HomeMy WebLinkAbout1983-02-25 - MinutesMINUTES OF THE SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held at 11:00 A.M. on Friday, February 25, 1983 at the Chamber of Commerce, 123 West Mountain.. Street, Fayetteville, Arkansas. MEMBERS PRESENT: Don Hunnicutt, Melanie Stockdell MEMBERS ABSENT: David Williams, Barbara Crook CITY STAFF PRESENT: Bobbie Jones, Suzanne Kennedy, Sandra Carlisle, Connie Edmonston OTHERS PRESENT: Johnnie Quinn, Jim Lindsey, Delvin Nation, Major Don Johnson It was moved by Melanie Stockdell, MINUTES seconded by Don Hunnicutt and passed, 2-0, to approve the Minutes of the last Subdivision Committee meeting of February 11, 1983, as mailed. The next item of business was to consider approval of the Large Scale Development Plan for "Walker Park North" lying north of East 13th Street, west of South Block Avenue, south of the Naval Reserve Training Center, and primarily east of Tin Cup Creek, zoned P-1, Institutional District. This is being developed as a Community Development Project. Chairman Hunnicutt explained that waivers are being requested of the separation distance required between "R" zoned property and the softball and soccer field areas and future spectator facilities (Article 7, Section 14, Zoning). Sandra Carlisle was present to represent the City Community Development Department and Johnny Quinn was present to represent McClelland Engineers. Bobbie Jones added that waivers also would be requested of the Board of Adjustment to allow on -street parking and of the Board of Directors for an amendment to the Master Sidewalk Plan. Johnny Quinn stated they had revised the plat to incorporate the requested easements and that the street rights-of-way have already been vacated. Bobbie Jones said.the.Board of Directors must authorize the Mayor and City Clerk to execute the easements. Jones said they had decided not to use a sanitation container at this time; and that communication had been made with Freeman Wood regarding the flood plain. Quinn said he knows they are not in the flood way and thinks it is marginal whether they are in the flood plain. He stated he had measured from the creek, not from the streets. Jones explained to Hunnicutt this development must go before the Planning Commission only because of the waiver request. Sandra Carlisle said notification had been sent to adjoining property owners and Quinn stated 18 out of 21 had returned cards of receipt. LARGE SCALE DEVELOPMENT PLAN WALKER PARK NORTH COMMUNITY', DEVELOPMENT PROJECT CITY OF FAYETTEVILLE C`3 Subdivision Committee Minutes February 25, 1983 Page Two Bobbie Jones said all 21 persons were not adjacent property owners and the list was more extensive than what is required for a large scale develop- ment notification. Bobbie Jones quoted from the Code of Ordinances, Article VII, Section 14, as to the requirements for spectator facilities as stated in her Plat Review comments of February 10, 1983, under Item 9(h), and she stated this applies only to a portion of the property along the west side where the creek goes off the property. Hunnicutt requested a copy of the zoning map for the Planning Commission meeting. In response to Clayton Powell's plat review requirement as to drainage improvements, Johnnie Quinn explained there is only one drop inlet on the west side of Block Avenue near the site, that the revised plat shows a drainage easement similar to that requested by the Street Department. He said since construction monies have not been budgeted to capture this storm runoff in a pipeline all the way to Tin Cup Creek, it follows that storm runoff must continue to be handled via ditch until further development of the site. He said to construct a new ditch within the delineated drainage easement would route storm water flows closer to the proposed improvements than they would otherwise go and he believes the Parks Department should enclose the storm flow in pipe within the drainage easement at the time improvements are made to the southernmost softball field area. Sandra Carlisle said the City will dedicate a storm sewer easement for future development. Bobbie Jones said Powell had stated he did not want complaints in the future about a soggy hall field, and he was sent a copy of Mr. Quinn's letter of response to Plat Review comments. Don Hunnicutt said he felt there should be some assurance that other properties will not be affected by a drainage problem. He said, pending a response from Clayton Powell, additional comments should be added to the paragraph on the plat under "Drainage Easement" that, as future development occurs, drainage pipe will be put in to Tin Cup Creek. In answer to a question from Stockdell, Bobbie Jones said that sidewalk and easement requests were submitted to the City Manager's Office but do not appear on the upcoming Board agenda. Melanie Stockdell moved (1) to recommend approval of the Large Scale Development, (2) that Clayton Powell respond to Item 7 in Mr. Quinn's letter of February 16, 1983 before Planning Commission meeting and (3) the waiver request be heard by Planning Commission when members of the public can be present. The motion was seconded by Don Hunnicutt and passed, 2-0. Next was consideration of approval of the Large Scale Development Plan for a Corps Community Center for the Salvation Army to be located on the south side of Fifteenth Street immediately east of Southgate Shopping Center, zoned C-2, Thoroughfare Commercial District, and consideration of a waiver request on the requirement to provide view -obscuring screening between this property and the "R" zoned property to the east with landscaping in lieu LARGE SCALE DEVELOPMENT PLAN CORPS COMMUNITY CENTER THE SALVATION ARMY W. Delvin Nation was present to represent architects Smith -Russell -Nation and Major Don Johnson and Jim Lindsey were present representing The Salvation Army. Major Johnson explained to Connie Edmonston that the Salvation Army has an ongoing youth program for children of all ages, that they are building a youth hall and activity rooms and they have discussed a need for a gym and perhaps a swimming pool for the future; he said they have talked to the School Board about trying to serve the south Fayetteville area because it was felt many of those youth were not participating in other youth programs. Hunnicutt stated there is a request today for a waiver of the fence requirement because the property line lies in the center of the creek. Delvin Nation, said notice was given to adjoining property owners by way of advertisement in the newspaper for the time of the Plat Review meeting. Bobbie Jones said she had not been contacted by adjoining property owners, and that property owner Bryan Walker was the only person required to be notified. Jim Lindsey stated they had been contacted only by a Mr. Askew, property owner to the West. Bobbie Jones said the only other notice to the public would be the agenda for Planning Commission meeting to be published the Sunday before the meeting. Bobbie Jones noted a correction to Plat Review Minutes of February 17, 1983, page two, under comments from the City Fire Department, in the last paragraph. She said it should be worded "to eliminate the exit marker on the individual sleeping areas, but keep the exit marker on the main hallway." Jones said, as to her own comments on page 3, (10)b: Right-of-way easements are needed to widen 15th Street and a legal description must be sub- mitted to her office. Jones reiterated her plat review comment that if the property was split from a larger parcel when it was purchased, a lot split must be processed, unless proof is submitted on when this parcel was created. She asked that this information be submitted. As to sidewalks, Jones said the sidewalks must be ramped down to the drive- ways for the handicapped. She said this holds true on arterial and collector streets and for all commercial development. Major Johnson stated they would wish to abide by this requirement anyway as many of their clients use wheel- chairs. Delvin Nation said he had contacted the Highway Department and they have given permission for sidewalks to be constructed on Highway Department right- of-way. Bobbie Jones said, for that part of the property where the sidewalk would meet the creek, a letter might be written requesting the Board of Directors to assist in the construction of a bridge -type crossing, or asking to terminate the sidewalk at that point, or for the developer to offer to pay only the cost of a standard sidewalk for that distance. There was some discussion of where the property line actually was at that point, and it was decided some confirmation is needed on that point. Jim Lindsey spoke on behalf of the Salvation Army and stated he thought the fund raising efforts of Major Johnson were awesome. Don Hunnicutt asked Bobbie Jones about any zoning problems for this use. Jones stated the site is zoned C-2, Thoroughfare Commercial, and stated welfare or social agencies, a thrift store, offices, chapel, hotels and motels are all permitted uses in that zone and she felt the Salvation Army's uses all fit somewhere into these categories. 43 J • • Subdivision Committee Minutes February 25, 1983 Page Four Melanie Stockdell moved to recommend approval of the Large Scale Development and waiver on screening, subject to determination of the need for a possible lot split, submittal of description of the right-of-way needed along the north property line and confirmation of the Planning Administrator's interpretation of permitted uses in the C-2 zoning district. The motion was seconded by Don Hunnicutt and passed, 2-0. 44
