HomeMy WebLinkAbout1982-08-20 - Minutess • • SUBDIVISION COMMITTEE MEETING MINUTES A meeting of the Subdivision Committee of the Planning held at 3:00 P.M., Friday, August 20, 1982 in the Directors Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Chairman Don Hunnicutt, Barbara Crook, Melanie Stockdell David Williams Commission was Room, City Rick Cowdrey, Jim Stephens, Bob Oliver, Suzanne Kennedy, Bobbie Jones The minutes of the July 23, 1982 meeting of Subdivision Committee were approved as mailed. Consideration was given to approval of the preliminary plat of Sequoyah South, a Planned Unit Development, Phase 1, to be located north of Huntsville Road, west of the end of Fifth Street and south and east of the end of Rodgers Drive; Sequoyah Land Company, owner and developer. Property zoned R-1, Low Density Residential District. Rick Cowdrey, Bob Oliver and Jim Stephens were present to represent Cowdrey and Associates, Inc., Engineers and Surveyors and the developer.. Chairman Don Hunnicutt brought up the letter of request regarding the elimination of the sidewalk requirement. Bobbie Jones stated she felt this is an off-site improvement which the Planning Commission can rule on and would not have to be referred to the Board. of Directors. Rick Cowdrey stated that the owner had decided to withdraw this request to waive the sidewalk requirement after hearing Clayton Powell's comments. Barbara Crook asked how much of Fifth Street they are proposing to pave between the development and Sherman Avenue. Mr. Cowdrey said they would pave all of it. Don Hunnicutt brought up the letter of request regarding the delay of the construction of the cul de sac at the west end of Fifth Street, and Clayton Powell's recommendation that, if the delay is granted, a Bill of Assurance be executed stating that, if the delay is granted, a Bill of Assurance be executed stating that, if the street construction is not completed within two years, the cul de sac would be constructed at that time. Bobbie Jones stated that Clayton Powell also asked that the street be constructed to the west side of Lot Two. Rick Cowdrey stated they agree with all of Clayton Powell's comments. Bobbie Jones said that Don Osburn, Water and Sewer Meter Foreman, was not present at the Plat Review meeting to give his comments. She said, referring to the Concept Plat, Rodgers Drive goes into Southern Heights, Phase One and forms a T at the south end of that subdivision which is also on the northwest MINUTES PRELIMINARY PLAT - SEQUOYAH SOUTH PLANNED UNIT DEVELOPMENT - PHASE ONE SEQUOYAH LAND COMPANY FIFTH STREET $ RODGERS DRIVE • 74 • Subdivision Committee Meeting August 20, 1982 Page Two side of the proposed PUD, which we all assumed would continue as Rodgers Drive. She said Rodgers Drive ties into Fifth Street and the question arises as to what to name this proposed section of street, and at what point. Bobbie said Don Osburn suggests that Rodgers Drive stop as platted in Southern Heights and the newer portion at the T at the end of Rodgers be given another name all the way down and back into its intersection with Sherman, which means the Board has to change the name on the platted portion of Sth Street west of Sherman Avenue. He feels it is illogical to call this new portion Sth Street, since 5th Street runs across the City at a certain north -south point. Barbara Crook said she thought it seems illogical to have a continuous street with three different names. Bobbie Jones said Mr. Osburn thought it would be better to change the name at a public street such as Sherman., rather than change the name of a public street where it intersects with a private street. She said there might be a possibility of putting the street in at the T so that it can go both east and west Chairman Don Hunnicutt stated that the Board would have to rename the street and that the Subdivision Committee could say a street name should be worked out from the intersection of Sherman back toward Rodgers Drive. tg Barbara Crook asked which common area was referred to in Plat Review Minutes where utility companies asked for designated easements. Bobbie Jones Qsaid they were talking about all the common areas. She said the interior part 6 where the drives and parking were to be will be called a common area and utility e3 easement but in the other common area the utility easements are designated as • 0,- such. Barbara Crook said any area to be designated as a utility easement, such as e:3 the common areas, causes her to be concerned about trees being removed. ' Rick Cowdrey and Jim Stephens said that wherever a utility easement is 69,•designated, the utility companies have the right to cut it to grade, so that they also are seriously concerned about the loss of trees. Rick Cowdrey said that originally the Telephone Company had asked for a 50' easement along the south. Because the Board of Directors had wanted Mr. Stephens to plant even more trees in this area as a buffer, the Telephone Company has said they would try to work around the trees. Chairman Hunnicutt asked if all requirements stated by Bobbie Jones in Plat Review had been met. Rick Cowdrey stated the covenants they plan to use will meet HUD guidelines because, if they vary from those they must outline to HUD what they have changed, and it is easier to use the HUD covenants and incorporate Arkansas law and Fayetteville City ordinances than to come up with a completely new set. Barbara Crook said originally she had a question regarding maintenance of the grounds but that this appears to be covered within the covenants. Don Hunnicutt asked Bobbie Jones if she was asking that the maximum number of units (26) be stated in the covenants. Bobbie Jones said it was her intention to try to clarify the number of lots to make it parallel to what was required by the Board of Directors. There was discussion of the possibility of adding units to one phase but taking away units from another phase in order to stay within the maximum number. Bobbie Jones said it was partly her intention to keep the number of units defined but also so that they would add the number of units of each phase and stay with a total of 130. She said it becomes difficult later on to say whether each lot represented indicates one unit. She suggested a statement could be made stating that lots 1 through 26 shall be limited to one unit per lot. 75 • • • Subdivision Committee Meeting August 20, 1982 Page Three Barbara Crook asked if requirement number six asked for by Bobbie Jones in Plat Review had ever been resolved. After some discussion, Bobbie Jones suggested a Bill of Assurance be executed regarding item 6 stating that future phases will develop, or that this be combined with the Bill of Assurance on the cul de sac mentioned earlier. Bobbie Jones stated the owner is supposed to contact the adjacent property owners and stated he is going to try to have that done before the Planning Commission meeting. Barbara Crook moved to recommend to the Planning Commission the approval of the preliminary plat of Sequoyah South, Phase One, subject to Plat Review comments which would specifically include a Bill of Assurance on the cul de sac if the road was not extended and the 100' setback on the north in case :the property is sold without further PUD development. The motion was seconded by Melanie Stockdell and passed, 3-0. With no further business, the meeting adjourned at 3:35 P.M.
