jo Drive (south side of Wedington) and that the situation on this side of Wedington is much better. Crook agreed, after' consulting a drainage map, that most of the problems do seem to occur on the south side of the Highway. Wimberly advised that the entire property, with the exception of a small amount of the southern portion, drains back northward to Hamestring Creek. Wimberly advised that internal subdivision drainage improvements will include cross drains at the ends of the loop streets and the pond 12S • • Subdivision Committee April 5, 1985 Page 2 will be used for retention. He added that the preliminary plans include an open channel through the park as well as through the west side. He said that the crown on Street "A" keeps the drainage on the east side of the road and he added that a storm drain may be needed across the middle portion of the parcel. Wimberly said there are drains at the west side which takes the drainage to a pond just off-site. Crook said she did not feel cross drains were necessary at each street corner but may be necessary mid -way along the streets as they begin to gather drainage. She said that the object was to get the drainage to proper outlets and that final sizing was between the developer and Powell as the code requires that drainage be worked out to the satisfaction of the Street Superintendent. Crook inquired about the length of the dead-end street as noted by Powell. Wimberly said the plan is to connect with Salem Road to the north through Dr. Harris' property which is presently undeveloped. Jones cited parts of the code which state that urban dead-end streets may not be longer than 500 ft. and 1000 ft. rurally. She noted that these figures are reversed in hilly terrain. Crook asked if Davis would. dedicate right-of-way through the park for a through street to the west and Wimberly replied that he will stub out two streets two the east to connect with potential future development. Crook said she would feel more comfortable with the west side right-of-way being dedicated at this time and Davis agreed. Wimberly explained that the Street Superintendent has requested two points of ingress/egress onto Wedington but that Davis and he have planned on a u -shaped access onto Wedington (with two exits) which would then connect with the north/south through street. He said they feel that any traffic bottle -neck would occur at this location. Crook noted that there was a possibility of connecting this development with Point West Addition to the east with a r/w dedication opposite Street "H"; Jones advised that this will involve a major bridge crossing. Crook advised that this Committee may deny approval of a LSD if sewer is not connected and she added that a condition of approval may include construction limited to a fixed number of units until another point of access is provided. Madison said she felt there were too many units at this time to approve the LSD with only one point of access. Crook suggested the possibility of a temporary 2nd exit so that the project could begin while keeping safety in mind for the residents. Wimberly advised that a bridge would be necessary to get to Mt. Comfort. Davis advised that he is beginning in the middle section of his parcel because sewer is available from the north property line while water is out on Wedington (south line) and that he also has had some request for R-1 which is located in the middle. He advised that because of /24 • • • Subdivision Committee April 5, 1985 Page 3 this situation combined with limited financing he felt it most productive to begin at the chosen location. Crook agreed that the first developer in a new area bears the financial brunt of the improvements. Madison said she felt that 68 units on a cul-de-sac (as planned) was too many and that she felt uncomfortable with the number of units planned for the loop streets although Wimberly noted that he could have been within requirements had he planned the streets as culs-de-sac. Madison said this would not make the situation more comfortable to her and she cited cases of developers whose subdivision were denied because they could not provide a second egress. She said she would be satisfied with a through connection to the existing Salem Rd. Crook asked if a pedestrian walkway to the park could be dedicated through Lots 124 and 125 and made wide enough to carry an emergency vehicle. Jones advised that there are many followers of emergency vehicles, such as press, utility companies and the curious. Crook suggested widening the shoulders of Street "A" to 10 ft. beyond the curb in conjunction with the easement noted above to provide for travel by emergency vehicles. Crook asked what Davis intended on sidewalks and he asked if he -could install sidewalk on only one side of Street "A" for now as the south part of this parcel will not be developed for a while. Madison said she would like the west side sidewalk installed all at one time, not piecemeal and Jones advised that code requires sidewalk be installed as the buildings are constructed and that if the lot remains vacant for five years, the developer shall install the sidewalk at that time. Jones noted that the question of when sidewalk shall be installed along the collector street within this development and along Hwy. 16 will be up to the Planning Commission to. She cited provisions for delayed off-site improvements from the code of ordinances. Madison agreed with sidewalk on one side of the collector street within this phase but she expressed concern over the south part of this parcel not developing with much traffic occuring and no pedestrian walkway. Crook pointed out that this sidewalk will need to be installed at some time and delaying them could be more costly. She suggested sidewalk on one side in the undeveloped areas an off-site improvement requirement. Jones said sidewalk installation on that part of Street "A" south of phase I might be tied to a particular number of units or a number of years. Crook said she thought maintenance responsibility for the drainage retention ponds near the park was an administrative problem. She said she didn't think the north/south street needed to be four -lane and saw no problem with the drainage plans as shown (pending final design). 17 • • • Subdivision Committee April 5, 1985 Page 4 Madison asked if streetlights have been taken care of and Davis assured her that they will be. Jones noted that the streetlights to be installed along Hwy. 16 needs to be considered at the time development takes place near that highway. Crook asked if the covenants have been prepared and Davis said they will be ready by the meeting of April 8. Jones advised that if this preliminary plat is approved it will apply to the entire plat not just the current phase. She questioned the lot width at Lot 321 and noted that the appropriate lot width and setbacks must be adhered to. Wimberly said he would make corrections. MOTION Crook moved that the Committee recommend approval of this subdivision subject to 1. Plat Review comments made by Arkansas Western Gas, Ozarks Electric, Southwestern Bell Telephone, Warner -Amex Cable, Water Meter Superintendent, Sanitation Department and the City Engineer; 2. the Planning Commission acceptance of the PRAB recommendation to accept 8+ acres of land for public park; 3. right-of-way dedication for Street "A" being 60 ft. and said street being built to local street standards (31 ft. as per code) unless the City decides to bear the cost of parti- cipating (at this stage) in the construction and development of said street to collector standards; 4. clarification by reference to City Administration as to whose jurisdiction the maintenance.of, the storm water detention ponds and easements will fall (the choices being either the Parks Department or the Street Department); 5. storm drainage being as shown pending final figures and designs for same; 6. dedication of additional street r/w extending from the west end of Street "E" to the west edge of property; 7. off-site improvements include the construction of Street "A" to local street standards from the south edge of this phase to Wedington Drive with sidewalks on one side at this time and sidewalk on opposite side to be constructed at such time as future development takes place; 8. dedication of a 16 ft. ped- estrian easement between Lots 124 & 125 with a sidewalk and prohibition against cross fencing of that easement; 9. the shoulders of Street "A" being improved for a width of 10 ft. beyond the back of curb on both sides of the extention of said street to a condition capable of supporting travel by a vehicle, from the south edge of this phase to Wedington Drive; and, 10. proof of notification of adjoining property owners and a copy of the covenants available on Monday April, 8. Crook seconded the motion which failed to pass 1-1-0, Madison voting "nay". Madison said that, if the Fire and Traffic Departments are not opposed to the street solution arrived at today, then she would be in favor of the motion as stated. MOTION Crook made a motion that the loop streets in this development shall have no more names assigned than they have access point to a collector street. Madison seconded and the motion passed 2-0-0. /9! • • • Subdivision Committee April 5, 1985 Page 5 MOTION Madison moved that the Planning Commission add a street to the Master Street Plan that will connect with Salem Road to the north and Highway 16 to the south; seconded by Crook, the motion passed 2-0-0. Davis said that the previous a street be named after him Street already exists and if first Dowell, a local street, owner of this parcel had requested that (Dowel) and Jones replied that a Dowell Davis wished to change the name of the it would require Board action. SPEE-DEE MART PRELIMINARY LSD HWY. 62 WEST - HOYT GREENWOOD The second item of consideration today was the large scale development plan for Spee -Dee Mart located on Hwy. 62 and Razorback Rd.; submitted by Hoyt Greenwood and represented by Ervan Wimberly. Crook noted that additional right-of-way and storm drainage have been taken care of. She asked about easements and Wimberly replied that they have dedicated 20 ft. on the north border as requested but felt that the easement requested on the south side for future use by Southwest- ern Bell was unreasonable. Crook suggested that the need for this easement be determined when future development takes place. Jones cited code (ART.IV) stating standards for design in subdivisions and large scale development. It was determined that easements should be required for known utilities and extensions but not necessarily for future development. Crook asked if a Bill of Assurance was needed for the sidewalk requested on the east and north sides which would occur at the time of future development or at the call of the City if development takes longer than five years. Wimberly agreed and added that notification of property owners and placement of the trash dumpster have been taken care of. Jones said that she is authorized to accept a sidewalk Bill of Assurance administratively if it is the feeling of the Planning Commission that it is all the developer shall be required to do at this time. MOTION Crook moved to Review comments south side with time of future recommend approval with the exception the need for said development; 2. a of this LSD subject to: 1. Plat of the easement requested on the easement to be determined at the Bill of Assurance being executed stating that sidewalk will extend from the west edge of the driveway on Hwy.62 to the west edge of the property and from the south edge of the Razorback Road driveway to the south edge of the property. Madison second and the motion to recommend approval passed 2-0-0. i29 • Subdivision Committee April 5, 1985 Page 6 SEER -DEE MART - PRELIMINARY LSD HWY. 16 WEST - HOYT GREENWOOD The third item of consideration today was a preliminary large scale development plan for Spee -Dee Mart located on Hwy. 16 west at Rupple Road submitted by Hoyt Greenwood and represented by Ervan Wimberly. Crook advised that there are major problems in this area with regard to sanitary sewer and storm drainage and she would address it last. Wimberly noted that he, Greenwood and Powell met at the site to examine the area with drainage in mind and added that Greenwood has said he would work with the City on these problems. Crook asked about the PVC requested under the driveways and Wimberly said he has not shown said conduit as they were requested for possible future use which he did not feel was necessary. Crook noted that they were requested only on the east side. She suggested this be stated as "PVC conduit as required for service" and Wimberly agreed. Crook said that, if there is a legitimate need in order to serve the residents further north, she would require it. Wimberly said he will change the plat to reflect 40 ft. of right-of-way dedicated on Rupple Road. Crook noted that easements have been met and Wimberly advised that notification has been given appropriate property owners. She suggested a sidewalk Bill of Assurance as per Spee -Dee Mart Hwy. 62 (previously discussed) and Wimberly agreed. RECOMMENDATION Crook said that this large scale development might be approved subject to 1. Plat Review comments; 2. a recommendation that PVC conduit under driveways would be provided as required for service and 3. a Bill of Assurance for sidewalks` which are shown and; 4. a sidewalk Bill of Assurance being executed for that area from the north edge of the north drive to the north property line and from the west edge of the west drive to the west property line. She noted that this would address everything except the drainage problems which could be examined between this time and the Planning Commission meeting Monday April 8. Crook and Wimberly agreed to address the drainage problems and report back to the Planning Commission. There being no further business, the meeting adjourned at 2:30 p.m. )30
