A meeting of the Subdivision Committee of the Planning Commission was held
on Friday, June 10, 1983 at 1:30 P.M. at the Central Fire Station,
Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Don Hunnicutt, Barbara Crook, Melanie Stockdell
MEMBERS ABSENT: None
OTHERS PRESENT: Randy Dodd, Johnny Quinn, Bobbie Jones, Suzanne Kennedy
Barbara Crook moved to approve the MINUTES
Minutes of the Subdivision Committee meeting of
May 20, 1983 as distributed. The motion was seconded by Don Hunnicutt and
approved, 2-0, with Melanie Stockdell not yet present.
The next item of business was consideration LARGE SCALE DEVELOPMENT
of the large scale development plan for CHICKEN COUNTRY RESTAURANT
Chicken Country Restaurant to be located 1889 NORTH COLLEGE AVENUE
at 1889 North College Avenue and zoned
C-2, Thoroughfare Commercial District. Randy Dodd was present to represent
the owner.
A revised plot plan was distributed by Bobbie Jones. It was confirmed for
Don Hunnicutt that the required legal description had been submitted.
Randy Dodd told Barbara Crook he understood the requirement for five feet of
additional right-of-way to be dedicated, making the right-of-way 25 feet from
the center line; he said he understood there was no sidewalk requirement for
Green Acres Road and that at some point there will have to be additional paving
of 15'6" from the center line, to meet Clayton Powell's requirement. Don
Hunnicutt asked if there would be continuous storm drains on Green Acres Road
and Bobbie Jones said that was Clayton Powell's requirement. Mr. Dodd said
he understood they would be signing a Bill of Assurance for sidewalk to be
built along College Avenue and the dedication of utility easements.
Chairman Hunnicutt stated the Subdivision Committee can approve this Large
Scale Development, as there are no waiver requests to go before the Planning
Commission.
Barbara Crook moved the Subdivision Committee approve the
Large Scale Development plan for Chicken Country Restaurant, MOTION
subject to Plat Review comments which include the dedication
of additional right-of-way for Green Acres Road and a utility easement along
College Avenue, a performance bond for the street work and drainage on Green
Acres Road be supplied and execution of a Bill of Assurance for a sidewalk on
College Avenue. The motion was seconded by Don Hunnicutt and passed, 2-0,
with Melanie Stockdell not yet present.
Randy Dodd asked about the procedure for having an existing fire plug removed and
Bobbie Jones referred him to the City Water and Sewer Department. Don Hunnicutt
asked aobut the fire zone and Bobbie Jones reported that Freeman Wood had said the
wood and shingles being used are specially treated.

The final item on the agenda was LARGE SCALE DEVELOPMENT
consideration of a large scale development ANDREW CORPORATION
plan for the Andrew Corporation, to be CITY LAKE ROAD
located east of City Lake Road and south
of Burlington Northern Railroad in the Industrial Park area and zoned I-1,
Heavy Commercial and Light Industrial District and I-2, General Industrial
District. Johnny Quinn was present representing McClelland Consulting
Engineers.
Bobbie Jones stated all revisions have been made, and said her office will
prepare a Bill of Assurance for the sidewalk to be built on City Lake Road.
She said the City cannot require improvements to the street as City Lake Road
is a state highway. Barbara Crook noted additional right-of-way has been
shown on the plat, but said a vicinity map for the property does not appear
to be shown on the plat. Quinn stated the vicinity map appears on a separate
sheet which was attached to the first plats.
Barbara Crook stated she saw no drainage problems.
Don Hunnicutt asked if there were still plans to move a gas line, and Quinn
showed Hunnicutt on the plat where the relocation would take place.
Johnny Quinn said they have already applied for driveway permits from the AHTD,
that he had talked with a highway department representative who told him that,
without a waiver, they may not have a 60 foot radius (50 feet is the maximum
allowable radius). Quinn explained for Bobbie Jones that the bigger the radius,
the more sweeping the turn. Bobbie Jones said Clayton Powell, for this
situation, is recommending the Planning Commission okay 80 feet of right-of-way
rather than 60 feet. Quinn said what they are requesting would require a waiver
from the City, not from the AHTD. Bobbie Jones said, if the Highway Department
would consider a waiver, the Planning Commission may want to word it to grant a
waiver for more, if the Highway Department is willing to waive it more. Quinn
said he did not think 60 feet is really needed, that the actual turning radius
needed is 45. feet, so that 50 feet should accommodate it.
Barbara Crook noted there was no parking outlined on the plat and asked Bobbie
Jones if she was satisfied there was adequate parking per square footage.
Don Hunnicutt said he thought some parking requirements had been waived in the
Industrial Park, citing American Air Filter as an example. Bobbie Jones said
she did not recall a waiver being granted, but thinks there was discussion
about changing Code requirements. She said the spaces were not totally
dimensioned on the plat. Melanie Stockdell arrived at this point. Johnny Quinn
said they show 116 spaces on the plat and Jones said her rough calculations of
floor space would require 126 spaces Quinn said this would simply mean
lengthening the parking lot in order to add more spaces. Bobbie Jones said
she is most interested that each phase of construction have parking which
complies with the code requirements, as of the effective date of the building
permit. She said the separated drive for employees and visitors has been changed
to a single driveway.

Barbara Crook said at the last Planning Commission meeting the wording was
not clear in discussion on the lot split for Andrew Corporation. She
suggested it might be stipulated in the approval that until the option to
buy the 27 acres to the east is exercised or a subdivision plat including
these two parcels is filed, no structure shall be constructed which would
violate setback requirements from street right-of-way along the north
boundary of this property or in any way interfere with construction of a
street. She said this would preserve for the City the option of a street and
give some flexibility. She said she feared a building being sited on the
parcel without a clear understanding of what the City is requiring.
There was discussion about from which direction a future road would come into
the property in question. Quinn said he thought it most likely a future road
would come off Armstrong Avenue. Bobbie Jones said there is a minimum 50 foot
setback requirement from a right-of-way adjoining industrially zoned property.
Hunnicutt said he did not think Subdivision Committee could go back to
Planning Commission and change their action on the lot split, other than to
simply express concern. Johnny Quinn said he recalled Dale Christy signing a
letter, on behalf of the FIDC, guaranteeing a right-of-way to the land -locked
parcel, wherever it came from. Don Hunnicutt said Ernest Jacks had moved
approval of the lot split at Planning Commission meeting .."with the provision
that, if the 27 acre parcel is left land -locked, then the Industrial Corporation
would subdivide and build a street." Hunnicutt said he doesn't see much problem
in granting a variance on a setback in the Industrial Park. He said he thought
the motion takes care of the problem of getting a street to the parcel. Bobbie
Jones said the Master Street Plan calls for Willoughby Road to meet Armstrong
Avenue at some future date, which will provide an alternative to taking Armstrong
Avenue north to 15th Street to get back to City Lake Road. Hunnicutt suggested
this be discussed again at next Planning Commission meeting.
Barbara Crook moved to recommend to the Planning Commission the
approval of the large scale development for the Andrew Corporation MOTION
as submitted, subject to the following: 1) Plat Review comments;
2) compliance with Code requirements on number of parking spaces; 3) approval of
a 127 foot curb cut for driveway width (changed from 87 feet originally requested);
4) that future buildings #3 and #4 be required to maintain a 50 foot setback from
the north property line or from any future street right-of-way along that north
property line. The motion was seconded by Melanie Stockdell and passed, 3-0.
Melanie Stockdell asked why the telephone company had required an extra five feet
be added to the 25 foot easement along City Lake Road, if sidewalk is included
Johnny Quinn said the AHTD, in this case, will allow them to build a sidewalk
in the highway right-of-way but, if they expand the right-of-way in the future,
Andrew Corporation would have to tear up the existing sidewalk and re -build a
new one five feet over, so Quinn has recommended the sidewalk be built on the
owner's property.
With no further business, the meeting adjourned at 2:25 P.M.
