HomeMy WebLinkAbout1983-03-11 - MinutesMINUTES OF A MEETING OF THE SUBDIVISION COMMITTEE A meeting of the Subdivision Committee of the Planning Commission was held at 1:30 P.M. on Friday, March 11, 1983 at the Chamber of Commerce, Fayetteville, Arkansas. MEMBERS PRESENT: Don Hunnicutt, Barbara Crook MEMBERS ABSENT: Melanie Stockdell OTHERS PRESENT: Rick Cowdrey, Bobbie Jones, Suzanne Kennedy It was moved by Barbara Crook, seconded by Don Hunnicutt and passed, 2-0, to approve the Minutes of Subdivision Committee meeting of February 25, 1983, as distributed. The only item to be considered at this meeting was approval of the final plat of Sequoyah South, Phase I, a Planned Unit Development, to be located north of Huntsville Road, west of the end of Fifth Street and south and east of the end of Rogers Drive, Sequoyah Land Company, owner and developer. Property zoned R-1, Low Density Residential District. Barbara Crook asked how far the paving would extend into the cul de sac on Overland Trail. Cowdrey said there had been a variance granted allowing them to stop the paving where the radius of the cul de sac begins. Bobbie Jones checked the file and said on August 23, 1982, the Planning Commission approved a Bill of Assurance that if two years subsequent to the date the street is completed, the road was not extended, the cul de sac then would be built and to enforce the 100' setback on the north in case the property is sold without further PUD development. Barbara Crook asked if anything had been resolved on paving Fifth Street. Bobbie Jones said it would be paved to Sherman. It was agreed the changing of the street name is a function of the Board of Directors. Crook asked if recording information, would be ,shown on the plat for off- site easements. Cowdrey said they would incorporate that information on the plat all at one time, that all the easements will be recorded as of today, with the exception of the 15 foot easement on the north referred to by Dick Shaw in Plat Review Committee. Cowdrey said that easement is filed at the courthouse as a City water and sewer easement but that, when the next phase is built, they intend to incorporate it into a regular easement. He said Dick Shaw's request had been, when the next phase began, that an additional ten feet be added to that easement which is now only for 15 feet, but the question was what to call the easement. Cowdrey said he did not think they needed to record the small section of that easement now when it would not be used for Phase I and when it will just have to be expanded and recorded later to include other utilities for Phase 2. MINUTES FINAL PLAT SEQUOYAH SOUTH, PHASE I SEQUOYAH LAND COMPANY q5 J • • Subdivision Committee Minutes March 11, 1983 Page Two Hunnicutt suggested, when the next phase is submitted,,the easement question on the north will come up again and Bobbie Jones suggested she could contact the Telephone Company to see if they would accept a letter saying the easement will be taken care of when the next phase develops. Cowdrey said also that he would change the wording on the plat from "drainage and utility easement to sewer easement to be consistent with that part of the easement in the Southern Heights Addition. Cowdrey said they now have the area to sub -grade. In answer to Bobbie Jones, he said they would want a contract for the incompleted improvements. Barbara Crook asked about covenants to be noted on the plat and Cowdrey said they were not filed yet - he had intended to note them on the plat after they:were filed, with book and page numbers. He said he has hesitated to file them because there is a probability the Secretary of State would begin assessing for maintenance costs to the Property Owners Association at the time of filing and he wanted to look further into this. Bobbie Jones suggested Cowdrey try to have them begin assessments when the first lot is sold or perhaps when the first building permit is issued. Jones said the Code requires the City be made a third party beneficiary in the covenants to insure the maintenance of private streets and common areas. Barbara Crook said a notation on the plat that "4 foot sidewalks are to be installed in residential neighborhoods...by person(s) obtaining the building permit" conflicts with the statement in Plat Review comments, "Cowdrey stated the developer will install sidewalks as the buildings are finished." Cowdrey said this was a standard notation for subdivision plats and he had not been sure whether to use it since the developer does intend to build the sidewalks. Hunnicutt suggested the note on the plat simply alerts the owner they must pay for the sidewalks, even though the developer obtains the building permit and actually constructs the sidewalks. Bobbie Jones said her reason for bringing up this point in Plat Review Committee was because the main part of the sidewalks are shown along the common areas. Crook said Plat Review minutes state "...these would be installed before the first units are sold..." Cowdrey said the sidewalks along common areas would, theoretically, be owned by the Homeowners Association and, if they were not built within five years, the Association would have to build them, but FHA requires sidewalks be completed before guaranteeing financing. Bobbie Jones said, when a building permit is applied for, she will ask for sidewalks to be finished for the part being worked on. Barbara Crook moved to recommend approval of the final plat of Sequoyah South, Phase I, with the following conditions: MOTION 1) that reference to covenants be added to the plat; 2) that recording information on off-site easements be added to the plat; 3) that the park area requirement will be worked out; and 4) that the Bill of Assurances will be provided on the construction of the cul-de-sac and 100 foot setback as per preliminary plat review comments. The motion was seconded by Don Hunnicutt and passed, 2-0. 46
