MEETING OF THE SUBDIVISION COMMITTEE
A meeting of the Subdivision Committee of the Fayetteville Planning
Commission met on Wednesday, December 19, 1984 at 3:15 P.M. in Room
111 of the City Administration Building, 113 West Mountain Street,
Fayetteville, Arkansas.
MEMBERS PRESENT:Sue Madison and Joe Tarvin
MEMBERS ABSENT: Melanie Stockdell and Stan Green
OTHERS PRESENT: Howard Scott, Jeremy Hess, Gary Carnahan, Steve
DeNoon, Bobbie Jones and Paula Brandeis
This special meeting of the Subdivision Committee was called to order
by Sue Madison at 3:20 P.M. and consideration of the minutes of the
October 19 meeting were suspended until absent members of this committee
could be in attendance.

The first item of consideration today was the preliminary plat for
• mini -warehouses at 996 S. Beechwood represented by Howard Scott.

Madison commented that a vicinity map and a legal description are
required along with each plat submitted.
Scott said he understood the requirements as addressed by Clayton
Powell in the Plat Review minutes and that he intended to install
street improvements including a 5 ft. sidewalk along his property
frontage on Beechwood in alignment with previous improvements installed
by the Goldkist property.
In answer to Madison's question, Scott said he intends to slope the
drainage to the front into a ditch along the Beechwood frontage.
Jones commented that there is an 18" CMP drain tile shown along this
frontage. Scott stated that he will maintain the ditch; Madison asked
that a note to this effect by added to the "as -built" plat. (Jones
added that the 8 copies of the "as -built" should also show where any
utility enters the building as well as any changes that have been
made).
It was clarified that all utilities will be in the 25 ft. building
setback as requested by the various utility companies.

Scott said he has indicated a 12 ft. chip/seal drive, and as there
will be no employees, he will not provide paved parking. He said
clients will want to park in front of their unit to load and unload.
Madison said if parking were desired, it would need to be chip/seal.
Jones said that because of the unusual use which necessitates as many
as 20 doors, it would be difficult to layout parking and Tarvin said
he thought a waiver for parking might be in order because there would
probably be no use for it. Jones cited another case in which a truck
body manufacturer was allowed to park the stored truck bodies on a
gravel surface.
Tarvin asked the width of Beechwood and what amount of it will be
improved. Jones said it is 15.5 ft. from the centerline and Scott
is responsible for the east half improvements (a length of 180 ft.).
Scott said the only improvements installed at this time are in front
of Goldkist. He said the east side parking area may or may not be
paved and he added that the lot will be fence -secured with all renters
having keys as well as individual locks on units.
A Bill of Assurance or a Performance Bond was discussed in lieu of
immediate installment of off-site improvements. Tarvin said he felt
the improvements should not be placed at this time because there are
so no other improvements adjoining it. Scott said he di'dn't mind
signing either of the above mentioned instruments. Jones advised
that Scott need only widen the existing pavement and Tarvin said he
did not approve of this requirement (instituted by the City) as a
complete re -surfacing would be better at the appropriate time.
Tarvin said he thought it would be in Scott's best interest to pave
at least a portion of a proposed parking area as he could then stripe
and number the spaces and rent them to clients. Scott said he would
chip/seal one third of the proposed parking area. Madison advised
paving more spaces as storage is made available to vehicles.
NOTION
Tarvin moved approval of this plat subject to: 1. Plat Review comments;
2. posting a performance bond stating Scott will pay 100% of widening
180 ft. along Beechwood on this site frontage; and, 3. any on-site
vehicle storage space provided will be improved with chip/seal surface.
Madison seconded and the motion to recommend approval passed 2-0-0.
Jones advised that if a Bill of Assurance was accepted, she could
issue a building permit immediately.

THE LAO QUAD
SYCAMORE HEAR LEVERETT
HESS AND GUZMAHN
The second item of consideration today was a preliminary plat by Hess
and Guzmann for the Law -Quad Apartment Complex located on Sycamore
near Leverett, represented by Jeremy Hess.
Hess stated that all drainage from this complex will flow to the creek
and that although a survey has been done on the flood plain, he has
not as yet seen it. He added that if there is a problem with the
proposed buildings being in the flood plain, he has the option of
buying another (adjoining) section of land and moving the entire project
over as many feet as is necessary. He said he would add whatever amount
of fill is necessary to raise the land to above flood plain.
Madison asked about a previous lot split and Jones replied that this
area was platted in ten acre tracts and may be modified at this time
by means of a property line adjustment depending on the report from
the engineer (Ervan Wimberly).
Hess advised that it is the intention of the developers to keep the
density of this project low with as much landscaping as possible in
as he thought he would probably be exempt from the Green Space Ordinance.
Jones stated that there is a record of right-of-way for Sycamore dated
in 1977, a twenty ft. right-of-way which crosses the creek (10 ft. either
side of the center line), and a ten ft. right-of-way from the north
sides of lots 23, 24 & 25 for a total of 60 ft. of right-of-way.
Hess stated that he will place spotlights on the corners of the buildings
instead of streetlights (which are not required).
Madison suggested that this project might be subject to off -sight
Improvements for the Sycamore-Leverett intersection on a "rational
nexus" basis. Tarvin said he did not agree that this property should
be required to participate in those improvements. Madison requested
Hess to eliminate a few parking spaces to provide more green area.
Hess stated that he has increased the utility easements to 25 ft. in
both the front and rear of this development as requested.
Madison inquired as to the fire hydrant situation and Hess replied
that he has spoken with the Fire Inspector who has accepted moving
a hydrant to a more central location.
Madison asked about the softening of the curves within the development
to allow ease of access for service trucks and Hess replied that it
has been corrected. Jones advised that landscaping is required only
at the Sycamore Street radii.

Madison next discussed the amount of fall for the sewer. Tarvin calculated
that it would only take 4/100" (.004) fall per foot (times 12") and
not the 1/4" as had previously been requested. Hess said he will
attempt to install it at 1/8".
In answer to Madison's inquiry regarding the angle of the dumpsters
as requested by the Sanitation Superintendent, Hess replied that he
has addressed that problem and corrected it.
Madison asked why no curb was indicated in the parking area on the
west side and Hess replied that he would install wheel bumpers which
will allow drainage to flow between them and down to the creek.
Hess said that he has notified adjoining property owners but did not
• bring the signed plat; he was requested to do so.
MOTION
Madison moved approval of this plat subject to 1. Plat Review comments;
2. the Planning Administrator being satisfied that proper notification
has been given to adjoining property owners;
3. a fire hydrant being located in the west center portion of the
development; 5. individual curbs with gaps being installed on the
west parking area; 6. the property line being adjusted when the exact
location of the flood plain is determined. (The property line will
be shown on the "as -built" plan); and, 7. a recommendation being made
to the Board of Directors that the 20 ft. north -south (empty) easement
be vacated because it will conflict with the building construction.
Tarvin seconded and the motion to recommend approval passed 2-0-0.

JOYCE, FRONT & STEARNS STS.
LINDSEY CONSTRUCTION
The third item of consideration today was a preliminary plat for Block
9 of the AW Subdivision located at the intersection of Joyce, Stearns
and Front Streets and represented today by Gary Carnahan.
Madison reflected that the Street Superintendent has indicated he
is not happy with having a drive on Joyce Street. Carnahan said he
has compromised by placing the drive further west than originally
platted and directly across from Front Street. Jones advised that
a permit for this drive would have to be issued by the State Highway
Department. Madison asked if two points of ingress/egress were required
and Carnahan replied that they were platted for convenience only. Madison
said she thought it would be quite difficult for people leaving this
development and going to the Northwest Arkansas Mall. Jones suggested
Carnahan get some input from the Highway Department regarding the
off ramp that could empty into this street configuration.

Tarvin commented that there is no site problem exiting from the drive
on Joyce and it would be more convenient. He added that the main
flow of traffic will use Joyce Street. Jones agreed and advised that
the Board is working on ways of encouraging people to use Joyce rather
that Zion Road. Madison said she could possibly support the Joyce
Street drive if it were one-way (entrance only). Carnahan said he
would accept that stipulation if he could put an additional drive
on Front Street.
Steve DeNoon, Lindsey Construction, explained that moving the proposed
drive further west on Joyce, eliminates the confusion of adding new
traffic from the stream of west -bound Joyce Street traffic narrowing
from four lanes to two and that the new proposed location is the least
impacted.
Madison inquired as to parking requirements and Carnahan replied that
it is one per 200 for retail space and that he has provided 42 spaces
where 41 are required. He added that he has shown the sidewalk south,
all the way to the telephone building.
Jones explained that there had been a previous agreement with Kathy
Burke with AW Realty, that sidewalk would be installed to this extent
at such time as any further development takes place on this lot.
Carnahan said the drainage will flow to a ditch along the highway
which then flows back towards Arkansas Western Gas Co. and into Mud
Creek.
Madison asked about the proposed widening of Highway 471 (old 71)
(as per Powell's comment - Plat Review) and Carnahan replied that
he thought Powell meant Joyce Street. Jones said Powell wants to be
certain that there 1s an 80 ft. right-of-way between this property
and the one on the north side of Stearns. She said that based on
given easements, there is a minimum of 80 feet of right-of-way.
Madison asked if the planter on the radius could be removed and the
radius mirror that of the other corners. She also suggested that
the drive encircle the development and Carnahan agreed adding that
he could pick up a few parking spaces by doing so.
MOTION
Tarvin moved approval of this plat subject to 1. Plat Review comments;
2. reshaping of planter island at northwest corner; 3. addition of
an access drive connecting the parking areas; and 4. low -
growing ground cover in the intersection (NE) area. Madison seconded
and the motion to recommend approval passed 2-0-0.
There being no further business, the meeting adjourned at 5:40 P.M.
