A meeting of the Subdivision Committee of the Fayetteville Planning Commission
was held at 3:30 P. M., on Monday, October 10, 1977, in the Board of Directors
Room, City Administration Building, Fayetteville, Arkansas.
MEMBERS PRESENT: Ernest Jacks, Bill Kisor, Keith Newhouse, Jack Ray, Larry Wood.
MEMBERS ABSENT: None.
OTHERS PRESENT:
Bobbie Jones, Angie Medlock, Ervan Wimberly, Claud Prewitt, Ann:Sugg,
Harold Wescott, Jim Lindsey, Wade Bishop, Jerry Sweetser, Neal
Albright, Larry Smith, and other unidentified persons.
Chairman Ernest Jacks called the meeting to order.
Bill Kisor made a motion to approve the minutes of the
September 26, 1977 Subdivision Committee meeting.
Jack Ray seconded the motion, which passed unanimously.
The first item for discussion was the
approval of the Preliminary Plat of Sunset
Woods Subdivision located south of Wedington
Drive and west of Sunset Avenue; Sugg -Bowen

Enterprises, developer. (This item was tabled at the September 26th meeting in order
to notify adjoining property owners.)
Ervan Wimberly, and Dr. F, Mrs. Sugg were present to represent.
John Swan, 1115 Oak Drive said he had called several adjacent property owners and
it appeared none of them had been notified that this was coming back to the
Subdivision Committee. He said they had talked to approximately six people living
either on Sunset, North, Valley View or Oak Drive.
Herman Schwartz, 1110 Oak Drive, said he had not been notified.
Betty Wallace, 1627 Wedington, said she had not been notified.
Mr. Swan said they do not want more than single-family dwellings in the area.
Ervan Wimberly explained that they are not exceeding 7 dwelling units per acre
which is allowed in R-1.
John Webb, 800 Cedarwood, said he had been notified. He said he was concerned that
there would be multiple -family units in there. He was also concerned as to what
R-1 density means. Chairman Jacks explained the Planned Unit Development Ordinance
to him and the R-1 density which is allowed.
Mr. J. G. Gleason, 1139 Sunset Avenue, asked if North Street would be opened onto
Sunset. Mr. Jacks explained that the developer is planning to petition to close
North Street.
Jan McMullen, 916 Eva, said she had been notified. She said she disagrees with the
multiple -family dwellings being allowed. She said a lot of people on Eva would not
be 100 feet from the proposed triplexes. She was concerned about Lots 26, 27, and
28. Ervan Wimberly said these would have to be duplexes or single-family. Jan
McMullen asked if they would be putting in nice duplexes and homes and Claud Prewitt
said they would be high-priced lots with nice duplexes.
Betty Wallace said the density seems much deeper than it should be.
Mr. Schwartz said he would prefer to see the streets as through streets.
City Attorney McCord said the history of the zoning ordinance is that duplexes
were a use by right in R-1 when the Planned Unit Development Ordinance was first
drafted. The Ordinance has been amended to provide that duplexes are a conditional
use. Mr. McCord said a literal meaning would be that the 100 foot setback does
apply. He said he doesn't feel that was the intent of the Ordinance. He said
Larry Wood will be bringing in a new recommendation and this would clear up the
questions on Planned Unit Developments. Jim McCord said a court may rule that

a literal meaning would mean a duplex would have to be set back 100 feet from any
other R-1 district.
Jim Lindsey said he was of the impression that there could be single-family attached
dwellings in a Planned Unit Development. .He said Dr. and Mrs. Sugg are planning to
live in the PUD. He said the idea of putting 160 as density on the plat was to put
the maximum density allowed.
Claud Prewitt explained what they are planning to do. He said they would be
willing to cut the density to 114 units. He explained that they are within the
•framework of the PUD ordinance by proposing 161 units.
The Subdivision Committee decided to pass this on the Planning Commission without
a recommendation.
Next was the approval of the preliminary plat
of Westwind Subdivision located west of
Township Road between Old Wire Road and
WESTWIND SUBDIVISION
North of Township

College Avenue; Edmiston-Prewitt Realtors,
developer. (This item was tabled at the September 26 meeting in order to notify
adjoining property owners).
Ervan Wimberly and Claud Prewitt were present to represent.
Ervan Wimberly pointed out what they are proposing for the whole project. He
showed the different phases of the proposal. He said they will have two tandem
lots on one phase.
The Subdivision Committee decided to send this on to the Planning Commission without
a recommendation.
The fourth item for discussion was the
approval of the preliminary plat of Regency
North Subdivision located West of Highway 71
REGENCY NORTH
W of Hwy 71 F, NE of Appleby Road
Preliminary Plat
North and Northeast of Appleby Road, Wade Bishop, developer.
Wade Bishop and Harold Wescott, Crafton and Tull, were present to represent.
Wade Bishop said they had brought this to Plat Review as a concept sketch and each
utility company had said where they would need easements.
Bobbie Jones said they had informed the utility companies which lots would have
multiple units on them.
Wade Bishop said he is building the 2511 foot street and putting'in curb and gutter.
He said the City is putting in 24 feet wide pavement and he is putting in 11 feet
pavement and curb and gutter. He said when the land on the other side of the
street is developed, the developer will have to build that side of the street to
City standards. Mr. Bishop said he is paying 90% of the expense to have his part
of the street paved. He said he is getting very little help from other property
owners.
Bobbie Jones said there is a question on whether or not to require any improvement
to Appleby Road on the west side.
Mr. Jacks said they would take this on to the Planning Commission to see what they
want to require on sidewalks and street lights.
Bobbie Jones noted that one of these lots is a tandem lot(Lot 7, Block 3) and will
need Planning Commission approval.
Next was the revised Preliminary Plat HYLAND PARK, PHASES IV, V, $ VI
of Phases IV, V, and VI of Hyland Park Revised Preliminary Plat
located East of Crossover Road, Jim Jim Lindsey
Lindsey, Developer.
Jim Lindsey and Harold Wescott were present to represent.
Jim Lindsey said he would provide Ozarks Electric with an easement running from
Phase V to Phase IV.

Chairman Jacks said they need a waiver to extend Cliffside Drive past the maximum
length of a dead-end street. Mr. Jacks noted that the lots on the cul-de-sac
must have 70 feet width at the setback line. Jim Lindsey said they would adjust
the lot lines on his lots or have a greater setback and put it in the protective
covenants. Bobbie Jones said she would not be able to enforce a larger setback
unless it is'imposed by the Board of Directors as a condition for granting a
waiver in lot frontage. It would be up to the developer to enforce a larger
setback. The Ordinance requires 70 feet setback. at the 25 foot setback line.
Ernest Jacks acknowledged a letter from Jim Lindsey asking for a waiver of the
sidewalk requirements. Jim Lindsey said he may propose to build some type of
pedestrian pathways with crossties and SB -2 base. Bobbie Jones said she had
talked with the City Attorney and he said the Board of Directors would have to
be the ones to totally waive the sidewalk requirements. Mr. Jacks questioned if
the Planning Commission could approve pedestrian pathways in lieu of sidewalks.
Bobbie Jones said they may waive the design standards and location, so they would
be able to do this.
Larry Wood had suggested that the developer extend the cul-de-sac on Cliffside
Drive through Lot 18 with the possibility of someday connecting with Joe Fred
Starr Road. Jim Lindsey said he did not want_to do this. He said he had
provided for a connecting street through to the south. Mr. Lindsey noted that
there is 80 acres between Hyland Park and Joe Fred Starr Road. He said there is
a series of small 10 -acre tracts. Larry Wood said it appears it would be easier
to connect to the east than to the south. Jim Lindsey said he would not object
to'giving the light -of -way for the street but would not want to build the street.
This was taken on to the Planning Commission without a recommendation.
Next was an approval of the final plat AZALEA TERRACE
of Azalea Terrace, a subdivision Final Plat
lying south of Old Wire Road and north Jerry Sweetser
of Brookside East Subdivision,
Jerry D. Sweetser, Developer.
This was taken on to the Planning Commission without a recommendation.
Next was a large scale development plan B F, W T.V.
for.B P, W T.V. located at 1895 South Large Scale Development
School Street, Julian Watts, developer. 1895 S. School
Larry Smith was present to represent.
Chairman Jacks said they need to show the parking as "paved" parking on the plat.
Bobbie Jones said the developer needed to notify the adjacent property owner to
the south (Virgil Webb), which he had done, but they had not received the return
receipt yet.
Ernest Jacks made a motion to approve the large scale development plan with showing
"paved parking" on the plat and no objections from the property owner to the south.
Bill Kisor seconded the motion, which passed unanimously.
The last item for consideration was a DR. E. M. SINGLETON
large scale development plan for Dr. E. M. Large Scale Development
Singleton, located at 2037 Green Acres Road. 2037 Green Acres Road
Larry Smith was present to represent Dr. Singleton.
The Subdivision. Oommittee.-discussed Plat Review comments about drainage problems
in this area. It was felt it would not accomplish much if Dr. Singleton were
required to install drainage, curb and gutter along his property if it were not
done all along the street.
Bobbie Jones explained that the Subdivision Committee does have the authority

to require participation in a street improvement district if one is ever formed.
Bill Kisor made a motion to approve with the developer adding a note on the
plat that the parking will be paved, and the owner will participate in an improve-
ment district for storm drainage and street, if one is ever formed; or at least
will not oppose the formation of a street improvement district.
Keith Newhouse seconded the motion.
No one was present in opposition.
The large scale development was approved unanimously.
The meeting was adjourned at 5:10 P. M.
