MINUTES OF A SUBDIVISION COMMITTEE MEETING
The Subdivision Committee of the City Planning Commission met at 4:30 o'clock
P.M., Monday, -April 23, 1979, in the Board of Directors Room, City Administration
Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Keith Newhouse, Elizabeth Crocker, and Bill Kisor.
MEMBERS ABSENT: Newton Hailey.
OTHERS PRESENT: Bobbie Jones, Larry Wood, Gail Biswell, Frank Blew and Richard
Mayes.
Chairman Newhouse called the meeting to order.
The minutes of the previous meeting of April 9, MINUTES
1979, were approved as mailed.
Chairman Newhouse stated that the only item for MAYES OAKWOOD SUBDIVISION
consideration was a request by Richard Mayes for (Outside City)
approval of the preliminary plat of Mayes Oakwood Sub- Preliminary Plat
division located East of Wheeler, Arkansas, and West
of Salem Community approximately 11 miles West of the
City Limits. Mr. Mayes and surveyor Frank Blew were
present to represent.
Chairman Newhouse questioned whether a waiver from the County Planning Board
had been obtained for the hard surface roads as discussed by Mr. Allen at the
Plat Review Committee Meeting. Mr. Mayes replied that a formal waiver had not
been obtained, however, he had discussed the matter with Mr. Allen and he stated
that Mr. Allen had commented that he was pleased "with what we have planned." A
lengthy discussion ensued concerning whether or not the City Planning Commission
should require the hard surfacing of the roads even if the County Planning Board
would not require same. The Chairman stated several times that he felt the City
had already decided to require double chip and oil seals on roads within subdivi-
sions in its planning area. Mr. Mayes took the position that the 11 miles of
roads leading to his subdivision from the paved road were entirely gravel and he
could not see what good hard surfacing the interior subdivision roads would do
at this time. He stated several times that he would be willing to put up a bond
or whatever the City wanted in order to assure them that he would pave these on-
site roads at the time the County paved the off-site roads leading thereto.
Beth Crocker stated that she felt a real problem existed with the City and
County not sticking to their decision to require hard surfacing of on-site roads
within such subdivisions. She stated "we have to start somewhere requiring the
roads to be built that we are going to need in the future." She continued,
stating "I realize that you may have to drive on a bunch of junk to get there
(to the subdivision), but we just have to start somewhere."
Mr. Mayes stated that it would cost him about $24,000.00 just to pave a por-
tion of the roads and that he could not afford to develop the subdivision if he
was going to have to put up that kind of money at the start He stated that if
he could first sell off some of the lots and wait a reasonable length of time
(perhaps one year) before being required to pave the roads that it would put him
in a much better position.

Bill Kisor commented that the City and County had not been requiring paving
of interior subdivisionroads in the planning area which were small and contained
only a few lots. He noted, however, that this subdivision was quite large consist-
ing of about 17 large lots of 11 to 2 acres each.
Discussion ensued concerning the comments made at the Plat Review Committee
meeting. Chairman Newhouse stated that it appeared that all such requirements
had been satisfied (the roads having been renamed and lots redesigned to conform
to minimum size, etc.), other than the question concerning hard surfacing of the
interior roads.
Mr. Blew noted that the new layout of the lots now brought all lots up to
the minimum 11 acres for lots without city sewer services if you took into account
that the acreages were computed including the land to the centerline of the roadway
easements. He noted that the County will not take rights-of-way for roads, only
easements, and that they do this in order to be able to assess the entire County
for tax purposes.
Mr. Mayes stated that at this time he had his roads ready for gravelling
since the base material was there naturally and all he now wanted to do was add
about 4" of creek gravel thereto. Mr. Blew stated that all the planning area
subdivisions that he has been connected with in the past have had to have road-
ways approved by the County only. He noted that the County had not been requir-
ing hardsurfacing of subdivisions not adjacent to the City Limits or not adjacent
to paved county roads.
After much discussion concerning possible paving of the roadways, Bill
Kisor stated that he would like to see this item tabled until after the discus-
sion on off-site improvements scheduled for the Planning Commission meeting dur-
ing the next hour. He stated that something at that discussion might come up
which would change his mind about whether to require paving of the roads. Other-
wise, he said that if the petitioner wanted to go ahead and have this Committee
act on his request that he could not vote for anything except hard surface paving
at this time. Mr. Mayes stated that he would be agreeable to having his re-
quest tabled.
Bill Kisor moved to table the item. Beth Crocker seconded the motion, which
passed unanimously (3-0).
There being no further business to come before the meeting, said meeting
adjourned at 5:08 o'clock P.M.
