HomeMy WebLinkAbout1978-04-10 - MinutesMINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the City Planning Commission was held on Monday, April210, 1978, at 4:15 P. M., in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Chairman Ernest Jacks, Keith Newhouse, Bill Kisor, Newton Hailey, Larry Wood. MEMBERS ABSENT: OTHERS PRESENT: None. 'Bobbie Jones, Angie Medlock, Ervan Wimberly, Neal Albright, Leo Peel, Jerry Sweetser, Robert Windham, L. M. Kirby, Bill Schwab, Bill Meadows. Chairman Ernest Jacks called the meeting to order. Mr. Jacks noted that the adjournment time should be changetto read 4:55. Newton Hailey made a motion to approve the minutes of the March 27, 1978 Subdivision Committee with the change in the time of adjournment. Bill Kisor seconded the motion, which passed unanimously. The first item for discussion was the approval of the large scale development plan for Wet Willie Water Slide to be located east of College Avenue and north of''Township Road, Phil Stocker, developer. MINUTES WET WILLIE WATER SLIDE Large Scale Development East of College Ave. Ervan Wimberly was present to represent the developer: Bill Kisor made a motion to approve the large scale development Newton Hailey seconded the motion, which passed unanimously. The second:'item for consideration was the approval of the preliminary plat of Grandview Place located East of Highway 71 South and South of West 24th Street; Leo Peel, Developer. Leo Peel.and Neal Albright were present to represent. Mr. Jacks questioned if this is both a commercial and residential development and Mr. Peel said part of the property is 'commercial and part is R-2, Medium Density Residential. Neal Albright said they would need a waiver on the scale to allow 1" = 50 ft. Mr. Jacks asked if the adjoining property owners had been notified and Neal Albright said they have been notified but the developer does not yet have anything in writing on this. Mr. Jacks explained that the Subdivision Committee has a new policy to not take any action on a subdivision if the_ developer does not have proof of notification of the adjoining property owners. Mr. Jacks noted that they heed.to add street lights at intersections and 300 feet intervals in between. The Subdivision Committee decided not to take any action on this until the developer has notified the adjoining property owners. Next was approval of the revised preliminary plat of Sequoyah Woods, Tract C, located north of Cherokee Drive and West of Starr Drive, Jerry D. Sweetser, developer. plan as submitted. A • • • Subdivision Committee Meeting April 10, 1978 -2- Jerry Sweetser said they.have preliminary approval on Tract C, but have added some additional property to this. He said they have already started developing the portion of Tract C which has been approved. Bobbie Jones stated that the Planning Commission has approved a preliminary and final plat on Phase I and a preliminary on Phase 2 pf Sequoyah Woods. Jerry Sweetser explained that they are seeking to bring some additional land into Tract C. He said they had talked about this at the last meeting and asked the Planning Commission if they would be favorable to his adding some property to Tract C. He said that since that time, he has purchased the Phillips property to the north and .is asking for permission to bring this into the Planned Unit Development. Chairman Jacks asked Bobbie Jones if she has checked this since the revision to see if the developer is still within -the R-1 density. Robert Windham said the R-1 density will allow up to 7 units per acre and they are asking for 4.75 overall units per acre. Mr. Jacks questioned if utility easements have been given and Mr. Sweetser explained that they are not going to give easements until they have obtained approval to add this to their Planned Unit Development. Mr. Jacks questioned if the original developer, Multi -Properties, Inc., was required to develop Starr Road. Bobbie Jones explained that the original developer gave a certain amount of money to the County to use as they saw fit in the upgrading of Starr Road. Mr. Jacks said Bobbie Jones is questioning if the private drive connecting Cherokee Drive to Starr Road should be built to City standards. Mr. Sweetser said he felt this should be looked at as a private drive. He did not feel anyone would ever use this drive as a through street to get from Cherokee to Starr Drive. He did not feel this connecting private drive was the intent of the Planned Unit Development Ordinance . where it requires that a connecting through street be built to current City standards. Mr. L. M. Kirby said the property owners in the area are concerned with the extra traffic load which will be added to Starr Drive because of all the new developments in the area He noted that Starr Drive is not very wide, and this development would cause an additional heavy load for the street. Bobbie Jones questioned if the developer has given the additional right-of-way on Starr Road and and Robert Windham said they have given 8 feet additional right-of-way. Mr. Sweetser said they would give more 'right -df -way if they need to. Bill Schwab, president of the Sequoyah Woods Home Owner's Association was concerned that with this development, some of the green space in Phase II would be eliminated. He said the home owners in Sequoyah Woods were willing not to oppose this Planned Unit Development as long as they have the "green space" which was supposed to be a part of their buying homes in Sequoyah Woods. Mr. Schwab said they had talked with their attorney who felt that the best way to insure this would be forLthe Planning Commission to pass a resolution that nothing will be approved in Phase II unless it includes the "green area". Mr. Kirby asked if there is some type of city -county ordinance which determines the size of a road on which developments may take place. Mr. Jacks noted that Starr Road is the city limits line and the road is built to county standards. Mr. Kirby felt this is only the beginning of developments in that area. He felt the Planning Commission should take a look at the whole situation to see if there should be an east/west thoroughfare type road leading to Starr Drive further to the south. Mr. Jacks requested that Mr. Kirby bring this problem to the whole Planning Commission. Mr. Jacks questioned if the developer would need a waiver on thesprivate drive connecting the through streets. Mr. Kisor said he did not feel this private drive would be used as a through street. City Attorney McCord said he felt a waiver would be appropriate. $a • • Subdivision Committee Meeting April 10, 1978 Bill Kisor made a motion to recommend that the Planning Commission approve the revised preliminary plat of _ Tract C, and that they waive the requirements for the private drive connecting Starr Drive to Cherokee be built to City standards, and that the plat meet the comments of.the Plat Review Committee. Keith Newhouse seconded the motion, which passed unanimously. The last item for discussion was the approval of an amendment to a conditional use request to add a racquetball court and an indoor tennis court for Summerhill Racquet Club, located on Summerhill Drive, north of Stubblefield Road. William Meadows was present to represent. Bill Kisor made a motion to recommend approval of use. Bobbie Jones noted that the developer will need to adhere to the setbacks from the residential property which were waived previously --50 foot setback on the east and a 65 foot setback on the north. Keith Newhouse seconded Mr. Kisor's motion, which passed unanimously.
