HomeMy WebLinkAbout1981-05-08 - MinutesMINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held at 9:00, A.M., Friday, May 8, 1981, in the City Manager's Office, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Chairman Don Hunnicutt, David Williams, Beth Crocker. MEMBERS ABSENT: Newton Hailey ( on temporary leave ). OTHERS PRESENT: Dr. John Andre, Bobbie Jones, Cynthia Stewart. The minutes of the April 24, 1981 Subdivision Committee Meeting were approved as mailed. MINUTES The next item of business was the approval of LARGE SCALE DEVELOPMENT the Large Scale Development Plan for Dr. DR. JOHN ANDRE John Andre to be located East of Highway HIGHWAY 71 SOUTH 71 South, South of Arkansas Highway 156 (Willoughby Road) and West of McCollum Road. Zoned I-1, Heavy Commercial and Light Industrial District. Dr. John Andre was present to represent. Cynthia Stewart submitted a letter to the members of the Committee from the City Manager to Dr. Andre stating that an arrangement had been made with the City of Fayetteville that this developer will not be required to improve McCollum Road other than the dedication of 5 ft. of additional right-of-way. Andre asked if the Office of City Planning had received any information from the State Highway Department regarding the proposed right-of-way for Willoughby Road (State Highway 156). Bobbie Jones replied she had not. Dr. Andre stated that a letter should be received stating that the Highway Department has no immediate plans to improve 156. Don Hunnicutt asked if there was a minimum width on a drive. Bobbie Jones stated that in an I-1 District, there is no minimum driveway width. Hunnicutt stated that the narrowness of the drive to this property bothered him. He asked if this would be considered a tandem lot. Bobbie Jones stated it could not as it has frontage on both Highway 71 and Willoughby Road. Beth Crocker stated she did not want to see this property's access coming off of Highway 71. She felt that Willoughby Road should be used. Hunnicutt stated that the property between Andre's and Highway 71 is also allowed to use this access. Andre stated that is correct. Hunnicutt stated it is not really a private drive, but a street. Andre stated that Willoughby Road is presently a dirt road, that when it is improved, it will be a beautiful access. Williams asked how many splits could be performed on the balance of the property. Bobbie Jones stated that until last week, she would have determined that only one more split could be performed on this property. However, the City Attorney has determined that lot split regulations will be enforced as of August 1, 1980. This means that instead of one piece of property with two splits already performed, there are two lots of record which could theoretically be split. VS - 4 Subdivision Committee Meeting • May 8, 1981 Page 2 • • This can be controlled, as the area is such that there may not be enough property to split without a waiver from the Planning Commission for minimum lot size for a lot split. Andre stated he had already obtained a Highway 71 South address and that he felt his business needed this access. Don Hunnicutt asked if Beth Crocker would be opposed to letting Dr. Andre use this Highway 71 access until such time as Willoughby Road is paved. Ms. Crocker did not think that 71 should be used at all. Dr. Andre stated he would like to maintain the Highway 71 access. Hunnicutt asked Crocker if she had an objection to the arrangement discussed concerning McCollum Road. Ms. Crocker stated she did not have a problem with the proposed development other than her feeling that Highway 71 should not be used for access into this development. Bobbie Jones stated that there is a water line buried in this 25 ft. access from Highway 71 to the site. This water line was placed in the -25 ft. strip and no easement was ever obtained for it. This was done prior to Dr. Andre purchasing his tract. Bobbie Jones stated she had spoken with a representative of the State Highway Department. He had told her that Willoughby Road is on "hold" as far as the state improving it. She said that other than the additional right-of-way to bring Willoughby Road up to standards as far as the Master Street Plan (80 ft.), she could require no other improvements to it. It is a State Highway, and the state will improve it. The State will have to deal with Dr. Andie as far as obtaining any additional right-of-way. As she understands it, Dr. Andre will' install a 5 ft. sidewalk on Willoughby Road adjacent to his property. Bobbie Jones stated that Dr. Andre has a permit from the State Highway Department for his access on Highway 71. Ms. Jones read from the ordinance the conditions under which a Large Scale Development Plan could be turned down (Art. IV, Section I (d). The Committee discussed (d) "The proposed development would create or compound a dangerous traffic condition. For the purpose of this section, a " dangerous traffic condition shall be construed to mean a traffic condition in which the risk of accidents involving motor vehicles is significant due to factors such as, but not limited to, high traffic volume, topography, or the nature of the traffic pattern". Williams said that in order to compound a dangerous traffic condition, you must first agree that a dangerous traffic condition exists. Bobbie Jones said there is a high traffic volume in this area. Don Hunnicutt stated that for that matter, he felt that the access to Willoughby Road, off of Highway 71 South, is more dangerous than this particular access. Bobbie said there are four lanes of traffic and no fifth turning lane. Beth Crocker stated the more drives there are on Highway 71, the more the condition is compounded. Williams stated that the access is there already, that nothing will be compounded as it exists already. Also, if Mr. Hunnicutt's statement that Willoughby Road is a more dangerous condition than Dr. Andre's access is true, then Dr. Andre would be eliminating a dangerous traffic condition by not using Willoughby Road Williams moved that this development be passed on to the Planning Commission and the following items considered: G24.1 Subdivision Committee Meeting • May 8, 1981 Page 3 • • • • Beth Crocker left the proceedings at 9:45, A.M. 1. The 12-1/2 ft. setback requirement from access drive to property line must be waived if this access is to be used. 2. The 30 ft. safety zone between drives would have to be waived if the Highway 71 access is used with this development. 3. Recommend that the driveway not connect with McCollum now or at any time in the future. 4. Recommend acceptance of the Northeast corner of this tract as described in letter dated April 28, 1981 from Don Grimes to Dr. John Andre. 5. Only dedication to bring Willoughby Road up to City Standards according to the Master Street Plan will be required at this time. 6. Setbacks from Willoughby Road for future structures are not approved at this time. 7. Bill of Assurance to be posted by Developer assuring that a 5 ft, wide sidewalk will be constructed adjacent to Willoughby Road by this developer for the entire length of his tract. 8. Planning Commission to address the length of the proposed 25 ft. access drive off of Highway 71 and access by other properties to the private drive. 9. All other Plat Review Committee comments will apply. Don Hunnicutt seconded. The motion passed (2-0) There being no further business, the meeting adjourned at 10:00, A.M.
