HomeMy WebLinkAbout1981-12-28 - Minutesg' Q MINUTES OF A SUBDIVISION COMMITTEE MEETING e7 • : A meeting of the Subdivision Committee of the Planning Commission was held at 10:00 A.M., Monday, December 28, 1981, in the Chamber of Commerce Building, Fayetteville, Arkansas. 11 11 0 The next item for consideration PRELIMINARY PLAT a® was the preliminary plat for HAPPY ACRES SUBDIVISION ens Happy Acres Subdivision, to be OLD WIRE ROAD cc located West of Old Wire Road, North of Ash '* Street, and East of Juneway Terrace. Property zoned R-1, Low Density Residential District. Mrs. Oleva Hebberd and .Mrs. E. L. Hines, Owner and Developer. There being no one present to represent, the Chairman postponed this item for consideration later in the meeting. MEMBERS PRESENT: Chairman Don Hunnicutt, Newton Hailey, David Williams, Beth Crocker. MEMBERS ABSENT: None. OTHERS PRESENT: Jim Lindsey, Bobbie Jones, Cynthia Stewart. Don Hunnicutt asked that the MINUTES Subdivision Committee Meeting minutes of the December 11, 1981 meeting be revised regarding the Final Plat approval for the Steele Addition, to include a. contingency that any modifications to utility easements will have written concurrence from all utility companies and the concurrences are to be submitted to the Planning Administrator, Bobbie Jones. Also, Ms. Crocker felt her comments regarding Happy Acres Subdivision were confusing as she had verbalized them prior to leaving the meeting and prior to the Committee actually addressing the Plat. She asked that the minutes be clarified to show that she verbalized those comments prior, to leaving the meeting. With those corrections, the minutes were approved as mailed. The next item of business FINAL PLAT was the approval of the PARADISE GARDENS CONDOMINIUM Final Plat of Paradise Gardens SWEETBRIAR Condominium located on the North side of Sweetbriar Drive and lying East of Greenbriar. Jim Lindsey was present to represent. The Chairman stated that items A & B would be considered simultaneously and Item C would be considered separately. Hunnicutt asked if there was anything outstanding on items A & B. Bobbie Jones stated that everything had been pretty well taken care of. 4, Subdivision Committee Meeting • December 28, 1981 Page 2 • • David Williams moved the Final Plat for Lots 1-4 and Lots 5-8 of Block 3, Sweetbriar Addition, be approved, subject to Plat Review Committee comments and requests. Newton Hailey seconded. The motion passed (4-0). The Committee addressed Item C, a Replat of ExhibitA;.Page 5, a survey of Lots 18-22 of the Replat of Block 3, of Sweetbriar Addition, and part of the SE; of Section 25, T -17-N, R -30-W. his replat is being processed for the purpose of reducing to 25 ft. the width of the easement paralleling the South property line and lying East of the end of Sweetbriar Drive. Lindsey explained that this is being requested due to an error in engineering. He stated there are no utilities located in the utility easement. Bobbie Jones stated the City Attorney had indicated to her that since the utility easement was dedicated by a plat, it could be reduced with a replat. She stated it is the easement around the South side of the development; the.. East 371 ft.. Further, Ms. Jones stated that Mr. Lindsey had taken a copy of the plat around to each of the..utility companies for their comments and they each indicated they had no problem with this reduction in utility easement. Newton Hailey moved that the replat be approved. Beth Crocker seconded. The motion passed (4-0). Lindsey stated that even though he has what he feels is an extremely competent engineering staff, he has found in working with the Horizontal Property Regime, that there are several areas in which mistakes can be made. As a result, a piece of property can be created on which title cannot be passed. He stated that although:. his staff had been very careful, the Planning Office had still found several mistakes with his condominiums. He felt there should be some process whereby these plats were reviewed. Bobbie Jones stated if there is an existing structure, which is zoned R-2 or R-3, and consists of property less than an acre, there would be no review process. Lindsey said he felt it was critical for an individual to know that he has something he can pass title on. The Committee considered the HAPPY ACRES preliminary plat for Happy Acres Subdivision. There was no one present to represent. Bobbie Jones stated she had been in contact with the engineers for this project and they had indicated they would be present, but calle&and,cancelled,today:; David Williams moved the preliminary plat for Happy Acres Subdivision be recommended to the Planning Commission for denial.for the following reasons: 1. The use of Old Wire Road for driveway access would create an unsafe situation. 2. The location of the Subdivision is in the Flood Plain. 49 • • Subdivision Committee Meeting December 28, 1981 Page 3 3. Lot 8, Block 2 does not appear to have adequate buildable area. 4. The widening of Ash Street should be discussed with the installation of the traffic signal at Sycamore Street. 5. Lack of adequate information concerning the plat. RE: Article 4, Section C of Appendix C, Subdivision Regulations. Newton Hailey seconded. The motion to recommend denial passed (4-0).
