HomeMy WebLinkAbout1981-03-06 - Minutes• • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held at 9:00, A.M., Friday, March 6, 1981, in the Board of Directors Room, Chamber of Commerce Building, Fayetteville, Arkansas. MEMBERS PRESENT: Chairman Don Hunnicutt, Newton Hailey (one seat vacant). MEMBERS ABSENT: Beth Crocker. OTHERS PRESENT: Paul Marinoni, Sr., Paul Marinoni, Jr., Paul Mattke, Neal Albright, Harry Gray, Cynthia Stewart, Bobbie Jones, General Bruce Kendall. The Chairman called the meeting to order at 9:03, A.M. The minutes of the February 20, 1981 meeting of the Subdivision Committee were approved as mailed. MINUTES The Chairman stated that items 3 and 5 would be discussed first as they are both outside the City and inside the Growth Area. As there was no one present to represent Item 3 at this time, the Committee considered item 5. The fifth item on the Agenda was the approval of the preliminary plat of Cato Springs Estate located outside the City Limits, South of County Road #200 and West of State Highway #265; Jim Hatfield, Owner and Developer. Tabled February 23, 1981, CATO SPRINGS ESTATE to allow the County Planning Board time OUTSIDE CITY to review the plat. JIM HATFIELD Neal Albright was present to represent. General Kendall stated that he did not feel it was necessary to table this item at the February 23, 1981 meeting, that the Subdivision Committee and the Planning Commission could consider Bud Allen's comments or his own as the comments from the Planning Board. Bud Allen requested that ten additional feet of right-of-way be dedicated for Highway 265 for a total of forty feet from the centerline towards this developer's property. Newton Hailey moved that this subdivision be approved subject to Plat Review Committee comments. The Developer had requested that City Jurisdication be waived, as this subdivision lies outside the City Limits. Hailey stated that his motion includes a denial of the waiver of jurisdiction.. Don Hunnicutt seconded. The motion passed (2-0). Albright asked if the locations of the existing_septic systems should be on the plat. Hunnicutt stated they should beton the Final Plat. The next item addressed by the Commission was the approval of the preliminary plat of Camelot Addition, located East of Highway 71 By-pass, South of Highway 16 West, and West of Porter Road; Paul Marinoni and Sons, Owner and Developer. Zoned R-1, Low Density Residential District. Hunnicutt stated that the Committee was looking at quite a few waivers. He asked the Developers to explain each request, and the Developers obliged. After much discussion, Newton Hailey moved to approve the subdivision based on the following recommendations: 1. Keep existing roll-over curb and gutter. 2. The Developers suggestion for flaring ,the existing 30 ft. pavement to widen it to the required 31 ft. of pavement will be accepted. 3. Recommending denial of waiver of base requirement of SB -2 unless approved by Clayton Powell. 4. Agree to waive the requirement that curb, gutter and sidewalk be installed in temporary culs-de-sac with the Developer entering into an agreement with the City that if the temporary cul-de-sac is not extended within a five year period, the cul-de-sac will be brought up to City Standards at the Developer's expense. 5. Recommend denial of the requested waiver of street light requirements. • (a) Approve requested waiver of street light spacing, as shown on preliminary plat. 6. Recommend denial of the requested waiver of the sidewalk requirements. 7. Work easements out with Don Bunn (easements within the subdivision are private easement's for the City Water and Sewer Lines only. The Developer proposes to have the Board of Directors release these easements, so that other utilities may share them with City utilities. Mr. Mattke stated that the easements will be platted into the Subdivision at the same width or wider than the existing easements. 8. Cleveland will be constructed when Camelot Avenue is constructed to connect East with Aberdeen Avenue and Lancelot Avenue. The easement. shown to the East will be maintained as a dedicated street right-of-way. 9. All other applicable Plat Review Comments will apply. Don Hunnicutt seconded, and the motion passed (2-0). There now being some one present PRELIMINARY PLAT to represent, the Committee addressed 0. E. LUTRELL the approval of the preliminary plat for OUTSIDE CITY LIMITS 0. E. Lutrell, located Outside the City Limits, inside the Growth Area, West of Highway 71, By-pass, South of Highway 16 West, and East of County Road #650. • Subdivision Committee Meeting March 6, 1981 Page 3 General Bruce Kendall commented for the County. The County requires that this Developer dedicate 30 ft. of right-of-way from the centerline of County Road #650 toward his subdivision. Bobbie Jones reported that General Kendall had also required for the County that the proposed cul-de-sac be constructed to the same standards as County Road #650; that is: a hot mix application rather than chip and seal. Bobbie Jones asked if the Developer had worked up the cost estimate on running water to this subdivision as requested by Don Bunn at Plat Review. Gray stated that the cost of running a 6" public water line to this subdivision would cost slightly over $13,000.00. The existing water line that would have to be tapped is on the North side of Highway 16, and the road would have to be bored under. Gray stated that there are existing wells on Lots 2, 3, F, 4. To install an individual well runs approximately $1200.00 per well. Newton Hailey asked that if an improvement district was formed, if the Developer could recoup some of his cost if he is required to run water to this subdivision. Gray stated that he could. Gray stated that in order to bring water to this subdivision, S80 ft. of off-site work would have to be done, and the subdivision is only 5S0 ft. wide, he thought that was a bit unfeasible. Hailey asked if Gray had received perc test approval for the subdivision. Gray replied the perc test had been scheduled, but that he had not yet: had one performed. Harry stated that the state requires that there be sufficient area for two fields on each lot. Newton stated he would not want to recommend this subdivision for approval without water, as the area is growing so fast He asked Gray if he could get together some information for an improvement district. Don Hunnicutt wondered how much a developer should have to spend to get water to a subdivision when there is already existing well water. He said he knew that there is a 300 ft. limit for requiring someone in the City Limits to hook on to sewer, and wondered if there was some type of limit on water too. Bobbie Jones thought perhaps something could be worked out by delayed off-site improvement, where the money could be placed in an interest bearing escrow accound, and at the end of five years, the Planning Commission would hold a public hearing if the improvements had not been performed. n At;that_ time it would be decided if the money should be used for some other type of. improvement or refunded. If the money is refunded, it goes either to the subdivider with interest, or to the property owners at this time on a pro rata basis with interest. Hunnicutt asked if Mr. Gray would be willing to check into the possibility of forming an improvement district. Gray agreed to investigate. Newton Hailey moved to approve the preliminary plat for 0. E. Lutrell subject to the comments made by the Plat Review Committee, the County Planning Board. The Planning Commission will make a decision on whether the Developer will run water to the subdivision as opposed to lots being served by existing wells. 10 Subdivision Committee Meeting • March 6, 1981 Page 4 • The last item for consideration FINAL PLAT was the approval of the final plat WEST WIND PHASE III of West Wind, Phase III, A PLANNED UNIT DEVELOPMENT A Planned Unit Development, located North of Township Road, East of College Avenue, and South of Rolling Hills. Drive; Jim Younkin and Johnnie Bassett, Owners and Developers. Zoned R-1, Low Density Residential District. Harry Gray was present to represent. The Developers are asking that the Planning Commission consider the following: 1) That the Developers not be required to install sidewalks as they were not required to construct them in either Phase I or II. Also, sidewalks had not been required at the preliminary plat level. 2) That the Developers not be required to install street lights for the same reasons as 1 above. 3) Should the third phase of West Wind be required to contribute for parks acquisition, since this is partially a replat, and under the new ordinance, replats are subject to the parks requirement. Newton Hailey did not feel that the parks requirement should be applicable unless a major replat is filed. Gray commented that there is only one more lot than on the original preliminary. Hailey stated this situation should be clarified. Bobbie Jones stated she would check with McCord for an opinion in this case. Newton Hailey moved that the Final Plat for West Wind, Phase III be approved based on previous approval and according to the rules and regulations that applied when the preliminary plat was filed. Also, since this is a PUD, and the Planning Commission has the power to waive requirements within a PUD, recommend waiver of the minimum street width from 22 ft. to 20 ft. Waiver of sidewalks, street lights, and parks will be based on recommendation from Jim McCord. Don Hunnicutt secondedand the motion passed (2-0). There being no further business, the meeting adjourned at 10:20. I I
