HomeMy WebLinkAbout1981-04-10 - Minutes• • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee was held at 9:00, A.M., April 10, 1981, in the Board of Directors Room, City Administration Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Friday, Building, Chairman Don Hunnicutt, Elizabeth Crocker, Newton Hailey. David Williams. Butch Pappon, Harry Gray, Ervan Wimberly, Jim Hill, Bob Crafton, Cynthia Stewart, Bobbie Jones. The minutes of the March 23, 1981, Subdivision MINUTES Committee Meeting were approved as mailed. The rnext item of business was PRELIMINARY PLAT the approval of the preliminary plat of 0. E. LUTTRELL 0. E. Luttrell, located inside the Growth INSIDE GROWTH AREA Area, West of Highway 71 By -Pass, South of Highway 16 West, and East of County Road #650; 0. E. Luttrell - Owner. (Tabled at the March 9, 1981 Planning Commission Meeting until Board of Directors meeting April 7, for guidelines as far as requiring Developers in the Growth Area to extend water lines to subdivisions if a substantial amount of off-site work must be done in the extension). Harry Gray was present to represent. Bobbie Jones stated that at their meeting April 7, the Board of Directors did set a guideline as far as requiring Developers in the Growth Area to extend water lines to subdivisions. The Board ruled that water will be extended unless waived by the Board of Directors. This Developer then asked the Board of Directors for a waiver of the requirement that water lines be extended to this subdivision. The Board waived the requirement for the remaining two lots in the subdivision not already served by wells. Newton Hailey moved that the preliminary plat of 0. E. Luttrell be approved subject to Plat Review Committee and County Planning Board comments. Beth Crocker seconded. The motion passed (3-0). The next item for consideration FINAL PLAT was the approval of the final plat of APPLEBY ACRES Appleby Acres, located West of Highway GOTTLIEB CORPORATION 71 and North of Appleby Road; GO -Hay. Partnership, GSCnCompany, Wal-Mart Properties, Inc. Owner and Developers. Zoned C-2, Thoroughfare Commercial District. Butch Pappon, Ervan Wimberly, and Harry Gray were present to represent. Beth Crocker stated that she thought it was a good idea on Gottlieb's ,part to construct the fence prior to beginning construction. She felt it might have created problems in the adjoining neighborhood had it not beeh constructed. 15 Subdivision Committee Meeting • April 10, 1981, Page 2 • • Crocker moved to recommend approval of the Final Plat of Appleby Acres with the following conditions: 1. Designate the 15 ft. utility easement on the Southeast side of the Development a water easement. 2. Waive one street light along Appleby Road, South of the proposed Wal-Mart Store. 3. Subject to all Plat Review Committee comments. Newton Hailey seconded. The motion passed (3-0). The next item of business was the FINAL PLAT approval of the final plat of ;EAST OAKS SUBDIVISION East Oaks Subdivision, Phase II, located BILLY $.'JAMIE SCHNEIDER West of Highway 265, East of Old Wire Road and South of the proposed Township Road; Billy $ Jamie Schneider - Owner and Developer. Zoned R-1, Low Density Residential District. Harry Gray and Ervan Wimberly were present to represent. Jim Hill, 1965 Bois de Arc, addressed the Subdivision Committee. He stated that he lives at the corner of Bois de Arc and Primrose Lane: He stated that he was concerned about the possible opening of Bois de Arc into East Oaks Subdivision. He felt that the additional traffic from this subdivision would worsen an already bad traffic condition. He stated that this traffic would ultimately end up taking Winwood to Highway 45. Winwood is a narrow, curvey street, and he felt there was already too much traffic on Winwood. Wimberly and Gray both pointed out that the traffic would also have access North of the Subdivision with the opening of Azalea Terrace. Both felt that the added traffic to Winwood would be minimal and that perhaps the traffic load would be lightened. Also, in the near future, Country Way will intersect with Highway 265; and sometime in the future, Township Road will be constructed. All these things taken into consideration, they felt that the traffic condition on Winwood would not be substantially increased. Also, this subdivision will have access to Highway 45 via the connection with the existing East Oaks Drive which will give good access to Highway 45 East to the South of the subdivision. The East Oaks Drive connection to Highway 45 was not in when the preliminary plat was approved. Bob Crafton stated his company had filed the preliminary plat on this subdivision. He stated that the Planning Commission had intended for Bois de Arc to be extended with Phase II of East Oaks Subdivision when the street pattern was completed. Beth Crocker stated that the construction of East Oaks will take a lot of traffic South. Crafton stated that West of this subdivision will not be accessible and that emergency and police vehicles will have to travel around to get into this subdivision if they happen to be West of it. Gray stated that Clayton Powell and Wally Brt had both recommended the opening of Bois de Arc and Azalea Terrace. 1b Subdivision Committee Meeting April 10, 1981 • Page 3 • Harry Gray stated that if the Subdivision Committee does not recommend Bois de Arc be connected with the stub in Sweetser's subdivision, that the Developers not be required to construct it at all in this phase. He said that there was no need in taking Bois de Arc to the property line of this subdivision, if it is never to be constructed. He said constructing this portion of street would cost approximately $6,000.00. Beth Crocker moved that the final plat of East Oaks Subdivision, Phase II be approved with three conditions: 1. Question whether the Planning Commission wants Bois de Arc opened up now, and if they don't, recommend that Bois de Arc not be constructed at all and let them pick up another lot. 2. Recommend the connection of Azalea Terrace with existing street in Brookside East subdivision to the North. • 3. Subject to all other Plat Review Committee comments and requests. • Newton Hailey seconded. The motion passed (3-0). The next item of business FINAL PLAT was the approval of the Final Plat of CATO SPRINGS ESTATES Cato Springs Estates located inside the INSIDE GROWTH AREA Growth Area, West of Cato Springs Road (Highway 265) and South of County Road #200; Jim Hatfield - Owner. There was no one present to represent. Upon a motion by Hailey and a second by Crocker, the final plat for Cato Springs Estates was approved with the following conditions: 1. Include the two existing septic systems on the final plat. (These were on the preliminary plat, but ommitted from the final plat.) 2. Subject to all Plat Review.Committee and County Planning Board comments. The motion to approve passed (3-0).. The next item for consideration CONCEPT PLAT was the concept plat for property J. B. HAYS PROPERTY located East of North College Avenue ABOVE WESTERN SIZZLIN' on the hillside above Western Sizzlin' Steak House; J. B. Hays:- Owner. Zoned C-2, Thoroughfare Commercial District and R-0, Residential -Office District., Ervan Wimberly and Harry Gray were present to represent. Wimberly stated the proposed structures will be one and two stories high. The streets leading • into the development will be 2% grade coming off of Highway 71 and 12% grade from that point up the hill. The existing slope is 22%. The streets will be storm drained, curbed and guttered. The streets will have slotted drainage • 17 Subdivision Committee Meeting April 10, 1981 • Page 4 • to prevent surface water from emptying onto Highway 71. The street will intersect Highway 71 at a 90 degree angle; they plan to close one of the driveways from King Pizza and all the slopes will be stabilized and protected. Wimberly stated the developer is requesting that he be allowed to construct 24 ft. wide streets rather than the 31 ft. of pavement required by ordinance. The Developer will need this reduced width in order to bring the slopes down to a lesser grade. The Developers plan to install sidewalk on one side of the proposed street. Bobbie Jones stated that Clayton Powell had discussed this site with her, and that he felt the streets within this development should be private. Bobbie said that Clayton had thought that grading was being performed on these streets at this time. Ervan assured Bobbie that he was removing some dirt for the shopping center site, at the Old 71 Drive -In. Don Hunnicutt asked what the maximum slope on a street is. Bobbie Jones stated that 10% for asphalt, anything over 10% must be concrete. 15% slope is the maximum allowable unless waived by the Planning Commission. Hailey asked Wimberly if he had any objections to making these streets private. Wimberly stated he did not. Hailey stated there is land in town that is not suitable for development. Wimberly agreed, but the land is there and there is money in it. Beth Crocker asked if the Planning Commission could waive the street width requirement. Bobbie Jones said the Planning Commission has the power to waive street widths only in PUDs. The Board of Directors would have to waive the street width requirement in this case. Crocker moved that this discussion be taken up at the Planning Commission meeting April 13, 1981. Newton Hailey seconded. The motion passed (3-0). The next item of business was MILLSAP ROAD $ the approval of design and location HIGHWAY 71 B of the intersection of the By -Pass INTERSECTION service road with the West side of Highway 71 B in the Millsap Road area. Bob Crafton was present to represent. Crofton stated that he had presented a concept to the Technical Advisory Committee and the Planning Commission for construction of a service road in the Southwest quadrant of Highway 71 B and the By -Pass, South of the Mall. The Planning Commission requested that a resolution be drafted that the Planning Commission will approve the.relocating of Service Roads behind a development rather than adjacent to the Highway. He stated that he is presenting a preliminary plat of the street system. The Master Plan calls for service roads to be constructed immediately adjacent to the right-of-way. Instead of constructing the service road in this manner, the developer proposes to make a sharp turn around the development to tie into the existing service road off-site. Crafton stated that the reason this is being requested is to provide access to property West of the proposed development which was a condition .of sale. This access to the West is reflected on the right-of-way deeds for the Highway Department. Bobbie Jones stated that if this preliminary plat is approved, it will be 1� • Subdivision Committee Meeting April 10, 1981 Page 5 for the design of the streets only, and that anydevelopment of the property will also have to be reviewed. Also, subdivision requirements state that when a street is put in, a plat must be submitted showing how the land will be used. Jones further stated that the ordinance requires that the other access point to the By -Pass be closed. Crafton stated this development will occur in phases. The Developer proposes to construct six to seven hundred feet of service road with a temporary turn around back in the property. The final plat will reflect development. The front portion of the property is zoned for commercial development. The back portion of the property is zoned A-1 at this time, but will perhaps be rezoned in the future. Crafton stated that access to 71 By -Pass is crucial to this development, and that there will be right turn movement only. Bobbie Jones read Chapter 18, Section 13, Subsection C (4) of the Code of Ordinances. According to this ordinance, the Developer will not be allowed to have access to both the service road and the Highway. Grafton stated that elimination of the access to Highway 71 would limit the development of this property. He further stated that the access to Highway 71, and the location of that access by the Highway Department had been directly involved in the price paid for this property. Bob Crafton stated that when he.had presented this proposal to the TAC committee, they had expected a traffic signal_to be installed at Millsap, however, the Highway Department will not come in ahead of time and install a traffic signal, they wait until the: intersection has been constructed, conduct studies, then decide if the installation of,a traffic signal is warranted. Bobbie Jones stated this preliminary plat would have to be reviewed by the Plat Review Committee. Crafton stated he thought this was the Plat Review Committee. She said that any development. would have to be reviwed by the Plat Review Committee before a Final Plat could be filed. Don Hunnicutt asked if what Bobbie was saying was that when this developer ties into the service road the access to Highway 71 will have to .be closed. Bobbie stated according to City Ordinances, that is correct. The service road is to tie into the By -Pass at intersections, but that access is not to be constructed unless a special exception exists. Mr. Turnbow stated he was thoroughly confused. He stated that access to the Highway had been directly connected with the price he had paid for the property. Crocker felt that perhaps this proposal should go back to the TAC committee for further consideration and they should address this particular intersection. Crafton stated that the committee consists of many persons, some from Little Rock and it is not all that simple getting them together for a meeting. Crocker stated that the developers should submit a bigger, more detailed map showing the surrounding areas. Crocker moved that this item be deferred to the Planning Commission and that McCord be requested to attend' the meeting April 13, 1981, to discuss: 1. Since the Developer shows access to Millsap, should the developer be allowed to develop the access point to Highway 71 By -Pass at all. Subdivision Committee Meeting April 10, 1981 Page 6 If the Ordinance does not state this, and the Developer can have access, does it mean that when the service road is connected with the Highway at a later point that the developer will have to give up their Highway 71 By -Pass access. Who should the Planning Commission go to for advice as to whether the access should be there in the first place, the TAC committee? There being no further business, the meeting adjourned at 11:00, A.M. •
