MINUTES OF A SUBDIVISION COMMITTEE MEETING
A meeting of the Subdivision Committee of the Planning Commission was held
on Friday, July 23, 1982 at 1:30 P.M. in the Directors Room, City Administration
Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Don Hunnicutt, Barbara Crook, Melanie Stockdell

Barbara Crook moved to approve the Minutes of the
July 9 Subdivision Committee meeting. The motion was
seconded by Don Hunnicutt and passed, 3-0.
The first item on the agenda was to
consider approval of the Preliminary Plat
of Winchester Square Subdivision located
south of Highway 16 West and east of
County Road #650 (outside City Limits);
Johnnie and Ora Bassett, owners and developers.
James Cramer and C. Forbes were present as representatives.

PRELIMINARY PLAT - PHASE ONE

JOHNNIE AND ORA BASSETT
Chairman Don Hunnicutt asked for discussion on the following
items:
1) Safety zone for driveways;
2) Offset on two streets;
3) Notification of adjacent property owners
Bobbie Jones said she does not yet have proof of notification to all adjacent
property owners. Mr. Cramer said they will be available before the Planning
Commission meeting on July 26.
Mr. Cramer said that he did increase the safety. zone.
Bobbie Jones said there is an ordinance which allows joint driveways on the
property line or single driveways each 121 feet from the common side property line.
There was discussion regarding the request for waiver of the requirement of
minimum jog distance at intersections of Rifle Road and Tyler Road with Winchester
Road to allow the 41.05 feet jog.
Bobbie Jones said that all three phases are shown on the maps, and have been
reviewed, and asked if there were any reasons why approval should not be considered
for all three phases.
Mr. Cramer said he had only done percolation tests on Phase 1, and that the
State Board of Health must approve percolation data before the final plat is approved.
Mr. Cramer said the only stipulations made by the County were the type of
materials to be used on Winchester Road and it was agreed to be curb and gutter and
hot -mix.
There was further discussion regarding the waiver of the minimum jog distance
versus a waiver of the minimum 12 acre lot size.
Barbara Crook stated that she was sympathetic towards the idea of having as
many lots as possible on the Highway 16 frontage, but pointed out that considera-
tion should be balanced against the considerations of safety.

Mr. Cramer stated that he thought the best argument for the waiver is the
fact that the terrain is extremely flat.
Bobbie Jones said that some waivers of 150 feet had been approved in the
past.
Mr. Hunnicutt talked about concerns regarding traffic on the roads as the
subdivision becomes more developed.
There was some discussion of where the jog appeared on the original concept
plat.
Barbara Crook said she had some question about Winchester Road lining up
with the road across the highway.
There was discussion about the dedication of the county road. Mr. Cramer
said the jog was about 20 feet. He said Winchester Road had already been
dedicated as shown and accepted by Washington County.
Mr. Cramer said the percolation test results would vary from lot to lot,
but that the tests he did make turned out fairly well; he said things would
have to be built up if they were ever to put in a septic system. He said they
had seepage at four feet on the test holes; he said it was mostly clay all the
way down, and that the tests were done one week after the heavy rainfall last
month..
Mr. Cramer said there was already a road where Winchester Road is shown
which was dedicated for the use of some property owners in the area such as
Bryce Davis, for purposes. of access. Mr. Cramer said that adjoining property
owners had been notified for all three phases, although proof had not yet been
submitted to the Planning Office.
Mr. Hunicutt suggested the consideration of approval of Phase 1 only and that
the question of the intersection not be included.
Barbara Crook said that it was her feeling the Planning Commission seems to
be reluctant to be in a position of trying to make money for an owner rather than
considerations of providing safety.
Bobbie Jones quoted from the City Code, page 938.3: "A straight tangent at
least 100 feet long shall separate reverse curves: and from page 941, on sight
distance of 90 feet at intersections on ordinary terrain.
Mr. Cramer said that Rifle Road jogs to the west. He said that, for all
practical purposes, it was fully constructed. He said that Winchester Road was
centered on the right-of-way.
Bobbie Jones said that she had talked with General Kendall and that the County
does not have any regulations regarding jog distances. She said that he had
called her office prior to the meeting and that the County gives its approval to
both items on the agenda.
It was clarified for Bobbie Jones that Johnnie Bassett's original intent
was to obtain approval of Phase 1 only.
It was generally agreed to consider approval only of Phase 1 and that
consideration would not be given to the waiver question at this time.
Barbara Crook said that she had a question about how much of the easement
lies each side of the line.
Bobbie Jones said she was satisfied with easements shown on Block 1, Phase 1,
but the final plat must dimension how much of the easement lies each side of a
lot line.
Barbara Crook asked that some elevations be shown on the plat to give them
something on record to look at.
There was discussion about where elevations might be indicated on the plat.

Mr. Cramer said he knew of the existence of City sewage about one mile north.
Bobbie Jones said the Assistant City Engineer had said there was sewer almost
across the street from the development, but the grade is not satisfactory to get
this development into it.
Barbara Crook moved the approval of the preliminary plat of Phase 1 of
Winchester Square Subdivision subject to Plat Review comments which seem to have
been accommodated with the understanding that at the time that Phase 2 is
developed some ground elevations will be determined to satisfy the Code require-
ments.
It was agreed that the motion did not recommend a waiver of any kind and
that some resolution of the offset problem between Tyler and Rifle Roads would
be accomplished before the approval of Phase 2. It was agreed that the Committee
was not approving the preliminary plats of Phase 2 and 3 and the owner will have
to work out the jog in the street intersection.
Mr. Cramer said he would withdraw the request for the waiver of the jog at
this time.
Bobbie Jones said the owner needs to check with utility companies before
making changes in utilityeasements as the utility companies told the owner.
the easement could either be centered on the lot line or on the back of the
commercial lots.
The motion was seconded by Melanie Stockdell and passed, 3-0.
The next item on the agenda was a HAMSTRING SOUTH ADDITION
request from Lester Longwith to extend HIGHWAY 16 WEST
the preliminary plat approval period LESTER LONGWITH
beyond one year for Hamstring South
Addition located in the Growth Area west
of County Road No. 877 and north of Highway 16 West. Lester Longwith and
B. L. Lewis were present.
Mr. Lewis stated that the property in question had been tied up in bankruptcy
litigation for approximately one year and work on the property had ceased. For
this reason, he is asking for a continuation on the preliminary approval time
period.
Bobbie Jones quoted from the Minutes of a Planning Commission meeting of
April 14, 1980: That the preliminary plat of Hamstring South Addition be
approved with the following conditions: (1) a. full 60 foot right-of-way for
County Road 877 be dedicated even if the entire balance needed to furnish 60 feet
must come off the property in this subdivision; (2) Developers are to build
County Road 877 along this Subdivision to County standards with SB -2 (gravel),
including drainage in the construction; (3) a drainage easement be shown between
Lots 6 and 7; (4) Developers be permitted to eliminate Lots 1 and 2 shown on the
plat under consideration; (5) County Road 877 will be constructed to the North
line of Lot 3 shown on the plat under consideration; (6) Remaining lots to be
renumbered accordingly; and (7) Developer may have to get approval from the County
to delete Lots 1 and 2.
There was discussion as to how much of an extension would be needed.
Bobbie Jones stated the Code says preliminary plat approval is good for one
year and thereafter as long as work is actively progressing.
Mr. Lewis said they needed to progress on the roadwork and the obtaining of
a final plat. He said the bankruptcy litigation was over with.
It was generally agreed that a 6 -month extension would be more than
adequate.
Melanie Stockdell moved to recommend the granting of a 6 -month extension

to the preliminary plat approval time period beginning Monday, July 26, 1982.
The motion was seconded by Barbara Crook and passed, 3-0.
Chairman Hunnicutt said the recommendation must go before the Planning
Commission on Monday, July 26 and that some representative should be present
at that meeting.
The meeting was adjourned at 2:20 P.M.
