HomeMy WebLinkAbout1981-09-11 - Minutes37 A • • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held at 1:30, P.M., Friday, September 11, 1981, in the Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Chairman Don Hunnicutt, Elizabeth Crocker, David Williams. MEMBERS ABSENT: Newton Hailey (on temporary leave). OTHERS PRESENT: Bobbie Jones, Cynthia Stewart, Larry Poage, Dale Holland, Pat Walter Turnbow, Bob Crafton, McGetrick, David Horne. The minutes of the August 21, 1981, Subdivision Committee Meeting were approved as mailed. MINUTES The next item for consideration was PRELIMINARY PLAT the approval of the preliminary plat of SERVICE ROAD the service road along Highway 71 Bypass for MILLSAP-71B-BYPASS Millsap Road, West of Highway 71B through property owned by Steele Investment Company, Zoned A-1, Agricultural District and C-2, Thoroughfare Commercial District. Bob Crafton and Walter Turnbow were present to represent. The Chairman stated this preliminary plat had been reviewed previously by the Planning Commission, they had approved only that portion of the service Road on the West side of Highway 71B. The intersection of the Bypass with the service road had been sent back to the TAC Committee for review. Bob Crafton addressed the Committee. He stated that this preliminary plat had been reviewed by the TAC Committee and, also, the Street Committee of the Board of Directors. The Board of Directors has approved the access as originally proposed by the Highway Department. The revised plats submitted to the Subdivision Committee reflect the access as approved by the Board and the various committees. Crafton stated as property sells, a Large Scale Development plan will be processed. He stated the preliminary plat designates the exact location of the proposed street. Crafton stated the Subdivision has been named Steele Addition, street lights are shown at the required intervals, and the required 5 ft. wide sidewalk is also included on this revised plat. He stated the expected use of all the property including the A-1 is commercial. The developer will appear before the Planning Commission September 28, 1981 with a rezoning petition for public hearing on the Agricultural property. Crafton said the street will be constructed in segments as tracts are sold. He understands that the street segments are to be constructed in lengths no less than 500 ft. . If the segment adjacent to the Bypass is constructed, it is to extend through the intersection. Bobbie Jones stated regardless of the type of development, each parcel developed will have to come before the Planning Commission or Subdivision Committee as it will fall either under the lot split waiver requirements, or the Large Scale Development process. • • Subdivision Committee Meeting September 11, 1981 Page 2 Bobbie Jones stated there had been several recommendations made by the Street Committee and the TAC Committee for this proposal. She stated two of the recommendations had been taken into consideration by the Board of Directors: 1. Widening of the Northbound lane on College to two lanes with a protective fifth turning lane. 2. Signalize the intersection as traffic develops and warrants. Don Hunnicutt recommended approval of the service road as presented on the preliminary plat subject to Plat Review Committee comments, and the Developer notifying adjacent property owners. Beth Crocker seconded. The motion passed (2-0). The next item of business was approval of the concurrent plat, a replat of Lot 6, Block 3, Kantz Place, located West of East Oaks Drive and North of Highway 45 East. Fred B. Hanna and John Maguire, Owner and Developer. Property is zoned R-2, Medium Density Residential District. Bob Crafton was present to represent. David Williams arrived at 1:50, P.M. The Chairman stated this concurrent plat has been reviewed by the Plat Review Committee and they had only commented on having something in the deed to cover utility service lines that may cross lot lines. Bob Crafton stated there had already been deed restrictions covering utility easements recorded. He showed the Committee the deed restrictions. Bobbie Jones said she would run the deed restrictions by the City Attorney and see if they would satisfy the utility companies' requests. David Williams moved approval of the Concurrent Plat of Lot 6, Block 3, Kantz Place subject to the following: CONCURRENT PLAT LOT 6, BLOCK 3 KANTZ PLACE 1. Clarification of utility service easements by the City Attorney. 2. Subject to Plat Review Committee comments and requests being complied with. Don Hunnicutt seconded. The motion passed (3-0). The next item of business was the approval of the Concurrent Plat, a Replat of Lot 1, Block 3, Kantz Place, located North of Highway 45 East and West of East Oaks Drive. Ball Family Trust, Owner and Developer. Property zoned R-2, Medium Density Residential District. Bob Crafton was present to represent. Hunnicutt stated that the sidewalk is already development. Bobbie Jones stated it is located on CONCURRENT PLAT REPLAT OF LOT'.1, BLOCK 3, KANTZ PLACE in place adjacent to this private property. 38 Subdivision Committee Meeting September 11, 1981 Page 3. Williams moved approval subject to Plat Review Committee comments and clarification of utility service easements being covered in the deed restrictions by the City Attorney. Don Hunnicutt seconded. The motion passed (3-0). The next item for consideration FINAL PLAT was the approval of the Final Plat ROYAL OAKS ESTATES of Royal Oaks Estates, a Planned Unit ' . PLANNED UNIT DEVELOPMENT Development, a replat of Tracts 1-6, Kantz Place, located North of Highway 45 East and West of Highway 265. Ball Land Company, Owner and Developer. Property zoned R-1, Low Density Residential District. Bob Crafton was present to represent. Beth Crocker stated this had been reviewed as part of Kantz Place Bobbie Jones stated that is correct, it was submitted with Kantz Place in 6 very large tracts due to the large amount of rock on the property. Crafton stated that sidewalks had been added to this plat. Bobbie Jones stated it had been suggested where Kantz Lane is being extended that the property that had been embraced in the cul-de-sac be reverted back to the property owners and only that portion needed for a uniform street be maintained as right of way for Kantz Lane. Crafton stated the developer is in agreement with this suggestion. Bobbie Jones stated this will have to be done by the Board of Directors. Crafton stated the property will be described and added to the descriptions of the adjacent lots. Crocker stated this will change the setbacks on the lots. Hunnicutt asked Mr. Crafton to comment on Clayton Powell's request to designate drainage easements. Crafton stated, originally, all common area had been designated utility and drainage easement. He stated Mr. Powell did not want this done as he was afraid the City would be held responsible for maintaining the entire common area. Crafton said drainage easements have been defined and designated on the plat. Bobbie Jones stated in the covenants the density per lot is restricted. However, if a lot is not developed to its maximum density, the remaining density can be applied to another lot. Ms. Jones further stated the streets within this PUD will be public. No more than 8 building permits will be issued for this PUD until all recreational facilities are completed, according to the ordinance. Beth Crocker moved that the Final Plat of Royal Oaks Estates be approved with the following conditions: 1. The Plat will note under zoning, to refer to the covenants for the density of each lot as well as the density of the total PUD. 2. Subject to compliance with Plat Review Committee comments and requests. 3. Recommend the right of way embraced in the cul-de-sac, Kantz Lane, be reverted back to the adjacent lots when the street is extended. David Williams seconded, the motion passed (3-0). Beth Crocker asked what the procedure is for requesting a traffic light at the intersection of Highway 265 and Highway 45. Cynthia Stewart stated a PLA Subdivision Committee Meeting • September 11, 1981 Page 4 • traffic count must be requested from the Arkansas Highway and Transportation Department, if the volume of traffic warrants, a signal will be installed. The last item on the Agenda was CONCEPT PLAN the approval of the Concept Plan for a GLENDALE ADDITION Planned Unit Development, to be located PLANNED UNIT DEVELOPMENT on Lot 21, Glendale Addition, located North of Whippoorwill Lane and East of Highway 265. Holland House, Inc. - Owner and Developer. Property zoned R-2, Medium Density Residential District. Dale Holland and Pat McGetrick were present to represent. Don Hunnicutt asked if it was R-1 to the East. Bobbie Jones stated it is, but it is her understanding that R-1 property has been purchased by an individual for a single family home. Someone inquired about using the entire 40 acres for a single family home. She told them she would run it by the Planning Commission. Hunnicutt asked if the 250 ft. setback for uses other than R-1 in an R-1 PUD would apply in this case. Bobbie Jones stated that only applies to an R-1 PUD in R-1, this is an R-2 PUD. Dale Holland stated these would be townhouses for individual ownership. The owner of the townhouse will own only the property the townhouse sits on, the balance of the property will be under common ownership. Holland stated there would be a 100 ft. green space to buffer between the R-2 PUD and the R-1 across the street. Pat McGetrick stated that traffic will be kept to ingress and egress at one point, as close to 265 as possible. Crocker asked if sidewalk is required with this development. Bobbie Jones stated she had not checked this plan against the Master Sidewalk Plan. Beth Crocker informed the developer that he may have to install sidewalks. Crocker asked if the Developer will request any waivers. Pat McGetrick stated not at this time. Bobbie Jones stated that the minimum width requirement for streets within a PUD is 24 ft. McGetrick stated the proposed streets will be 25 ft. wide, back of curb to back of curb. Larry Poage, Fire Inspector, stated that with the 25 ft. wide streets, there should be no parking allowed on the streets. He stated with the size of the structures and location of existing plugs, there may be a fire hydrant required. Bobbie Jones stated the Developer is proposing landscaping. McGetrick stated that is correct. The developer plans to install both trees and ground covering. David Horne stated that he represents Mr. g Mrs. Ellis Trumbo. He asked if traffic from this PUD would be funnelled out Inwood or into Sequoyah Woods Holland stated it would not. Dale Holland discussed the height of the townhouses and an existing drainage ditch with David Horne. Mr. Horne stated he had no objection to the proposed PUD. Hunnicutt moved that the Concept be recommended to the Planning Commission for approval, and any additional comments or input the Planning Commission might have. Crocker seconded.
