HomeMy WebLinkAbout1982-06-11 - Minutes• • MINUTES OF A SUBDIVISION COMMITTEE FETING A meeting of the Subdivision Committee of the Planning Commission was held at 1:30 P.M., Friday, June 11, 1982, in the Director's Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Chairman Don Hunnicutt, David Williams. MEMBERS ABSENT: OTHERS PRESENT: Melanie Stockdell, Barbara Crook, Jim Walker, Wayne Jones, Frank Blew, Jerry Rogers, Mike Phillips, Cynthia Stewart, Bobbie Jones. The minutes of the May 21, 1982 Subdivision MINUTES Committee meeting were approved as mailed. The next item of business LARGE SCALE DEVELOPMENT was the approval of the Large Scale ARKANSAS WESTERN GAS CO. Development Plan for Arkansas Western INDUSTRIAL PARK Gas Company to be located South of Commerce Drive and East of Armstrong Avenue; property zoned I-2, Heavy Industrial District. Wayne Jones and James Walker were present to represent. The Chairman opened the discussion on the Large Scale Development and stated he had found five items he would like to discuss: 1. The waiver of.the safety zone requirement at the East end of the property at Commerce. 2. Developers share of contribution to the improvement of Armstrong Avenue. 3. Dedication of right of way for Armstrong Avenue. Bobbie Jones said this had been resolved by information furnished to the Office of City Planning by Dale Christy. 4. Warranty had been property Deed proving this is a lot of record. Bobbie Jones said this resolved also, and there had been no splits performed on this after June 29, 1970. 5. Screening of storage areas. Hunnicutt stated he understood that there would be a recommendation on this item from the Landscape Committee. Williams said the issues to be discussed are the safety zone for drives, and contribution for construction of Armstrong Avenue, all other issues are resolved or will be resolved by other bodies. Bobbie Jones stated this Developer has requested a construction deferrment for the required sidewalk on Armstrong Avenue until such time as Armstrong is constructed. This request has been reviewed by the Board Street Committee and will be acted on by the Board on June 15. The Board will address this the same night. Jim Walker addressed the Committee. He said the Street Superintendent has recommended that this developer be responsible for contributing his share of improvement to Armstrong Avenue, but did not feel construction should take place until there was enough participation to get Armstrong constructed to Industrial Standards for a practical length. Bobbie Jones said the Board of Directors has been requiring sidewalks in most cases. However, when immediate construction is not practical, they are having the developer enter into a bill of assurance that the sidewalks will be constructed at the call of the City. The Planning Commission cannot waive sidewalk requirements or require Bills of Assurance. They can require a performance Or cash bond to be posted by the Developer that is good for five years, at the end of the five year period, the Commission is to hold a public hearing to determine what is to be done with the funds. The same is true for improvement of streets. The Planning Commission can require a bond be posted, the Board of Directors has to grant any waivers. Mr. Walker said in terms of bonds, he did not feel in these economic times that bonds for cash are practical. He said he would much rather enter into a contract for improvements similar to the Bill of Assurance issued for deferrment of sidewalk construction. Bobbie Jones said she could ask the City Attorney about some kind of agreement for street construction where cash money would not have to be put up. She said she felt Mr. Walker's arguments are legitimate, not only because of interest rates, but because of inflation. The amount of money put up in a bond, may not be adequate to cover street construction by the time the construction is needed. Addressing the matter of the safety zone between drives, David Williams asked how far this drive will be from Norris' Drive. Wayne Jones said this drive will be 125 ft. from Norris' nearest drive. Bobbie Jones said Clayton Powell is measuring the safety zone from property lines to curb cuts. In this.oase, with the radius being taken into account, the curb cut will sit on the property line. Hunnicutt said since Norris' drive is so far removed, he did not see this as a safety problem. David Williams moved the Large Scale Development Plan for Arkansas Western Gas Company be approved subject to the following: 1. Recommend a waiver of the safety zone requirement on the East drive. 2. Subject to all conditions contained in the Plat Review Committee meeting minutes being met. 3. Subject to City Attorney's approval of a non-cash guarantee for this developer's share of improvements to Armstrong Avenue. Walker said he met with some of the members of the Landscape Committee yesterday, and Arkansas Western Gas is going to try to leave as much natural vegetation as possible around the perimeter of the development to satisfy a lot of the screening requirements. Keeping in mind that if, in the future, 63 J • Subdivision Committee Meeting June 11, 1982 Page 3 improvement of Armstrong Avenue or future expansion occurs and vegetation is removed, the developer plans to plant rose bushes or something on the fence to satisfy screening requirements. Huhnicutt seconded Williams' motionto approve. Bobbie Jones said she felt the Planning Commission prefers to see trees and natural vegetation in lieu of fences. The next item of business REVISED FINAL PLAT was the approval of the revised plat of POND ADDITION Pond Addition located inside the HIGHWAY 16 WEST Growth Area, North of Highway 16 West and about 1-1/2 miles West of the By-pass; Herbert Pond, Sr. and Roger and Sylvia Phillips, Owner and Developer. Frank Blew was present to represent. Hunnicutt said there were a few things that he would like to discuss that were brought up at the Plat Review Committee meeting, such as the multiple accesses on to Highway 16 West and the provision of water to Lots 6 $ 7. Frank Blew explained that this plat is not changing any of the lots. The original final plat listed the proposed use as residential, the revised plat will list it as residential and commercial. The original plat indicated there were protective covenants. This plat will state there are no protective covenants.. The original plat showed Herbert Pond, Sr as the owner, since that time a lot has been sold so Roger and Sylvia Phillips will be included in the ownership block. Also, at the Plat Review Committee meeting the telephone company representative asked that the dedication block be revised, so with this plat it will be so revised. Blew said this plat was filed in August of .1979. The water line is in but is not run to Lots 6 $ 7. There is a prospective buyer for the subdivision, he did not like the restriction of residential uses for all lots, he wanted some commercial usage. Also, the original plat stated there were protective covenants. The revised plat will state there are no protective covenants. Hunnicutt said regarding water service to Lots 6 $ 7, he said he could not see changing the requirements for water service at this late date. If development is to occur, these lots will have to have water service run to them, he did not see how it could be required at this late date. Bobbie Jones asked about the separate accesses on to Highway 16. Blew said any'access onto Highway 16:.wili have to be approved by. the State Highway Department, and a permit obtained for the curb cut. David Williams :moved the Revised Final Plat for Pond Addition be approved subject to Plat Review Committee minutes. Don Hunnicutt seconded. The next item of business LARGE SCALE DEVELOPMENT was the approval of the Large ROGERS PRODUCE Scale Development plan for Rogers HIGHWAY 16 EAST BYPASS Produce Company to be located South of 15th Street (Hwy. 16 Bypass) and West of Morningside Drive; Jerry Rogers, Owner and Developer; property zoned I-1, Heavy Commercial and Light Industrial District. 6hi A Subdivision Committee Meeting • June 11, 1982 Page 4 Jerry Rogers and Mike Phillips were present to represent. Hunnicutt said he did not have any comments. Williams moved this Large Scale Development plan be approved subject to Plat Review Committee comments and requests. Bobbie Jones stated this developer is seeking a waiver of the screening requirements from the Planning Commission. Don Hunnicutt seconded. There being no further business, the meeting adjourned at 2:10 P.M.
