HomeMy WebLinkAbout1983-12-09 - MinutesMINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held Friday, December 9, 1983 at 1:30 p.m. at the Fayetteville Chamber of Commerce. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Don Hunnicutt, Barbara Crook. Melanie Stockdell. Tom McMillan and Lyndon Holmes Bobbie Jones and Jeanette Crumpler With no additions or corrections, the minutes of the November 14, 1983 meeting were approved as mailed. MINUTES The only item of business for review by LARGE SCALE DEVELOPMENT the Subdivision Committee was the Large OZARK FOREST PRODUCTS Scale Development of Ozark Forest Products. 833 Beechwood Avenue Bobbie Jones began by submitting Ozark Forest Products' letter requesting a waiver of the screening requirement on property boundaries adjacent to Highway 62 and Beechwood Avenue and to place vegetation instead. Jones advised that the only area which had to be screened was the outdoor storage areas. Jones advised that the Subdivision Committee would either need to make a recommendation in regards to this shrubbery or make note that the Planning Commission needs to discuss this matter. Hunnicutt clarified the necessity for requiring screening adjacent to residential property. McMillan stated the only piece of residential property was across from Beechwood on the corner itself, and advised that Ozark Forest Products would be screening directly across the street from that. Jones advised that screening was for the purpose of obscuring from view any outdoor storage areas that can be seen from abutting streets. McMillan stated he was in the process of trying to clean up the Ozark Forest Products area and advised that the southwest corner is used for log storage which is visible at a distance. Across the railroad tracks, i.e., the west central area is used for stickered lumber for air drying. McMillan then explained the process which is involved in curing the lumber. The northwest corner is a chip pile which is decreasing quickly. Barbara Crook asked if the Loblolly Pines would qualify for that which is required by the ordinances. Jones advised that the Codes provide by Article 8, Section 10, Subsection (d), that the Planning Commission can waive or grant a variance from the requirement in those instances where strict enforcement would cause practical difficulty due to circumstances unique to the property under consideration, if it is demonstrated that such action will be in keeping with the spirit and intent of the ordinance. The Planning Commission may impose reasonable conditions in granting such a variance. In areas where variances are granted, there should be some landscaping installed. Crook stated her only question would be type of planting. Hunnicutt advised there were some other people on the Planning Commission that have some other ideas on the planting, thus, this matter probably should be discussed at the Planning /37 SUBDIVISION COMMITTEE • Page two December 9, 1983 Commission meeting. McMillan asked if he planted all along his east property line, this would cross concrete drive and would not feasibly be able to plant where the existing concrete parking is. Jones advised that when the Gas Company asked for the easement, Mr. Wagner first said a 50' easement because there is a high pressure gas line. She advised she did not think the minutes reflected this, but thought she understood the matter might be negotiable down to 50' from the center of the street. Jones stated that with a high pressure gas line, you could not build within 25' of the line. Therefore, if he had 25' on one side of it, that would allow 50' from the center of the street. Hunnicutt requested to know what was currently existing at the Ozark Forest Products location. McMillan advised that everything on.the plat is presently in existence except for the dry kiln area shown north of the SPUR. Jones stated this project fell over 10,000 square feet and therefore had to go to large scale development. McMillan questioned at this Subdivision Committee Meeting, as he had at the Plat Review Committee Meeting, the possibility of future intent of the property owners to sell Highway frontage for development, and wanted to know if it would be 0. K. to place the trees behind the line of possible intended sale. The Subdivision Committee advised that they did not see anything wrong with this, as a matter of fact, they thought this may be better. Don Hunnicutt suggested the utility easement along Beechwood should probably be left up to the property owner and the Gas Company. Barbara Crook advised the only thing she could see was the need for Bills of Assurance on sidewalks and future improvements.:along Beechwood. McMillan advised that it was his understanding that Mrs. Jones would prepare these Bills of ... Assurance, being sidewalk on Highway 62 as well as the 50' easement along Beach- wood Avenue both of which would have to be signed by the owners of the property. Crook then reiterated that she waslnot referring to sidewalks, but curbs, gutters and paving of Beechwood at the call of the City when it is improved. McMillan stated there would be no problem with this at all. McMillan stated that the only thing he had objection to was when the State made their improvement, the possibility of him having to tear this out and replace sidewalk at the call of the City. He was again advised that this would not be the case, that he would just leave the 4-8' asphalt strip which was installed by the State and place a 5' concrete sidewalk in back of it. McMillan questioned that where the main drainage under Highway 62 was put in by the State, there will be a bridge required at that point, or Ozark Forest Products will have to tear the bridge out and rebuild. He stated that the State allowed just enough room for- the main drainage structure. He stated if he had to put another two feet in, he would have to build a structure to match this. Jones advised that she could not say that the City would help, but she stated there may have been some instances when they have helped other people bridge across drainage outlets, and Ozark Forest Products would just have to work with the Street Department on this. McMillan advised that even though Ozark Forest Products has not been the delight of the City, they have recently gone through an extensive program of upgrading the facility and to be a good neighbor in the area. Bobbie Jones stated that when Mr. McMillan first came in, she knew that the principal operation did require I-2 zoning. After talking with him about what was planned in this particular building, she felt it compared somewhat to a lumber yard storage which is allowable in the I-1 zoning. She stated she made the interpretation that it would be allowable in an I-1 even though the sawmill operation • 13f • • SUBDIVISION COMMITTEE Page three December 9, 1983 had to be in an I-2. She advised that the property south of the railroad track is I-2 and north of the track is I -l. Jones also advised that calls were received from people in the neighborhood who stated that they remembered going to a Board of Directors meeting in which Ozark Forest Products stated they would not do anything north of the railroad track. She stated she could not find any- thing in any of the minutes that indicates that they ever made that type of commitment. In 1976, they did petition for rezoning of the total property to I-2. The Planning Report recommended only that portion south of the track and Mr. Love stated this was acceptable to.them because they thought the property north of the track was of more value to them as I-1 than it was as I-2. The Planning Commission subsequently recommended rezoning only that portion south of the track. That is what the Board acted upon and approved. She stated she could not find anything in which Mr. Love stated that they did not plan to develop north of the tracks. McMillan advised this was largely an open-air shed. Incorporated in this shed is an approximately 30' x 30' square building which will be a dry kiln. This will be a wood frame construction and will be adjoining to the roof line of the steel shed itself. He advised that the dry kiln works on a dehumidification basis and would be all electric. Barbara Crook moved that the Subdivision Committee -MOTION recommend approval of this Large Scale Development with 1) Bill of Assurance being provided for the sidewalks on Highway 62 to be built on the call of the City; 2) Bill of Assurance for improvements on Beech- wood, Ozark Forest Products assuming their proportionate share of the cost of the improvement along that street, also to be constructed upon the call of the City; and 3) that vegetation be provided in lieu of screening along Highway 62 returning southward to the north right-of-way for the SPUR and'akan along Beechwood south of the existing development at Ozark Forest Products. The type of vegetation is to be determined by the Planning Commission. 4) Subject to other Plat Review comments. Some discussion was carried on about the particular type of vegetation which would be planted and the height of the vegetation. Crook reiterated that this would be discussed at length at the Planning Commission meeting as there are several members on the Planning Commission who are very concerned'with planting. Jones advised that these plants may not meet the required height (18") when planted, but they will in a very short time. Hunnicutt advised that if all goes well at the Planning Commission, then the plants will be alright. Mr. McMillan proposed that the plants along Highway 62 be set back into the property but':northaof,_the buildingtratherythancnear the right-of-way line. Crook stated she thought that would be preferable than having the plants at the right-of-way line. Hunnicutt seconded the motion to approve.
