HomeMy WebLinkAbout1980-09-08 - MinutesMINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the Planning Commission was held at 3:15, P.M., Monday, September 8, 1980, in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Keith Newhouse, Don Hunnicutt, Beth Crocker (arrived late), Newton Hailey (arrived late). None. Mel Milholland, Rick Cowdrey, Richard Mayes, Tom Hopper, Jim Lindsey, Larry Wood, Cynthia Jim Stephens, Stewart, Bobbie Jones. The first item for discussion was the FINAL PLAT approval of the final plat of Township TOWNSHIP COMMON Common located North of Township Road, NORTHWOOD HOMES CORP. East of Highway 71 B, and West of Old Wire Road. Northwood Homes Corp. - Owner, Milby Pickell - Developer. Zoned R-1, Low Density Residential. Mel Milholland was present to represent. Keith Newhouse asked if proof had been furnished that there are no liens against improvements within the Subdivision. Bobbie Jones said she had not received such proof. She stated that proof must be furnished, or a bond posted to cover such liens.before the final plat is filed and recorded. Newhouse said the plat does not show how the covenants will be recorded. Bobbie said that a note could be added to the plat showing the book and page on which the covenants are recorded. Newhouse asked if the driveway had been moved back to allow for the additional right-of-way. Milholland stated it had. Newhouse asked if all the adjoining property owners had been notified. Milholland replied that all but two had been notified. Those two had been mailed certified letters, but no receipts have been returned. Newhouse stated that the final plat could not be approved without the notification of all property owners adjacent. Bobbie Jones said proof of notification would have to be furnished for the owners of Lot 4, Block 3, Butterfield Addition, and Lots 6, 7, 8 & 9 of Century Estates. Bobbie Jones stated that the Planning Commission had waived the sidewalk requirements at the preliminary plat level. Don Hunnicutt stated the Master Sidewalk Plan and Ordinance had not been in effect at that time. He said this ought to go before the Board of Directors for a recommendation on the sidewalks. Larry Wood suggested getting Jim McCord's opinion on sidewalks for this subdivision. Bobbie Jones stated that an easement is shown on the final plat as being West of Common Drive and 20 ft. wide. In the Plat Review comments, it is designated as a 25 ft. easement. Bobbie Jones said she would hold the plat until such time as proof is furnished that no liens exist against the improvements, or a bond is posted. Keith Newhouse stated he would recommend approval if the following contingencies are met: 1. The Developer will conform to Mrs. Bobbie Jones comments as laid out in A, B, C, $ D of the August 21, 1980 Plat Review Committee Meeting. Developer must furnish proof that the owners of Lot 4, Block 3 of Butterfield Subdivision, and the owners of Lots 6, 7, 8 F, 9 of Century Estates Subdivision have been notified.of the Subdivision Development. Keith Newhouse said that if proof of notification to the above property owners is not furnished by the time the Planning Commission Meeting commences at 5:00, P.M. today, the Subdivision Committee cannot recommend this Final Plat for approval. 3. Sidewalks will be as per recommendation from the City Attorney Jim McCord and/or the Board of Directors. 4. Easements will have to coincide with the Plat Review Comments. Mr. Hunnicutt agreed with this recommendation. The next item for discussion FINAL PLAT was the approval of the Final Plat MAYES OAKWOOD SUBDIVISION of Mayes Oakwood Subdivision located outside RICHARD MAYES the City, North of Wier Road (County Road 94) in the Salem Community, Richard L. and Ethel Mayes, Owners; and Developers. Richard Mayes was present to represent. Keith Newhouse asked what arrangements had been made on the road. Richard Mayes said he had dedicated 30 ft. from the centerline of the road Bobbie Jones said that at the time the preliminary plat had been approved, the Planning Commission had approved it with the recommendation that hard surface roads be installed within the Subdivision. She said the County is working on the road up to the Subdivision and that actual construction of the road within the subdivision has not begun. Don Hunnicutt asked what the two miles of road for which Mr. Mayes had paid for includes. Mr. Mayes said he had contributed to the paving of Salem Road up to the Subdivision, and that the County is paving Salem Road now. Bobbie Jones said a problem had occurred in that the Final Plat had been signed by everyone except the Chairman of the Fayetteville Planning Commission and had been filed for record without that signature. She said that whoever signs the Plat will have to go to the County Recorder's Office at the Courthouse to do so. Keith Newhouse asked if the legal description matches the perimeter of the lots. Bobbie Jones said it does. Keith Newhouse stated he would recommend approval of the Final Plat for Mayes Oakwood Subdivision and that Windell Cullers would be directed to sign the Final Plat at the County Courthouse. The fourth item on the agenda was the approval of'the preliminary plat of Southern Heights - Phase I, located off the end of Rodgers Drive, South of Lighton Trail, and North of Huntsville Road; S & J Company, Owner. Zoned R-1, Low Density Residential District. Rick Cowdrey and Jim Stephens were present to represent. Keith Newhouse asked where Rock Street would be located. explained that Rock Street is a proposed Collector Street and down to any specific location. He said that as it stands now PRELIMINARY PLAT SOUTHERN HEIGHTS S & J COMPANY Rick Cowdrey, has not been tied , it does not look like Subdivision Committee Meeting September 8, 1980 Page 3 Rock Street will be put through at.the point it is drawn on the preliminary plat. Bobbie Jones stated that on the Major Street Plan, Rock Street comes out of the curve of the extension of Fletcher Street, across to Happy Hollow Road then ties in with 265. Elizabeth Crocker arrived at 4:00 P.M. Bobbie Jones said the Developers had furnished her a plat with the signatures of the adjoining property owners. Keith Newhouse asked if frontage requirements had been met on the cul-de-sac lots. Bobbie Jones replied that they had. Newhouse asked about the request for waiver of the maximum length of the dead end street. Rick Cowdrey stated that waiver refers to Rodgers Drive from the subdivision out to Oklahoma Way. Bobbie said this would apply until such time as Rock Street is extended, or other access is furnished in future phases She said according to the ordinance, the maximum length of a dead end street is 1000 feet in hilly terrain. Rick Cowdrey stated that from the start of the property the dead end street would be 11-1200 ft. in length. Elizabeth Crocker said that from the point where the street originates, the street is more like 2500 ft. in length. Beth Crocker asked what Clayton Powell's recommendation had been for the end of Rodgers Drive. Bobbie Jones 'said that a cul-de-sac is required, but that Clayton had said he would accept a "T -Turn Around". A T -Turn Around would be easier to tie into the grades of the future streets. A cul-de-sac would create a balloon in any future road. Keith Newhouse asked about street lights. Mrs. Jones said that there is a space on Southern Heights Place which is slightly (20') over the 300 ft. maximum distance between street lights. Rick Cowdrey said it scales out at 310'. However, the spacing between the rest of the street lights meets or exceeds the requirements. Don Hunnicutt made a motion to approve the preliminary plat of Southern Heights with the following comments: Waive the maximum length of a dead end street for Rodgers Drive with the condition that a T- Turn Around is constructed on the Southeast end of Rodgers Drive. 2. Waive the maximum distance between street lights along the Southern Heights Place between Lots 6, 7 P, 8. Beth Crocker seconded Don Hunnicutt's motion to approve, the motion passed (3-0). The next item on the agenda was the CONCEPT PLAT AND REPLAT approval of the concept plat and replat of Kantz KANTZ PLACE PUD Place, a Planned Unit Development to be located BALL FAMILY TRUST North of Hwy. 45 East and West of East Oaks Drive, Ball Family Trust, Owner F, Developer. Zoned R-1, Low Density Residential District. Tom Hopper was present to represent. He stated that this proposal consists of the six remaining tracts of land from Kantz Place Development, which the Developers are proposing to develop as a PUD. The PUD would consist of a maximum of 265 lots. There will be 35% open space, and the entire development will be 35.41 acres. • • Subdivision Committee Meeting September 8, 1980 Page 4 The density of the PUD will be 7.5 units per acre, the property is zoned R-1. The outside perimeter of the PUD will be duplexes, set back;50 ft."from the perimeter, four-plexes set back 100 ft. from the perimeter and multi -family units which will be setback 150 ft. from the perimeter. Hopper said the Developers are anticipating developing the PUD with public streets. East Oaks Drive is an existing street constructed with a cul-de-sac (Kantz Lane) off it. Newton Hailey arrived at 4:10, P.M. Hopper said the Developers are proposing the extension of Kantz Lane around and looping it so that it will come back in and tie in with Hwy. 265. He stated he had furnished Bobbie Jones with notification of property owners. Bobbie stated that there is one receipt missing. Bobbie Jones suggested they change some of the street names as there are too many streets named "Kantz". Bobbie Jones asked if each lot would have sewer going to it. Mr. Hopper replied that each lot would have water and sewer. Jim Lindsey stated that in the covenants and also, in the plat, the density would be regulated so that a designated unit with a designated density would be placed on each lot. He said he was doing this so that the early stages of the PUD would not be overly developed to the point that other lots could not be built upon. Jim Lindsey asked if the proposed tennis court on the North part of the PUD was the required distance from the adjoining property line. Bobbie Jones stated that it is too close to the property line the setback is 100 ft. for outdoor sports areas without spectator facilities. Lindsey said in that case it would be moved to conform to setback requirements. Bobbie Jones said that according to the ordinance, the tennis court should be 100 ft. from the property line. Don Hunnicutt said that the maximum number of units on a loop street is 80 units, he asked Mr. Lindsey if he could meet that requirement. Bobbie Jones asked if these were public streets. Lindsey said that they would be public streets. Tom Hopper said he thought a loop street said the maximum of 80 units on a loop street and does not apply to public streets. Beth Crocker moved to approve the concept Planned Unit Development with two conditions: 1. Rename Kantz Avenue. only had one entrance. Bobbie Jones is a requirement for private streets plat and replat for Kantz Place, a 2. Move tennis court on North side of PUD to required distance from property line. Don Hunnicutt seconded Beth Crocker's motion to approve. Bobbie Jones said she might have a problem with Kantz Lane coming up to the corner of the service station property. She felt that a future owner of that property might want access to Kantz Lane. It would require a waiver from the Planning Commission and the permission of 'the PUD. Mr. Hopper stated the street could be moved. Jim Lindsey asked if there was any problem developing this PUD in two phases. Bobbie Jones said there would be no problem, but that recreational facilities should be built with the first phase The Commission voted on Beth Crocker's motion to approve and it passed (3-0-1) with Newton Hailey abstaining. Subdivision Committee Meeting • September 8, 1980 Page 5 • • The Committee now considered the MINUTES minutes of the August 25, 1980 Subdivision Committee Meeting. Beth Crocker requested that the 8 ft. fence height be omitted from her motion to approve the Appleby Acres Subdivision. With that correction, the minutes of the August 25, 1980 Subdivision Committee Meeting were approved as mailed. The meeting::adjourned at 4:30, P.M.
