MINUTES OF A SUBDIVISION COMMITTEE MEETING
The Subdivision Committee of the
Monday, August 29, 1977, in the Board
Building, Fayetteville, Arkansas.
City Planning Commission met at 1:30 P.M.,
of Directors Room, City Administration
MEMBERS PRESENT: Chairman Ernest Jacks, Bill Kisor, Keith Newhouse, Larry Wood.
MEMBERS ABSENT: Jack Ray.

Claude Prewitt, Ron Shelby, Ervan Wimberly,
Chairman Ernest Jacks called the meeting to order.
Keith Newhouse made a motion to approve the MINUTES
minutes of the. August 22, 1977 meeting.
Bill Kisor seconded the motion, which passed unanimously.
The first item was the approval of the pre-
liminary plat of -Mathias Subdivision located
South of Township Road and East of Juneway
Terrace; Mathias Real Estate Partnership,
developers.
Bob Battenfield was present to represent.
Mr. Battenfield said the 25 foot building setback and utility easement had been
designated. He said the sidewalk would be continued Co Township on the east side
of the street. Bobbie Jones asked if the Planning Commission would want to require
any off-site improvements on Township Road. She said Clayton Powell had suggested
that on Briarwood they come back to the southwest corner of Briarwood and Peel and
start from that point in order to alleviate a drainage problem. Mr. Battenfield
said they would do that and put in a concrete swage for drainage.
Mr. Jacks noted that the street light needs to be moved to the intersection of
Briarwood and Township, and Mr. Battenfield said they would move it.
Bill Kisor made a motion to approve the preliminary plat of Mathias Subdivision
with 1) no sidewalk (or other up grading of existing improvements) required on
Township Road and 2) put the street light at the intersection of Township and
Briarwood.
Keith Newhouse seconded the motion, which passed unanimously.

The second item for consideration was the
approval of the Large Scale Development Plan
for a branch bank of Fayetteville Savings
and Loan Association located at Millsap Road

Millsap Road F, North College
and North College.Avenue.
Ron Shelby was present to represent.
Mr. Newhouse noted that there was an error in the Plat Review Committee minutes.
It should read that the trash container be located on the southeast corner of
the property. Keith Newhouse made a motion to recommend waiving the required
safety zone for a driveway from street intersection to allow a driveway 24 feet
from the street intersection.
Bill Kisor seconded the motion, which passed unanimously.

for private drives in Planned Unit Developments •-IN PLANNED UNIT DEVELOPMENTS
which he had obtained from three booklets. He
said he hoped the Planning Commission would leave "private streets" in Planned
Unit Developments. He noted that the streets would have to be adequate for
sanitation trucks and public vehicles.
Bill Bonner asked what would happen if, after the private street had been used by
the general public for more than seven (7) years, someone wanted the city to take
over maintenance by prescription. City Attorney McCord said he would research this.
He suggested the Subdivision Committee consider all of these questions thoroughly
before making any decision. Ernest Jacks said he felt Larry Wood should re -write
the entire planned unit development regulations. City Attorney McCord agreed
with Mr. Jacks.
Bill Bonner asked if the buyer should not be aware that this is a private street
and the City will not maintain it. Mr. McCord also noted that private streets
should not be "through streets".
Claude Prewitt said that without private streets, you almost kill the Planned
Unit Developments ordinance. There was some discussion about the street width.
Larry Wood said they could bring the street width down to a bare minimum and trans-
fer the parking off-site in Planned Units Developements since it is cheaper to
improve a parking lot than it is to build a street. Mr. Jacks felt you should
consider the number of units in the Planned Unit Developements when considering
the street width.
Mr. Jacks questioned if the lo;t• cost would be less in a Planned Unit Development
since you would not have as wide of street and Claude Prewitt felt they may be a
little less. Mr. Jacks noted that the person buyinga lot would have to help
• maintain the street. He said he did not feel you should have to pay the same for
the lot and still have to help maintain it. Mr. Prewitt noted that they would
probably have a swimming pool or tennis court, which would.'increase the cost of the
lot.
The Subdivision Committee decided they do agree with the "private street" concept
in.Private Unit Developments.. The Committee asked Planning Consultant Larry Wood
to give them standards for street widths for those Planned Unit Developments which
will be coming in before the new ordinance is written._
Ervan Wimberly felt they should rewrite thw hole Planned Unit Development ordinance.
He noted that plat sizes and other things need to be looked at.
Ervam Wimberly pointed out that the presert Planned Unit Development ordinance
says they should have every house laid outbut he would like to have some leeway
on lot splits in Planned Unit Developments.
The Subdivision Committee agreed to meet Tuesday, September 6, at 1:30 P.M. to
consider street widths and standards for private drives in Planned Unit Developments.

The last item for discussion was a study to make a"GREEN SPACE"
recommendation on "green space" in subdivisions. SUBDIVISIONS
Chairman Jacks explained some recommendations from the ASPO booklet.
There was some discussion about a cash payment in lieu of developing parks in a
platted subdivision.
City Attorney McCord felt the City could enforce this.
The Subdivision Committee also discussed the idea of a "tree protection" ordinance.
Claude Prewitt felt they do not need a "tree protection" ordinance. He felt most
developers are conscious of trees and try to preserve them.
Mr. Jacks said the big issue on "green space" is the maintenance of the green space.
He said the City will not maintain it so the Homeowner's Association would have to
maintain it.

Larry Wood recommended that they ask the City Board of Directors to state what
its policy would be in regard to acceptance and maintenance of "open space" in
subdivisions.
Mr. Jacks asked that the Subdivision Committee go on record as 1) the Subdivision
Committee would favor an ordinance requiring open space but suggest it be deve-
loped only if the City would take over maintenance of it.
City Attorney McCord said he would be glad to bring this up under "other business"
at the next Board of Directors meeting.
Ernest Jacks said he would also like the Subdivision Committee to consider a
"planting incentive" for commercial and residential subdivisions.
