MINUTES OF A SUBDIVISION COMMITTEE MEETING
A meeting of the Subdivision Committee of the City Planning Commission was
held on Monday, April 9, 1979, at 4:30 o'clock P.M. in the Board of Directors
Room, City Administration Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Keith Newhouse, Elizabeth Crocker, Newton Hailey
and Bill Kisor.
MEMBERS ABSENT: None.
OTHERS PRESENT: Bobbie Jones, Larry Wood, Gail Biswell, Bob Crafton and other
unidentified members of the audience.
Chairman Newhouse called the meeting to order.
The minutes of the previous meeting of March 26, MINUTES
1979, were approved as mailed.
Chairman Newhouse noted that the only item for HERITAGE EAST
consideration was a request by Charm Homes, Inc. for Right -of -Way Request
approval to construct a 31 ft. back -of -curb to back- N. of Industrial Park
of -curb street within an existing 40 ft. right-of-
way which will lie between the NE tomer of Heritage
East subdivision and Highway 16 By -Pass. Bob Crafton,
engineer, was present to represent.
Mr. Newhouse acknowledged a note from Mrs. Jones which stated that the City
Attorney has obtained an executed deed exchanging a 10 ft..strip of land owned
by Homer McBroom lying between Fairlane Street's right-of-way and the Heritage
East subdivision for a 10 ft. strip of land owned by the City which lies within
Homer McBroom's property.
Mr. Crafton noted that a problem still unresolved was that of whether Mr.
Bishop (President of Charm Homes, Inc.) would be allowed to build Fairlane
Street from Emily Drive to Highway 16 By -Pass (a contingency of the approval of
the preliminary plat of Heritage East) on only a 40 ft. right-of-way since the
City does not own the full 50 ft. right-of-way which it had supposed it owned
for a distance of 120 feet. A SO ft. right-of-way is available for the remain-
ing distance that Fairlane is to be constructed.
Mr. Crafton stated that it would be possible to build a regular width street
(31 ft. back -of -curb to back -of -curb) within the 40 ft. right-of-way and still
get the necessary utilities (gas and water only) placed in the 41 ft. remaining
on each side of the pavement without any job in the pavement or without anyone
even noticing the fact that a full 50 ft. was not present.
After further discussion, Bill Kisor and Newton Hailey stated that they
did not see any problem with the smaller than normal right-of-way as long as
the full -width street and necessary utilities could be built in place. Newton
Hailey moved to approve the request. Bill Kisor seconded the motion, which
passed unanimously (4-0).
There being no further business to come before the meeting, said meeting
adjourned at 4:45 o'clock P.M.
