HomeMy WebLinkAbout1977-12-12 - Minutes• • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee of the City Planning Commission was held on Monday, December 12, 1977, at 3:30 P. M., in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: Ernest Jacks, Keith Newhouse, Bill Kisor, Jack Ray. MEMBERS ABSENT: Larry Wood. OTHERS PRESENT: Bobbie Jones, Angie Medlock, Jim Lindsey, Jerry Sweetser, Helen Edmiston, Ervan Wimberly, Skip Holland, Jim McCord, Peg Anderson, Beth Crocker, Rick Cowdrey, Ray McElhaney, and other unidentified persons. Chairman Ernest Jacks called the meeting to order. The first item for discussion was green space GREEN SPACE in subdivisions. Mr. Jacks asked Skip Holland IN SUBDIVISIONS if he was ready to present the Master Parks Plan which would divide the city into park districts. Mr. Holland said the report was not ready yet and should be ready by January 9. Mr. Jacks said they would have to incorporate this into the Community Facilities Plan. Jim McCord said the Master Park Plan should deal only with recreational park areas and green belts or natural areas should be dealt with under the Zoning Ordinance. Mr. Jacks said if a developer wishes to develop in an area which is set out for a park, he will need to dedicate the land for a park. If he does not have enough land, he may give cash in lieu of dedication. If no park is set out for that immediate area, he would need to give cash in lieu of dedication to be used to build a park in that district. There was some discussion about what would be a reasonable requirenent.and Mr. McCord noted that in a similar plan used in California, they required 2.5 acres dedication for 1,000 acres. This would be approximately .01 acre per family. Helen Edmiston felt this would be unfair to the original owner. She said the developers would not pay him as much for the land since the City has designated that area as a park. Jerry Sweetser felt the City should look into the need for additional parks. He noted that a lot of the parks in the area need to be better maintained. Jerry Sweetser said he did not agree at all with the manner of collecting money for a park. He said he is all for parks, but does not feel the responsibility should be put on the developer. Jim Lindsey pointed out that the City is forcing developers to move outside the City. He said it would be more financially feasible for them to develop outside the City where development costs are not as great. He noted that developers already have to pay for off-site improvements --sidewalks, streets,curb and gutter, street lights, the cost of bringing abutting streets up to City standards and other things. He felt if parks were the only thing, it would not be an issue. Keith Newhouse arrived at 4:00 P. M. Ervan Wimberly asked if a developer could put a park in his development and receive credit for his park requirements and Jim McCord said the.Planning Commission would have the discretion of whether or not to accept the park as meeting his requirements. He said the Planning Commission could give you up to 100% credit for the park. Jim Lindsey felt if the City took more than 3% of a person's land, he would have to be compensated for that land. Jim McCord said if the City wanted to use more of a person's land, they would have to condemn it and pay the person for the land. Jim Lindsey pointed out that it would help if the land immediately adjacent could be allowed to rezone to something other than single-family residential. • Subdivision Committee Meeting December 12, 1977 -2- Jack Ray agreed that it would be a burden on the developers. He pointed out that Fayetteville does not even have adequate streets or sewage facilities. Jim Lindsey felt there should be a millage tax on all property owners. All developers present agreed that it is not fair to force this on the developers. They felt the City would be forcing them to develop outside the City where the costs are not as high. They also felt it would be unfair because it would be a tax on only new developments which would benefit the entire City. This discussion was continued until January 9, 1978. Bill Kisor made a motion to approve the minutes of the November 28, 1977 meeting as mailed. Keith Newhouse seconded the motion, which passed unanimously. MINUTES Next was the approval of a large scale development GLEN OLDHAM plan for Glen Oldham located on Highway 62 West, Large Scale Development west of Highway 71 Bypass. Highway 62 West Glen Oldham and Ray McElhaney were present to represent. Bobbie Jones said there is a note on the plat that the driveway approaches will be concrete and said she would also like to have it noted that the parking area will be paved. Keith Newhouse made a motion to approve this large scale development plan with two contingencies: 1) the 40 foot right-of-way being dedicated from the center- line of Highway 62 West and 2) a note on the plat that the parking area will be paved. Jack Ray seconded the motion, which passed unanimously. The fourth item was approval of the final plat GREENBRIAR of Greenbriar Addition, a Planned Unit Develop- Final Plat ment and a replat of 19th Green, located north N. of Sweetbriar Drive of Sweetbriar Drive, Edmiston-Prewitt, developer. Helen Edmiston explained that they had changed the lot lines to conform with the center of the buildings. Keith Newhouse made a motion to approve the final plat, seconded by Bill Kisor which passed unanimously. The last item was the approval of the final FOX HUNTERS ADDITION plat -of Fox Hunters Addition, located on the Final Plat south side of Fox Hunters Road, Alfred Fuchs, Fox Hunters Road developer. Rick Cowdrey was present to represent. Mr. Jacks noted that Clayton Powell said the street names are confusing. Rick Cowdrey said they would have no objections to changing the name. Jack Ray made a motion to approve the final plat as submitted. Bill Kisor seconded the motion, which passed unanimously. The meeting adjourned at 4:40 P. M.
