M., in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Ernest Jacks, Larry Wood, Keith Newhouse, Bill Kisor, Newton Hailey. MEMBERS ABSENT: None. OTHERS PRESENT: Bobbie Jones, Angie Medlock, Carter Schell, Beth Crocker, Wade Bishop, Larry Smith, Attorney Charles Medearis, Homer McBroom, Attorney Marshall Carlisle. Chairman Ernest Jacks called the meeting to order. The minutes of the March 13, 1978 Subdivision Committee meeting MINUTES were approved as mailed. The first item for consideration was the LARGE SCALE DEVELOPMENT approval of the large scale development plan Dr. Thermon R. Crocker for an office building to be located South of South of Zion Road Zion Road; Dr. Thermon R. Crocker, Developer. Larry Smith and Betk.Crocker were present to represent. Chairman Jacks asked if the street problem has been worked out and Bobbie Jones said it had been worked out satisfactorily with the City Manager and the developer. Mr.. Jacks questioned if this building would be on a septic tank and Larry Smith said "yes". Bobbie Jones noted that the septic tank permit will have to be obtained before the building permit may be issued. Mr..Jacks asked if the adjoining property owners had been notified and Bobbie Jones said "yes". Bill Kisor made a motion to approve the large scale development with the stipulation that it meet the requirements of the Plat Review Committee. Keith Newhouse seconded the motion, which passed unanimously. The second item for consideration was a review REGENCY EAST of a sketch prior to submission of the preliminary W. of Happy Hollow Road plat of Regency East Subdivision located West of Concept Sketch Happy Hollow Road, North of the Industrial Park Property and east of Curtis Avenue and-Southmont Apartments; Wade Bishop, developer. Mr. Jacks explained that there is a dedicated street right of way at Mr. Bishop's north property line which has not been built yet. He said that Mr. Bishop would like to move the street to the south far enough to have one lot between the street and the property to the north. Mr. Bishop explained that he would not care to build the street where it is, if he could get cooperation from the property owners: to the north. Bobbie Jones said the Plat Review members did not have any objection to the sketch plan presented which would allow the street to jog to the south once it got into Mr. Bishop's property and continue to the west property line somewhere along the north boundary of Southmont Apartments. This would give the developer lots on both sides of the street for a little more than half the distance across the property. Charlie Medearis, 36 E. Center, was present representing Homer McBroom, who owns property to the north of Mr. Bishop. Mr. Medearis stated that Mr. McBroom had given this right of way several years ago. He felt if the street were now moved to the south, it would make Mr. McBroom's property less valuable. Mr. Medearis stated that there is a church group who is interested in buying some of Mr. McBroom's property and they will need this street for access. ng • • Subdivision Committee Meeting March 27, 1978 -2- Mr. Jacks stated that the policy in the past is that the City will work with developers on street problems. He felt the developer would need to pay for his proportionate share of the cost of building the street. Bobbie Jones stated that the access out to Happy Hollow road is vital to Mr. Bishop, because he needs an access to the east. Wade Bishop stated that if the adjoining property owners. would pay their proportionate share of the cost of constructing the street, he would not care to leave the right-of- way where it is. Homer McBroom stated that if the street right of way is moved, Mr. Bishop would be blocking Sherman Avenue. He also stated that he did not think it is fair for the street right of way to be taken back after being 'dedicated to the City. J. W. Depew, pastor of the Evangelistic Church was present representingthe church group who is interested in' buying a part of Mr. McBroom's property. He stated that the church would have about 300 feet of street frontage, and indicated ,, he would be willing to help on the cost of the street. Charlie Medearis questioned the approximate cost of building the street. Wade Bishop felt it would be about $40 per foot with curb and gutter and street, and the property may also need some drainage, which would cost more. Mr.McBroom stated that he and the church would each have about 240 feet of frontage. Keith Newhouse made a motion to recommend to the Planning Commission that they not close the right of way already dedicated on Fairlane Street. Newton Hailey seconded the motion, which passed unanimously. The last item for discussion was the amended final VILLA NORTH plat of Villa North, Holly -Ogden Enterprises, Amended Final Plat Developer. The.purpose of the amendment is to delete the requirement to develop recreation area. Mobile home parks require 8% of the gross park area to be developed as recreation space. Subdivisions do not require recreation space. Attorney Marshall Carlisle was present representing the developers. Mr. Carlisle explained that the original plat showed the designated recreational areas. He stated that the plat has been amended to eliminate the recreation...space since it will not be used as a mobile home park. Mr. Jacks questioned if this had been back through Plat Review and Bobbie Jones said "no". She felt the only thing the utility companies may be interested in is the number of units. Mr. Carlisle said he had gone to the gas company, SWEPCP, and the water department and got the easements straightened out. He said the easements shown on the plat are satisfactory to the utility companies. Mr. Jacks questioned if there would be duplexes and Mr. Carlisle felt there would not be duplexes or apartments on the lots. Mr. Carlisle said there is an agreement with the City that no mobile homes will be allowed in the subdivision. Mr. Carlisle said they plan to have everyone who has been deeded a lot up to the present time to execute the final plat before it is recorded. At that time, they will amend the covenants again to reflect the book and=page number of the final plat so there won't be any question about the change. Keith Newhouse made a motion to. accept the amended final plat::.df Villa North Subdivi- sion. Bobbie Jones noted that she had issued permits for duplexes and one triplex already iii the subdivision. Bill Kisor seconded Mr. Newhouses's motion, which passed unanimously. • The meeting adjourned at 6:15 P. M.
