MINUTES OF A SUBDIVISION COMMITTEE MEETING
A meeting of the Subdivision Committee of the Planning Commission was
held at 9:05, A.M., Friday, February 20, 1981, in the Board of Directors Room,
City Administration Building, Fayetteville, Arkansas.

Acting Chairman Don Hunnicutt, Beth Crocker, Newton Hailey,
(one position vacant).
None.
Neal Albright, Clayton Powell, Don Bunn, Jim McCord, Cynthia
Stewart, Bobbie Jones, Jim Vizzier.
The minutes of the February 9, 1981,
meeting of the Subdivision Committee were
approved with one addition, that being
that a fourth item be added to the Subdivision Recommendation for approval
of the Large Scale Development Plan for Bittle Apartments as follows:
4. Developer will install 15-1/2 ft. of street, including curb and gutter
from the centerline of the existing right-of-way of Nettleship Street
for the full length of the development.
APPROVAL OF THE MINUTES
The next item of business was PRELIMINARY PLAT
the approval of the Preliminary Plat CATO SPRINGS ESTATES
of Cato Springs Estate located South of OUTSIDE CITY
County Road #200, West of State Highway
265. Jim Hatfield - Owner and Developer.
Neal Albright, Engineer was present to represent.
Beth Crocker moved that this item be tabled pending a recommendation from
the County Planning Board. This property lies inside the Growth Area, but
outside City Limits, and therefore, County Standards will apply.
Newton Hailey seconded.'
Newton Hailey asked if Jim Hatfield owned all the property in the
Subdivision. Mr. Albright stated he does not. Hailey asked if the property
had already been split. Albright stated it had.
Hailey stated that since there are lots in this Subdivision served by
septic systems, that the septic systems be located on the plat in relation
to property lines. Also, the owners of the property within the Subdivision
should be on the Plat.
Beth Crocker's motion to table passed (3-0).
Under other business, the Subdivision OTHER BUSINESS
Committee addressed the percentage, under
rational nexus, the Developersof the Washington
Mountain PUD should have to contribute to the improvement of Finger Road Finger
Road will be improved with the First Phase of Development of this PUD. Washington
Mountain PUD is located South of Highway 62 West, and West of Highway 71 By -
Pass.

Jim Vizzier was present to represent.
Vizzier stated that the distance of improvement of Finger Road which would
be off-site would consist of bringing 800-1000 feet of Finger Road up to
City Standards. His question is what percentage of the cost, by rational nexus,
the developers will have to bear. Mr. Vizzier felt that other persons either
presently using Finger Road, or those who would develop properties in the
area with later development would benefit from this Developer's capital outlay
to bring Finger Road up to standards, and wondered if perhaps some contribution
could be obtained at a later date from those persons.
Clayton Powell, City Street Superintendent, stated that he is recommending
that portion of Finger Road from the perimeter of the PUD to Highway 62 West
be improved to City Standards by this developer. That is, 31 ft. of pavement
from back of curb to back of curb with curb and gutter. Clayton stated that
Finger Road, after it forks to the East is a 20 ft. gravel access road
(not a public street) which the City has maintained and which provides access
to the FAA Omni tower and three houses. He said that this road is not adequate
to serve a subdivision. In his opinion, this Developer should provide adequate
access to his subdivision, that involves improving the 800-1000 feet of Finger
Road between his PUD and Highway 62 West.
Mr. Powell recommended two other improved access points for the total
development: East Farmers Drive, to be improved into the Subdivision to the
same standards as constructed by Community Development wherein the only
variance was in pavement width, or West Farmers Drive be constructed to full
City Standards from Highway 62 into the Subdivision. Also, that an access
be obtained with 50 ft. right-of-way and constructed to full City Standards
back to the By -Pass service road to the East; either across Major Taylor or
at some other point.
Don Hunnicutt wondered if this Developer's outlay would benefit others
in this area.
Beth Crocker did not agree. She stated that the development of this
PUD is creating the need for the road. She said that this might create a wind-
fall for other people, but this PUD is creating the need for the access, therefore,
the rational nexus exists.
Don Hunnicutt felt that the improvement of this road would open up other
areas, and that developers of those areas should be taxed for the improvement
of the road also.
McCord stated he was in agreement with Beth Crocker. A precedent had
been set with the Strawberry Hill Addition on Oak Bailey Road. The Developers
improved an existing street that was not up to City Standards which benefitted
existing houses. McCord stated that when other developments occur, they will
improve other portions of Finger Road.
Don Hunnicutt asked if this Developer should contribute 100%. He
wondered if the City could perform the construction and be reimbursed at a
later date. Clayton Powell stated that the City cannot act as banker and collect
the money at a later date. He said this had been done on other occasions where
an improvement district had been formed. But, Powell did not think that
property owners in the area could be persuaded to contribute to the building
of the street when it was needed to get to this developer's subdivision.
Hunnicutt asked if perhaps the developer could put the money up and

build the street at a later date. Beth Crocker did not think that was a
good idea, she felt the street should be constructed at the same time the
subdivision is put in. McCord agreed that this section of street would
be needed immediately.
Don Hunnicutt asked what percentage the Developer should bear. Beth
Crocker stated that the Developer should contribute 100%, since this subdivision
is creating the need for the road.
Beth Crocker moved that a recommendation be made to the Planning Commission
that this developer should bear 100% of the cost of improvement of Finger Road
Don Hunnicutt seconded.
The motion passed (2-0-1) with Newton Hailey abstaining.
The meeting adjourned at 9:50, A.M.
