A meeting of the Subdivision Committee of the Planning Commission
was held at 4:30, P.M., on Monday, October 27, 1980, in the Board of
Directors Room, City Administration Building, Fayetteville, Arkansas
MEMBERS PRESENT: Chairman Keith Newhouse, Elizabeth Crocker, Don Hunnicutt,
Newton Hailey.
MEMBERS ABSENT: None.
OTHERS PRESENT: Lynn Wade, Carl Russell, Cynthia Stewart and Bobbie Jones.
The Chairman called the meeting to order
at 4:30, P.M.
The first item of business was
the approval of the minutes of the
October 13, 1980 Subdivision Committee Meeting.
The minutes were approved as mailed.
The next item for
consideration was the approval
of the Large Scale Development Plan
for Hog Country Distributing Company,
to be located 1/8 mile South of 6th
Street, East of Razorback Road, and West
Company, Owner $ Developer. Property is
R-2, Medium Density Residential District
Industrial District.
Lynn Wade, Attorneys and Carl Russell, Architect were present to represent.
Keith Newhouse asked about the insertion in Bobbie Jones' comments at
the Plat Review, by Don Bunn, stating that the State Highway Department plans
to run Razorback Road through the Development site.
Carl Russell stated that the Highway Department has made its plans known,
and that it is more or less following the existing centerline of Razorback
Road. Don Bunn, City Engineer, had thought the Highway would cross .the
railroad spur somewhere near the South property line and swing into the proposed
Development.
Bobbie Jones said that she did not know how much right-of-way the
Highway Department could require. She stated that according to the Master
Street Plan, Razorback Road adjacent to this development is an arterial street
and requires an 80 ft. right-of-way. The Developer will be required to
dedicate at least 40 ft. from the existing centerline of Razorback Road under
the Master Street Plan.
Carl Russell stated that the right-of-way, where it passes the proposed
structure on the Development Plan is completely West of this Developer's
property, and across the railroad tracks. Mr Russell said that the dedication
of right-of-way, even if the Highway Department requires 120 ft., will be complied

with and will be no problem.
Keith Newhouse asked if the Highway Department should install sidewalks
where Razorback Road crosses the railroad tracks and leaves this Developer's
property.
David McWethy, Administrative Assistant to the City Manager, stated that
if the Developer is running a railroad spur to serve this development, that the
Developer should be required to install the sidewalks. Mr. Russell said that
the right-of-way is not on this Developer's property. Russell said that once the
right-of-way crosses the tracks, it is not adjacent to the Developer's property
until it rejoins the property further South.
Beth Crocker stated that the sidewalks should connect. McWethy said
that perhaps this should be considered an off-site improvement, and the
Developer should be required to install sidewalks for the full length of
his property running along Razorback Road.
Keith Newhouse said he would recommend that the Developer install sidewalks
along the East side of Razorback Road, the full length of his property.
Bobbie Jones said that approval of this Large Scale Development Plan
is subject to a rezoning petition for the property to be taken up at the
Planning Commission Meeting. Also, some easements have been requested by
the Plat Review Committee. The Gas Company requested a 25 ft. easement East
of the future Razorback Road right-of-way, and the Telephone Company requested
some easements on the North, South and East sides of the Development, but they
are being discussed between the Phone Company and the Developer, and they are
to inform City Planning of their plans.
Bobbie said this development abuts residential property on the North,
South and East sides, and that the ordinance requires screening, either fence
or vegetation. Mr Russell had stated at Plat Review that the existing vegetation
will probably be sufficient. Russell, said the Developers do not plan to clear
any of the wooded areas, except where the building and paved areas will be
constructed.
Keith Newhouse asked if there are any future plans for expanding the
site. Carl Russell said not at this time. Newhouse said perhaps it should be
part of the recommendation, that if any future clearance of the site occurs,
that screening will be installed.
Bobbie Jones said that Campbell Soup had at one time petitioned to rezone
the property they own to the South of this site. At that time the rezoning
of Campbell Soup property North of the%Railroad Spur from R-2 to Industrial
had been denied.
Beth Crocker said that the Highway Department is supposed to build
Razorback Road where it abuts this Development. She asked if some provision
should not be made, in case the Highway Department's plans fall through, and
they do not construct the street, whereby the Developer would be responsible
for building the street abutting his development if the Highway Department
does'not do so.
Keith Newhouse said the Developer should be required to put up a Bill
of Assurance. Carl Russell asked if the Bill of Assurance would have to be
posted before the building permit is issued. Newhouse said that is correct,
also, cash will have to be posted for the construction of the sidewalks.
Beth Crocker asked if cash should not also be posted for the improvement

of Razorback Road. Newhouse said he was not sure and asked if this is
Highway Department property.
Bobbie Jones said that when the Highway Department lets contracts,
and obtains right-of-way, then the property would become the Highway
Department!.s.
Bobbie said that the Developer should be required to improve his proportionate
share of Razorback should the Highway Department's plans fall through. He
is required to do so under Chapter 18-47 (B) (3) of the Code, as well as
under Appendix C, Art. IV, Section I (2) (d) of the Code of Ordinances.
Bobbie said she could have the City Attorney, Jim McCord prepare either
a contract or a bill of assurance to the effect that; if the Highway Department
does not improve Razorback, the Developer will contribute his proportionate
share of the cost of improvement of Razorback where it abuts his property.
Beth Crocker said that a cash bond should be posted for construction of
the sidewalks. Bobbie Jones agreed.
Bobbie Jones said that the Developers are proposing a septic tank and
absorption field to dispose of waste.
Mr. Russell said he would design the septic tank and absorption field in
such a manner so that it will be easy to connect to City sewer when it is
extended to the site.
Hailey asked if the truck wash waste would go into the septic tank and
absorption field. Mr. Russell said it would be wasted separately through a
sediment trap consisting of sand and gravel, and then wasted through a
separate absorption field.
Hailey moved to approve the Large Scale Development Plan for
Hog Country Distributing Company with the following conditions:
1. Developer will conform to Plat Review Comments.
2. Recommend approval, subject to rezoning petition to be considered by
the Planning Commission and the Board of Directors.
3. The Developer will enter into a contract or Bill of Assurance to insure
improvement of his proportionate share of Razorback Road, if the
Highway Department should decide not to improve Razorback Road adjacent
to this development. Per ordinance, the Developer will install sidewalks
along the whole East side of Razorback Road for the entire length of
his property, regardless of who improves Razorback Road.
4. Existing vegetation will serve as screening. If vegetation is removed and
screening is required, the Developer will install either a fence or
vegetation screening.
5. The septic tank and absorption field will be accepted for waste disposal,
with the condition that the truck wash be wasted separately.
Elizabeth Crocker seconded. The motion to recommend approval passed
• (3-0-1) with Don Hunnicutt abstaining.
