HomeMy WebLinkAbout1982-11-05 - Minutes• • • • MINUTES OF A MEETING OF THE SUBDIVISION COMMITTEE A meeting of the Subdivision Committee of the Planning Commission was held at 1:30 P.M. on Friday, November 5, 1982 at the Chamber of Commerce, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Chairman Don Hunnicutt, Barbara Crook Melanie Stockdell, David Williams Ervan Wimberly, Al Harris, Suzanne The only item of business to be considered was approval of the final plat of Northview Heights Addition located south of Rolling Hills Drive and east of North College Avenue; J. B. Hays, owner and developer. Ervan Wimberly and Al Harris were present to Chairman Don Hunnicutt said that would not be present and that she had final plat was regarding an easement. Ervan Wimberly explained the easement was a legal question only. He showed on a map where Hays owned property and where adjoining land owners owned property and stated some 25cfoot strips of land had been dedicated as a street easement. He said the owners have agreed that when the street was put in, it was moved over. He said there is a legal description made up for a narrow strip of land, that the right of way is dedicated, they have more than fifty feet and he will ask the Board of Directors to have vacated the portion they don't'.need.. Barbara Crook asked if the recording. information required to be on plat had been added. It was noted this now: appeared on./the final. plat. It was noted that.Northview'Drive had been changed,toGolden Eagle as required. Ervan Wimberly. stated Phase.1.was really Tract 1, but.for purposes.o,f deed records, they are showing:aLl the,other tracts on.,the.final'plat, There was .some discussion about the b,uilding;;settiack requirement of 50 feet, unless there'is landscaping with no parking.b'etween'the-building and,the street. Wimberly had revised the plat to show.-the.50 foot requirement out expressed the opinion that, if there is, a;choice between'using•a 501footsetback and using the 35 foot setback,,with.required landscaping and no parking between.the building and the street/be would prefer to simply indicate on the plat that the building setbacks will be in accordance with the City ordinance, rather ;ban 'indicating 50 feet on the plat. ''He stated that Tract 3 is going to be difficult to develop and he would like some leeway on that tract as.to choice of setbacks. Barbara Crook suggested that, for recording purposes, a uniform setback should be shown for,.all tracts. She suggested Wimberly might indicate a 35' setback for Tract 3 if he wished, with landscaping and no parking between the building and the street to be noted and then the Planning Commission can see what the intent is for the other tracts. She noted Bobbie Jones had stated the setback should be 50' unless there is landscaping, etc., but that she didn't say that 50' must be used for every tract. Planning Administrator, Bobbie Jones, stated her only question on the revised the final Drive • • • Subdivision Committee November 5, 1982 Page Two Wimberly stated Building A may need a fire escape, which would be masonry but which might protrude about a foot into the setback. Wimberly stated the second page of the plat was added at the request of the attorneys preparing the covenants, and refers to building restrictions for Tract 1. Barbara Crook noted that Bobbie Jones had asked for the ratio of parking spaces to square footage be shown on the plat. Hunnicutt noted that on page two parking spaces were drawn in but not numbered, and that a notation was made for floor area square feet. Barbara Crook said there should be a statement on the plat regarding this, as required in Plat Review comments. Barbara Crook noted all four street lights were shown on the plat. Wimberly stated that, if the power company has not completed their work on this before the plat is finalized, he understands he must post a bond. Wimberly stated the sidewalk has been measured and it is five feet wide. Barbara Crook asked Wimberly if he would be requesting a waiver of the setback regarding height. Wimberly said they would not, as they are not in excess on that requirement. Barbara Crook asked about the requirement to submit a copy of the Property Owners Association. Wimberly stated there was no P.O.A. as of yet, but that the Covenants provide for one to be set up. Barbara Crook asked, if the plat were to be approved subject to completion of items mentioned in Clayton Powell's final inspection, would there be any problem on completing any of these. Don Hunnicutt pointed out the City Engineer would not sign off on the plat until those items were complete. Wimberly pointed out he could not be responsible for items in Clayton's letter such as incomplete utility construction. Barbara Crook noted that, in Plat Review comments, it states that a perfor- mance bond can be executed if these items are not completed. Barbara Crook moved to recommend approval of the final plat, subject to Plat Review comments, with one change to be made MOTION before the plat is recorded; that, in regard to Plat Review comment 9(d), a 35 foot building setback be shown with landscaping and no parking between the building and the street on all tracts, and with a note to be included on the plat stating this. Wimberly stated he could bring a revised plat to the Planning Commission meeting but did not think he could have copies made by then. The motion was seconded by Don Hunnicutt, and passed, 2-0. Barbara Crook asked a question about the drainage from the north hillside into the detention pond. Wimberly stated the parking lot drains into the storm drain system and the roof water probably will also. He said the rest of the drainage will sheet flow from the undeveloped area into the pond. He said the detention pond is dry except when there is a heavy rain. Barbara Crook said she was over -estimating the amount of water to be created by the drainage ditch, and at first had thought the ditch would be too small. Hunnicutt stated this was a point brought out on preliminary plat discussions. The minutes of the October 22, 1982 Subdivision MINUTES Committee meeting were approved as mailed. With no further business, the meeting adjourned at 2:05 P.M. 83
