MINUTES OF A SUBDIVISION COMMITTEE MEETING
A meeting of the Subdivision Committee of the City Planning Commission
was held on Monday, October 30, 1978, at 3:30 P.M., in the Board of Directors
Room, City Administration Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Ernest Jacks, Bill Kisor, Newton Hailey, Keith
Newhouse and Larry Wood.
MEMBERS ABSENT: None.
OTHERS PRESENT: Bobbie Jones, Gail Biswell, Bill Graue, Mildred Graue,
Ervan Wimberly, Kent Clement, Bob Reagan, Gerald Jones,
Ann Jones, and other unidentified members of the audience.
Chairman Jacks called the meeting to order.
Keith Newhouse made a motion to approve
the minutes of the regular meeting of October 9,
1978, and the minutes of the special meeting of
October 24, 1978. Bill Kisor seconded the
motion, which passed unanimously

The first item for discussion was the re- SUNSET WOODS
quest for one building permit prior to filing Planned Unit Development
the final plat for Sunset Woods, Planned Unit Building Permit
Development, located West of Sunset Avenue,
North of terminal point of Cedarwood, Lewis,
and Fowler Avenues, East of terminal point of
Berry Street, and South of Eva; Sugg -Bowen
Enterprises, Inc., Developer. Property is zoned
R-1, Low Density Residential District. No one
was present to represent.
Bobbie Jones explained that this request had been brought before the
Plat Review Committee and that all the utilities were not in at this time.
Chairman Jacks asked if the streets and utilities were roughed in and
Bobbie Jones said she thought they were.
Larry Wood said that all the curbs and gutters were in.
Ernest Jacks asked Bobbie Jones to explain the pros and cons of allowing
the building permit and Bobbie explained that the zoning ordinance states
that before a building permit can be issued for any phase of a Planned Unit
Development, that they have to show the plan for that as approved and that
no division of the property can be made without compliance with the subdivi-
sion regulations. She said that in the past they have allowed issuance of
such permits, with the understanding that the plat must be filed before any
house could be occupied or before any transfer of ownership could be made.
Bobbie said that since this is a proposal for a single family house and that
since it more than meets the setbacks, she didn't feel there were any problems.
Keith Newhouse asked if the numbering of some of the lots had been changed.
He said that he had noticed that lot 51 was now lot 49 and wondered which was
correct.

Bobbie Jones said that lot 49 is correct and Ernest Jacks commented that
the final plat would straighten all the numbering out and said that he didn't
feel this was a problem.
Bill Kisor made.a motion that the building permit be permitted to be
issued, with the requirement that no occupancy be allowed until the final
plat has been filed.
Newton Hailey seconded the motion, which passed unanimously.
The next item for discussion was the ap-
proval of the plat of Mildred Lee Estates,
Phase II, located South of Highway 16 West off
the end of Michael Cole Drive (outside city),
Bill and Mildred Graue, owners. Bill and
Mildred Graue were present to represent.
Bobbie Jones explained that this was a five (5) acre tract located out-
side the city on which 5 duplexes were constructed. She further explained
that Mr. P, Mrs. Graue now wish to divide the development into five 1 -acre
tracts each so that they may be sold separate, and that since each tract will
be less than 11 acres each, the Board of Directors will have to vary the lot
size. She said that the Subdivision Committee can send this to the Board of
Directors with or without a recommendation.
Mr. Jacks said that before any approval could be made that he felt they
needed to look into what the Plat Review Committee had suggested. He asked
Bobbie Jones if the plat review comments had been met, such as, has the plat
been amended to show the adjoining subdivision, to show the easements dimen-
sions on the north and west sides, the dimensions of the east and west side
lots, the cul-de-sac, etc.
Bobbie Jones said that some of these things still need to be done, such
as she would like the engineer to add the lot numbers, and some of the ease-
ment dimensions, such as the easement on the west side.
Bill Graue commented that Mr. Blew was to have added all the easements.
Ernest Jacks said that the tract was 22 miles outside the city and that,
this should be shown on the plat. He asked Mr. Graue if he had the signatures
of the adjoining property owners and Mr. Graue said he had only part of them
and that when he got them all he would bring them in.
Mr. Jacks said that the subdivision committee couldn't act without hav-
ing the signatures. He said they had tried to do this in the past and that
it just didn't work. Mr. Jacks also noted that there was no date on the plat
and that it didn't show the existing utilities.
Mr. Graue again said that he would bring the property owners signatures
in the next day, if that would help them make their decision. Mr. Jacks again
stated that the committee simply couldn't approve anything without the signatures.
Mr. Jacks then said that he and Mr. Kisor were confused about the lots.
He asked why the plat showed the street cutting the lots in two and wondered
if there really weren't 9 lots, not 5.
Mr. Graue explained that there were only 5 lots and that the street
divided each lot into two parts, but that the lots would be sold as only one
unit, although they were indeed divided by Michael Cole Drive. Keith Newhouse

noted that this was a strange arrangement and Mr. Graue said that the county
had required a street through the tract.
Mr. Jacks asked if the septic tanks meet regulations and Mr. Graue said
they did, that they were 40' from the street. Mr. Jacks wondered if the
houses were on city water and if perc tests were made before they were built.
Mr. Graue said they were and that both the county and city had approved.
Mr. Hailey asked if the septic tanks were uphill from the houses as the
contours showed, and Mr. Graue said they were not, that a dozer had levelled
the lots before the tanks were put in.
Mr Jacks said that according to the committee's policy, they could not
approve the plat without the adjoining property owners' signatures, and even
without them, the other problems with the plat bothered him more.
Bill Kisor made a motion to send this request on to the Planning Comis-
sion without a recommendation. Keith Newhouse seconded the motion, which
passed unanimously.
The next item for discussion was the
approval of the final plat of West Wind
Subdivision, a Planned Unit Development,
Phase II, located North of Township Road
and South of Sheryl Avenue; Dr. Bob Brandon
and Jim Younkin, Owners. Property zoned R-1,
Low Density Residential District. Ervan
Wimberly was present to represent.
Ernest Jacks asked Bobbie Jones if all the requirements of the Plat Re-
view Committee on its review of the plat had been met. She said that most of
them had been, but that the dimensions of the utility easements between lots
20-21-22 and 23=25 were not shown, that lot 14A should be dimensioned down at
the street, as well as lot 17A. Ervan Wimberly said that the easements were
25' and that the lots named also had 25' frontage on the private road
Ernest Jacks commented that the ordinance permits only 1 tandem lot and
that the plat showed two. Larry Wood said he thought that the committee could
approve the plat, since he didn't feel that the tandem lot ordinance applied
to this plat, but that it was under the PUD ordinance. He said since they
are using a private road, ALL the lots are essentially tandem lots.
Ernest Jacks commented that if the committee took Larry Wood's opinion
that the tandem lot ordinance did not apply, that they could approve the plat,
subject to the Plat Review continents (showing the 25' dimensions, etc.) and
subject to PUD ordinances.
Bobbie Jones asked Ervan Wimberly if all the improvements were in, and
he said that all of them were, except for the ones she had added on her Plat
Review comments. The "as builts" are not submitted. She said a contract would
be needed to insure completion of the improvements.
Bill Kisor made a motion to approve the plat subject to the Plat Review
comments, subject to 25' frontage for each tandem lot driveway and subject to
a requirement that a contract with the developer be executed covering the
improvements not yet completed.
Newton Hailey seconded the motion, which passed unanimously.

The next item for consideration was the TROY PARNELL
request for a lot split by Troy Parnell, Lot Split
property being located South of Highway 62,
West of Hollywood Avenue, and East of Highway 71
By -Pass, zoned C-2, Thoroughfare Commercial
District. This was brought to the Subdivision
Committee since Sec. 18-13, Fayetteville Code
of Ordinances, requires Planning Commission ap-
proval of any "development" of property abutting
Highway 71 By -Pass, a controlled access highway.
Kent Clement was present to represent.
Ernest Jacks commented that he would be happy to approve this lot split,
on the condition that a contract between the city and developer be executed
to insure that the developer (at its expense) would provide a service road
for the property whenever development begins.
Bill Kisor made a motion that the lot split be approved, subject to execu-
tion of a contract with the developer to build the service road (at the
developer's expense) upon the city's call Keith Newhouse seconded the mo-
tion, which passed unanimously.
The next item for discussion was the PINEWOODS SUBDIVISION
approval of the final plat of Pinewoods Sub- Final Plat
division, said subdivision being located on
the West side .of Azalea Terrace (street) be-
tween Old Wire Road and Azalea Terrace Subdi-
vision, Bob Reagan, Developer. Property is
zoned R-1, Low Density Residential District.
Bob Reagan was present to represent.
Bobbie Jones commented that the water and sewer improvements were under
construction, but not completed.
Bill Kisor commented that, according to the Plat Review comments, the
note on the plat referring to sidewalk construction should be changed to read
that "sidewalk's will all be built at one time and that no occupancy of any
building will be allowed until completion of the sidewalks."
Bobbie Jones said that it would be the developer's responsibility to set
the grade -for the .sidewalks, not the individual property owners.
Afterfurther discussion about sidewalk construction, Bill Kisor made
a motion to approve the final plat with the contingencies that (1) the note
on the plat be changed to read that "sidewalks will be completed in full prior
to occupancy of any building", and (2) that all other Plat Review comments be
met. Keith Newhouse seconded the motion, which passed unanimously.
The last item for consideration was
the approval of the Large Scale Development
plan for Whitfield Motor Company, to be lo-
cated on North College Avenue North of Lewis
Ford. Property is zoned C-2, Thoroughfare

Commercial District (approximately 1 acre being zoned A-1 and covered under
Rezoning Petition R78-26). Gerald and Ann Jones were present to represent.
Ernest Jacks questioned whether the Plat Review comments had all been
met,
Gerald Jones commented that they already had a contract with the gas
company to connect with the high pressure line in their area and that they
had given 25' utility easements along the North, South and East property
lines.
Bobbie Jones commented that the sign shown on the plat was too large
and Gerald Jones asked if a variance for the sign might be considered.
Ernest Jacks responded that the City Board of Directors administered the
sign ordinance and that a variance petition would have to be taken to them.
Bobbie Jones noted that the plan conformed to all requirements, except
for the zoning of the 11 acre tract and the sign. She also reminded Mr. Jones
that an "as built" plan should be submitted upon completion of the develop-
ment, showing where all utility lines existed.
Newton Hailey made a motion to approve the plan subject to (1) Plat
Review comments, (2) passage of the rezoning of the 1 acre tract, and (3)
approval by the City Board of a sign variance. Keith Newhouse seconded the
motion, which passed unanimously.
