A meeting of the Subdivision Committee of the Planning Commission was
held at 1:30 P.M., Friday, May 21, 1982, in the Directors Room, City Administration
Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Don Hunnicutt.
MEMBERS ABSENT:

The Chairman considered the approval LARGE SCALE DEVELOPMENT
of the Large Scale Development LEVERETT GARDENS II
Plan for Leverett Gardens II, CHESTNUT P, ARTERIAL
located West of Chestnut Avenue,
North of Poplar and South of the
University of Arkansas Farm, Universal
Properties - Owner and Developer. Property zoned R-2, Medium Density Residential
District.
Olan Asbury and Gene Thrasher were present to represent.
Olan Asbury addressed the Chairman. He stated at the Plat Review level,
it was suggested that Chestnut be improved to the North line of this
property and a turn -around constructed at the termination point. The developer
does not wish to construct the street past the development's most northerly
entrance. Asbury felt the construction would be a waste, since the road is
a dead end. He felt the installation of a cul-de-sac would be costly and that it
Will be. hard to keep it from collecting trash. Also, it was recommended that
this developer improve Chestnut on both sides with curb, gutter and pavement.
The developer feels the property owner on the East side of Chestnut should
develop his side of the street. If the turn -around is required by ordinance,
the developer would like to request a waiver.
It was recommended at the Plat Review Committee meeting that sidewalk be
constructed on the North line of the property `.'.,along!r.'. the future arterial.
The developer would like to request a waiver of that requirement. Bobbie Jones
said that type of waiver must be requested from the Board of Directors.
Asbury said it was also recommended that a performance or cash bond be
posted for the construction of the proposed arterial street to the North.
Asbury saidthe arterial is last on the construction priority list. The property
for the proposed arterial was donated by this developer; it was a very expensive
piece of property. Asbury said he was doubtful that arterial would ever be
constructed and felt the right of way should be vacated and given back to the
property owner.
Asbury said the developer has no problem with requested easements.
There is a water line indicated on the plan but there is no record of the
line on the City's as-builts or plans. That discrepency will have to be
resolved. If the line exists, an easement will be dedicated to cover the line
(15 ft.)

Asbury said there was some discussion with Mrs. Jones about a possible lot
split. The developer has decided to leave the tract intact at this time.
Asbury said the developer proposes to construct his half of Chestnut,
the property owner to the East can be responsible for his portion of construction.
The 'Developer does not wish to contribute money or a performance bond for
the construction of the Arterial Street to the North of his property. The
Developer would like a waiver of the sidewalk requirement on the North side of
the property.
Hunnicutt reminded Mr. Asbury that all other Plat Review Committee
comments will be binding.
The next item of business LARGE SCALE DEVELOPMENT
was the approval of the Large PARK LAKE APARTMENTS
Scale Development plan for Park Lake ZION ROAD
Apartments located approximately 1/2 mile
East of Highway 71 North, South of Zion
Road, and approximately 1/2 mile West of
Old Missouri Road. Park Place Properties, Ltd., Owner and Developer. Property
zoned R-2, Medium Density Residential District.
Claude Prewitt was present to represent.
Hunnicutt stated the developer is not requesting any waivers. He said
he had noted Perry Franklin's comments about the proposed overpass at Zion
Road and Highway 71 North.
Prewitt stated he is sitting in for the developer, the Developer will be
present at the Planning Commission meeting.
Hunnicutt stated this developer will be required to improve his portion of
Zion Road.
Bobbie Jones said one reason the Planning Commission can disapprove
a Large Scale Development Plan is if it creates or compounds a dangerous
traffic condition.
Edward Ivey, Zion Road, addressed the Chairman. He said he felt this
development would compound a dangerous traffic problem, traffic is already
bad in this area, especially at Zion Road and North College. He said he could
fill this room with persons complaining about traffic out there.
Arthur Mueller, Zion Road, addressed the Chairman. He said the way the
development is proposed, the entrance and exit will be on to the South curve
in Zion Road, to the East of the proposed drive there is a hump, there is no
site distance. At this time, Mr. Cole can't get a clear view of what is coming
over the hill when he backs out of his drive. He invited the Commission to come
and look at the site and suggested they do so when everyone is going to work.
Mueller asked if the drive into the apartment complex will be a public
street maintained by the City. Hunnicutt said it willnot, it will be a private
drive maintained by the owners of this development.
Mueller said there is presently a problem getting power to homes in the
area, and he wondered how power would be provided to the site and whether it
would interfere with the power service to houses presently in the area
Mueller was also concerned about emergency vehicles getting in and out
of the development with only one ingress/egress. Hunnicutt pointed out there
is an emergency vehicle driveway, which will be compacted to support emergency

vehicles, it will be gravel.
Mrs. Arthur Mueller addressed the Chairman. She said that Zion Road is
a narrow street and she did not see how it could support the density proposed
by this development. She asked if the City has any intention of improving
or widening Zion Road. Hunnicutt said that improvement of streets in this
area will take place as development occurs.
There was further discussion about the traffic problems in the area.
The meeting adjourned at 2:45 P.M.
