HomeMy WebLinkAbout1982-07-09 - Minutes• en a G3 C MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held at 1:45 P.M., July 9, 1982 in the Directors' Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Chairman Don Hunnicutt, Barbara Crook Melanie Stockdell, David Williams Tom Hopper, Carl Russell, Bobbie Jones, Suzanne Kennedy Approval of the Minutes of the June 11, 1982 Subdivision Committee meeting were deferred until the next meeting, as Chairman Hunnicutt had not yet read them. The first item of business was consideration of the preliminary plat of Mud Creek Addition, Unit 1, located south of Stearns Street, north of Sain Street and east of Highway 71 North; Arkansas Western Realty, owner and developer. Property zoned C-2, Thoroughfare Commercial District. Tom Hopper was present to represent Crafton, Tull and Associates, Engineers. Chairman Don Hunnicutt brought up four items for consideration which had been brought up at the last Plat Review Committee meeting: 1. The extreme southeast corner of Tract 3 is zoned I-1, not C-2. 2. Street lights at end of cul de sac, at each street intersection and at 300 -foot intervals in between are required along each street. 3. Provide proof to Planning Office that owners of all surrounding properties within 100 feet have been advised of development. 4. Submit copy of any proposed covenants. Barbara Crook brought up the fact that the Street Department has said in Plat Review that it will not be responsible for maintaining the drainage ditch unless some structure is provided. She asked the developer if he was not proposing to do anything other than leave the easement. Tom Hopper said that once Tract 3 is sold for development, it will have to come back to the City for large scale development approval and they can then approach what will be the final disposition of the ditch. He said there will be no covenants filed, as shown on the plat; sidewalks and streetlights have been added; five foot wide concrete sidewalk has been added all around the culde sac. Some of the street lights are more than 300 feet apart because of Mud Creek. There was further discussion about sidewalk and streetlight requirements, particularly at the end of Joyce Street. Bobbie Jones said that there probably should be something included in a motion that, rather than requiring a light at the end of Joyce Street now, it would be required when the property is further developed or when the street is extended. There was further discussion regarding the distance between streetlights. Bobbie Jones suggested that, if some of the streetlights are more than 300 feet apart, the Planning Commission can consider the approval of a waiver. MINUTES PRELIMINARY PLAT MUD CREEK ADDITION UNIT 1 COLLEGE AVE $ STEARNS ARKANSAS WESTERN REALTY 64 • • • Subdivision Committee Meeting July 9, 1982 Page Two Tom Hopper said that property owner notification would be completed by Monday, July 12. Bobbie Jones said when the Board acted on a rezoning petition for IND Corporation at its last meeting, the City Manager was asked to send a letter to the Planning Commission telling them that the City wants more street connections between Zion Road and Stearns or Joyce, somewhere in the area between College Avenue and Old Missouri Road. They want some traffic movement in that area other than Highway 71. There was discussion about what direction the old raw water line travels in that general area. Bobbie Jones said that, when she gets a copy of the letter from Mr. Grimes, she would send a copy to Mr. Hopper. Mr. Hunnicutt brought up the question of the change to I-1 zoning. Mr. Hopper said that his legal description for the Tracts shown on their plat indicates that all this property is within the C-2 zone. Bobbie Jones said the City will need a description of the part of Sain Street which willbe vacated, and that this would then go before the City Board of Directors and the Planning Commission may need to make a recommendation. She said that when the A.W. Realty Plat was filed, the right-of-way for Joyce Street was given at that time in a separate deed to the City; she asked Mr. Hopper if there was a separate deed to connect the rest of Sain Street up to Joyce. There was further discussion about the location on the plat of the right-of-way the owner wishes to vacate. Bobbie Jones asked for a drawing and a letter requesting that the undeveloped right-of-way for Sain Street be vacated. There was discussion as to where the paving ends on Sain Street on the plat. Mr. Hopper indicated that he did plan to complete the paving into the cul de sac and up to City standards. Mr. Hopper also indicated that he had a copy of the flood plain permit that had been approved by Harold Lieberenz (now retired) but that he now has discovered that it had not been signed or submitted back to the City Planning Office and that this would be done. Tom Hopper spoke about the floodway shown on the map as based on a FEMA study. He said that the 100 -year flood line is as shown; the intent is to fill the area in the vicinity of lots 3 through 8 between the floodway and the 100 - year flood to the 100 -year base flood elevation and submit to FEMA a request for a conditional approval of the letter and map amendment that would show rain to the 100 -year flood line. After the work is done, it will then be approved. The next time the City's flood map is updated, they will update the map. On tracts 2 and 3 they propose to show the area to be raised to the 100 -year flood elevation; at this time they are not sure whether the whole area will be raised or just the portion where the building will be constructed. He stressed that the flood elevations to be used are being based on the FEMA study. Barbara Crook spoke about Clayton Powell's Plat Review comments that, if the draining is such that drainage to the site would be affected, storm drains would have to be put in the street to keep water from draining into the street. Tom Hopper said that the flood elevation differs all the way back up the creek; there was further discussion as to the amount of elevation indicated on different parts of the plat. He said that the area between the 100 -year flood and the floodway is fill; the maximum rise that is shown is to be 6/10ths; based on that, he would put the minimum floor elevation on the final plats. '7 Subdivision Committee Meeting July 9, 1982 Page Three Barbara Crook brought up Dick Shaw's Plat Review comments asking that the developer show an electrical easement. Mr. Hopper said that Mr. Shaw had not realized that there was already a utility easement down the full length of Front Street on its West side. Barbara Crook moved to recommend to the Planning Commission approval of the preliminary plat of Mud Creek Addition, Unit 1, including the 13 street lights shown, spaced as evenly as possible and with the understanding that an additional street light will be required at the end of Joyce Street at such time as the surrounding land is developed, and acknowledging that no covenants are on the plat, and requiring submission of proof of notification to adjoining property owners. The motion was seconded by Don Hunnicutt and passed, 2-0. Mrs. Crook clarified that her motion did not include any approval of the vacation of Sain Street. The developer will have to bring that back with a written request and description. The next item for consideration was review of the Large Scale Development plan for Production Credit Association and Federal Land Bank located west of Highway 71 North, south of Highway 71 Bypass and north of the new service road; Production Credit Association Bank, owner and developer. Property zoned C-2, Thoroughfare Carl Russell, Architect, was present as a representative. Chairman Hunnicutt said this piece of property was Tract Addition. Barbara Crook asked if problems with SWEPCO utility easement had been worked out. Mr. Russell stated that the intention will be to move a pad up to the existing easement and avoid having an additional easement. Bobbie Jones pointed out that the original drawing which went to Plat Review has been revised. The reduced copy attached to the agenda was made before the revision, the large prints were made after the revision. Bobbie Jones said the Master Sidewalk Plan shows sidewalks on both sides of North College Avenue, that sidewalks beyond Millsap Road pose a problem; and that the sidewalk question should go before the Board of Directors for clarification. Bobbie Jones said that the City subdivision regulations require water, sewer, streets and drainage, but do not specify any other utility requirements. Mr. Russell has told her this property has some deed restrictions which require the utilities to be underground, but they were not put in by the subdivider. She wonders if the Planning Commission should give some thought to whether or not, in developing a subdivision, developers should be required to make provision to furnish those utilities before the lots are developed. Tom Hopper, who was present to speak for Mud Creek Addition, pointed out that.conduits for utilities do exist under Millsap Road. There was considerable discussion regarding the question of financial responsibility for furnishing private utility access to subdivision lots, before or after the lots are developed. Barbara Crook said that she felt the City has some responsibility to protect city streets and some responsibility to the public, but does not feel it extends beyond some form of location. PRODUCTION CREDIT ASSOCIATION and FEDERAL LAND BANK ASSOCIATION OFFICE BUILDING COLLEGE AVE $ MILLSAP ROAD and Federal Land Commercial District. 1 of the Steele Subdivision Committee Meeting July 9, 1982 Page Four Bobbie Jones said that in the past she had received a couple of complaints from lot owners who were surprised to find they had no access to gas or electric utilities after they purchased a lot in a residential subdivision. Most of these were in the Growth Area. In regards to street names, Bobbie Jones said that the map which was approved by the City Board shows the Bypass as Fulbright Expressway, the service roads on the west side as Shiloh Drive, and the service roads on the east side as Futrall Drive. This street does form a 4 -way intersection at Millsap and College and the Steele Addition plat shows it as Millsap She said that the correct name needs to be straightened out before issuing a building permit. Barbara Crook moved to recommend approval of the Large Scale Development plan for Production Credit Association and Federal Land Bank as submitted, subject only to any Plat Review comments which have not yet been addressed. The motion was seconded by Don Hunnicutt, and passed, 2-0. Bobbie Jones said that to her knowledge, only two points have not been resolved: (1) Should this be Millsap or Futrall; and (2) How are sidewalks to be located along both sides of College Avenue in this area.
