HomeMy WebLinkAbout1981-12-11 - Minutesa a 6 •C c� idO ca @3 • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee was held at 1:30 P.M., Friday, December 11, 1981 in the Directors Room, City Administration Building, Fayetteville, Arkansas, MEMBERS PRESENT: Chairman Don Hunnicutt, David Williams, Beth Crocker (left early). MEMBERS ABSENT: Newton Hailey. OTHERS PRESENT: Mike Todd, Bob Crafton, Cynthia Stewart The first item of business was the approval of the Large Scale Development plan for Safeway Stores, Inc. located at 380 North College Avenue; Safeway Stores, Inc., Developer. Property zoned C-2, Thoroughfare Commercial District. Mike Todd was present to represent. He stated the Developer is in the process of requesting a waiver of the right of way dedications for College Avenue and Lafayette Street. The Owner does not wish to dedicate the rights of way. Hunnicutt stated the Subdivision Committee and the Planning Commission do not have the power to waive the right of way requirements, that will have to be done by the Board of Directors. Hunnicutt said the deveioper_of.this property_will.not have..to.construct the improvements recommended by Clayton Powell unless the Arkansas Highway and Transportation Department requests that the Developer construct the improvements. Art. 3, Section A 4 (e). Hunnicutt asked about meeting the parking requirements:if the additional right of way is dedicated. Bobbie Jones stated the right of way easements.could be used for parking until such time as they are needed for street purposes. At the time they are utilized for street purposes, some of the parking will be cut out. Hunnicutt stated approximately 38 parking spaces will be cut out.when the additional rights -of way are utilized. Bobbie Jones stated she would like for the Board of Directors to be made aware of the fact that the developer would be allowed to use the dedicated easement until such time as the street improvements are made when considering whether or not to grant the waiver on the right of way dedications. Beth Crocker moved the Large Scale Development plan be approved subject to: Bobbie Jones. LARGE SCALE DEVELOPMENT SAFEWAY STORES, INC. COLLEGE $ LAFAYETTE 1. Plat Review Committee comments.. The Developer will be allowed to use the easements dedicated to bring North College Avenue and Lafayette Street up to Master Street Plan standards until such time as the easements are needed for street improvements. At that time, the developer will make some other plans for meeting the parking requirements or seek a waiver of the parking requirements from the Board of Adgustment. 45 1 • • Subdivision Committee Meeting December 11, 1981 Page 2 David Williams seconded. The motion passed (3-0). The next item for consideration FINAL PLAT was the approval of the Final Plat of STEELE ADDITION Steele Addition to be located West of HIGHWAY 71 B AND FULBRIGHT EXPRESSWAY North College Avenue and East of Highway 71 ByPass (Fulbright Expressway); Springdale Canning Company, Owner and Developer. Property zoned C-2, Thoroughfare Commercial District. Bob Crafton was present to represent. He had the following comments: 1. The easement requested under 4A of the Plat Review Committee comments which is located outside the subdivision, is now being recorded. It is also noted on the revised plat. 2. On the South side of Tract 3, there is a 35 ft. utility and drainage easement. The Plat Review Committee requested a 15 ft. easement outside that utility and drainage easement.. Research_has_brought to light an adjacent 25 ft. utility easement outside that drainage and utility easement on the adjacent property. Crafton proposed that sleeving be run under the concrete drainage ditch to the utility easement. He stated that the 35 ft. drainage and -Utility easement has been increased to 40 ft. to accomodate the concrete ditch and with the 50 ft. setback in the C-2 zone, the addition of the 15 ft. easement outside the drainage and utility easement would restrict thebuildable area too much. 3. On item 56, Ma Bell requested that the perimeter easement around tracts 1 $ 3 be increased. On the East side of tract 3 there is a 30 ft. utility easement that is presently dedicated and recorded. On the East and Northeast sides of Tract 1 a 15 ft. utility easement is indicated on the plat. This had been dedicated for the gas line. Crafton stated he did not see the possibility of any other utilities ever locating in that easement. Crafton stated each tract will have to be reviewed under the Large Scale Development process and that utility connections will be better known at that time, and if additional easement is needed, it should be requested at that time. It was stated at the Plat Review Committee meeting that there:is a. building setback anyway, however a waiver can be requested from the Board of Adjustment on setbacks, but it cannot be requested for an utility easement. Beth Crocker left the proceedings at 2:10 P.M. 4. Regarding Item 8C; there will be no covenants with this subdivision. Bobbie Jones stated that needs to be stated on the plat. 5. Item 8E; Crafton stated the plat is not ready to file ;yet. He said the developer would like to try and install all improvements without entering into a contract or posting a bond if possible. y6 Subdivision Committee Meeting December 11, 1981 Page 3 5. Item 8H; regarding the service road being renamed Futrall, Crafton said he was of the opinion that this is Millsap Road. Bobbie Jones stated she had requested a clarification from David McWethy on the name of the street within this subdivision. Hunnicutt moved the Final Plat be approved with the following conditions: 1. Show on the Plat there will be no covenants. 2. Clarify the name of the street in the Subdivision. (Whether it will stay Millsap or be changed to Futrall. 3. Show the easement South of the drainage and utility easement on the South side of Tract 3. Obtain written concurrence from the utility companies on the sleeving under the concrete drainage ditch. to the existing 25 ft. easement as discussed. Indicate where the concrete drainage ditch lies within the 40 ft. easement at the South of Tract 3. David Williams seconded. The motion passed (2-0). The next item for consideration PRELIMINARY PLAT was the Preliminary Plat of HAPPY ACRES SUBDIVISION Happy Acres Subdivision to be located WEST OF OLD WIRE ROAD West of Old Wire Road, North of Ash Street, and East of Juneway Terrace. Property zoned R-1, Low Density Residential District. There was no one present to represent. Beth Crocker stated she has a definite problem with this subdivision, in that it is located in the Flood Plain and very few of the lots appear to have buildable areas adequate to construct a house. Crocker stated she understands. that the accident rate at the corner of Sycamore and College warrants a traffic signal. She said if one is installed Ash Street will probably become a cut through point to Old Wire Road.from North College Avenue. She felt this developer should bear his portion of the cost of widening Ash to Master Street Plan standards. Since: there was no one present to represent, Hunnicutt moved this item be passed on to the Planning Commission with Crocker's comments. Williams seconded. The motion passed (2-0). There being no further business, the meeting adjourned at 2:30 P.M. 47
