The Subdivision Committee of the Fayetteville
met on Monday, September 26, 1977, at 3:30 P.

MEMBERS PRESENT: Ernest Jacks, Jack Ray, Bill Kisor, Larry Wood.
MEMBERS ABSENT:

Ervan Wimberly, Helen Edmiston, Claude Prewitt, Ann Sugg, Steve
Krysowaty, Loris Stanton, Charles Presley, Sam Mathias, Jim Viziier,
Allan Beauchamp, Jerry Sweetser, Robert Windham, and other
unidentified persons.
Chairman Ernest Jacks called the meeting to order.
Bill Kisor made a motion to approve the:minutes of the
September 12, 1977 meeting. Jack Ray seconded the
,motion, which passed unanimously
The first item for consideration
was the approval of the preliminary
plat of Westwind Subdivision located
north of Township Road between Old Wire
Road and College Avenue; Edmiston-Prewitt
Realtors, Developer. This is a Planned Unit Development proposed to have private
roads.
Ervan Wimberly and Claude Prewitt were present to represent.
Mr. Jacks said they will need to show on the plat what kind of turn -around they are
proposing; they also need a waiver in the maximum length of a dead-end street.
The 25 -foot easement requested for Arkansas Western Gas is included in the 70 foot
strip designated for the private drive and utility easement. Mr. Jacks said they
would have to work with the telephone company on the easement they requested.
Mr Jacks said they would also need to add the stipulation that the trees are to
be kept trimmed by the Home Owner's Association for the sanitation trucks and fire
trucks; they will also need adjoining property owner's signatures.
There was some discussion about the possible extension of this street to tie
into Sheryl Avenue but Ervan Wimberly and Claude Prewitt felt they would not do this.
Ervan Wimberly said they may extend the drive another 300 to 400 feet or they may
leave it as is.
Bobbie Jones said she is still concerned about having a private drive. She said the
properties which are not shown in the Planned Unit Development would not:be able
to use this private drive for frontage to meet the City zoning regulations not to
get lot splits.
Ervan Wimberly felt all of the property owners on the east side would have other
frontage. The only one he was concerned about was Dr. Brandon.
Bill Kisor made a motion to approve the preliminary plat with the following
contingencies: 1) provision of a turn -around; 2) waive the maximum length of a
dead end private road from 1,000 to 1300 feet; 3) write into the protective
covenants that the trees will be kept trimmed by the Home Owner's Association
for sanitation service and fire trucks; 4) submit a copy of the protective covenants
to the Planning Office; 5) the property owner's association agree to build the
private road to City standards if it is ever connected to Sheryl Avenue; and 6)
obtain approval from the adjoining property owners (not just proof that they have
seen it).
Jack Ray seconded the motion, which was approved unanimously.

The second item for discussion was the approval
of the preliminary plat of Sunset Woods Subdivision
located south of Wedington Drive and west of Sunset
Avenue; Sugg -Bowen. Enterprises, Developer.
This is a Planned Unit Development proposed to
have private roads.
Ervan Wimberly and Ann Sugg were present to represent.
Ervan Wimberly explained that they would have to go back
to go through Planning Commission today.
Mr. Jacks said there will be an entry from Lewis Avenue. Ervan Wimberly said this entry
has already been deeded. Mr. Jacks questioned what the 20 foot gaps between dead-end
roads would be, and Ervan Wimberly said they would be pedestrian pathways.
Ervan Wimberly said the maximum density =possibility on all but four lots is duplexes,
triplexes and quadplexes. Mr. Jacks felt they should apply for a conditional use on the
property proposed for duplexes which is within 100 feet of the adjoining R-1 district.
Bobbie Jones noted that they may have some problems on Lots 26, 27 and 28. Those three
lots are shown for three units each but they are within 100 feet of other R-1 property.
Charlie Carnes, .741 North Lewis .Avenue, was concerned about the drainage. He was
satisfied with the drainage plan as shown to him. Mr. Carnes and Bill Bonner, 721.Cedarwood,
adjacent property owners, stated they had not been notified that this was coming back
to the Subdivision Committee. They had opposed the previous submittal.
Bill Kisor made a motion to table this in order for the Planning Office to notify other
adjacent property owners who had signed a petition in opposition. Jack Ray seconded the
motion, which passed unanimously.

Next was a letter from the developers of SUMMERHILL
Summerhill, a Planned Unit Development,
requesting an amendment to the plat as filed.
This would change the maximum residential living units from 60 to 90.
Ervan Wimberly was present to represent.
Ernest Jacks said they would be using the east 115 feet of Lot 1 which is presently shown
as a tennis club. Mr. Jacks said they would have a 100 foot setback from the east
property line if they put more than duplexes in. What they are proposing would increase
the maximum living units from 60 to 90.
Bill Kisor asked if any of the lots are sold and Claude Prewitt said they still own all
of the lots. He said there are approximatley six which have not closed yet and they
have explained to everyone that there may be multi -family density around the tennis
courts.
Bobbie Jones noted that there would be a problem in processing lot splits on a condo-
minium. She said she would only be able to approve three splits or they must file a
replat.
No one was present in opposition.
Jack Ray made a motion to approve the revision to the plat.
Bill Kisor seconded the motion, which passed unanimously.

approval of the large scale development
plan for apartments located West of Leverett
Street, between Lawson and Sycamore, Ralph
Freemen, Developer.

Mr. Jacks questioned if the 16 foot drive on the south of the two units
worked out with the fire department and Ervan Wimberly said it had.
Ervan Wimberly said they still need to have Storer Avenue closed.
Mr. Jacks said the 10 foot additional right of way on Leverett is shown. Mr.
said Mr. Wimberly needs to show Bobbie Jones the building height because this
affect the setbacks.

Mr. Jacks asked if Lot 6 still only has 30 feet of frontage.

Bobbie Jones said there may be some confusion about Brophy Avenue turning
Circle. She felt this may be confusing for the fire department and other
vehicles.

The seventh item for consideration was the approval of a
revision .to the final plat of Country Club Estates,
located northeast of Fayetteville Country Club;
The Stanton Company, Inc., developer. This would
eliminate the cul-de-sac and make tandem lots out of Lots 28 and 29.
Loris Stanton was present to represent.
Mr. Stanton said the Board of Directors was concerned about who would maintain the
property (right-of-way) if a cul-de-sac were not constructed, and a couple of the
members of the Board suggested he bring back this revision eliminating the cul-de-sac
Bill Kisor made a motion to approve the revision to the final plat. Jack Ray seconded
the motion, which passed unanimously.

Partnership, developer. The developer proposed to rechannel a drainage ditch and
add 10 more apartment units to the approved plan. Parking and setback regulations
would be met.
After some discussion, Bill Kisor made a motion that they approve the large scale
development plan with the approval of the Plat Review Committee. Jack Ray seconded
the motion, which passed unanimously.

was a revision to a large scale

of Old Wire Road and on the west side :of Crossover Road; Allan Beauchamp, developer.

Allan Beauchamp said he is asking to be able to put the tennis courts anywhere inside
the 50 foot boundary shown. Bill Kisor felt:the Planning Office should have notified
the adjoining property owners. Bobbie Jones explained that Mr. Beauchamp had not
furnished the Planning Office with the adjoining property owners and she had thought
Jerry Sweetser still owned the two adjoining lots in Sweetbriar so she had only notified
him
Bill Kisor made a motion to approve the change in conditional use based on obtaining
approval from the two adjoining property owners. He futher recommended that the
laP nning Commission waive the setback from R -zoned property (for non-residential use)
from 100 feet to 50 feet. Jack Ray seconded the motion, which passed unanimously.
This is to be put on the Planning Commission Agenda for October 10, 1977 with adjoining
property owners to be notified. Because it was now time for the Planning Commission
meeting to begin, the Subdivision Committee adjourned at 5:00 P.`M. leaving items
10 through 13 to be discussed by the full Planning Commission.
