The Subdivision Committee of the City Planning Commission met at 4:00 P. M., Monday,
June 13, 1977, in the Board of Directors Room, City Administration Building,
Fayetteville, Arkansas.
MEMBERS PRESENT: Chairman Ernest Jacks, Keith Newhouse, Bill Kisor, Larry Wood.
MEMBERS ABSENT: Jack Ray.
OTHERS PRESENT: Angie Medlock, Bobbie Jones, Rick Cowdrey, Phillip Misenheimer,
Donald Nickell, Chad Kumpe,Gary Carnahan, Ken Riley.
Chairman Ernest Jacks called the meeting to order.
Keith Newhouse made a motion to approve the minutes of the May 23, MINUTES
1977 Subdivision Committee meeting as mailed. Bill Kisor seconded
the motion, which passed unanimously.
The first item for discussion was the approval of the CALVARY BAPTIST CHURCH
Large Scale Development for the Calvary Baptist Church Large Scale Development
located East of Porter Road and North of Lawson Street; E. of Porter Rd. $ N..c$.Lawson
Calvary Baptist Church, developer.
Donald Nickell and Rev. Philip Misenheimer were present to represent.
Chairman Jacks asked if the 10 feet additional right-of-way on Porter Road has been given
and Bobbie Jones said he does have an authorization for three men to sign the easement
when City Attorney Jim McCord gets it drawn up. Chairman Jacks said the setbacks on the
Family Life Center should be 100 feet from the side property line; also the softball
diamond should be 100 feet from the side property line; both will have to be waived by
the Planning Commission under Article 7, Section 14 of the zoning ordinance.
Donald Nickell said they don't have enough room there and would appreciate a variance.
Mr. Jacks mentioned that the reason behind this setback is the noise factor. Donald
Nickell said the property adjoining to the pastor's residence and the Family Life
Center is the back of the lots facing Lawson Street. He said he doesn't think it will
be a hindrance to anyone there. He said the softball diamond is out in the middle of
a field.
Chairman Jacks questioned why Bobbie Jones interpreted the Family Life Center in a
different category than the Church.
Keith Newhouse asked what times they would want to use the Family Life Center and Rev.
Misenheimer said it would be at night, but not very late at night.
Donald Nickell said there is a ditch on the north side to drain to the road He said
there is a natural flow and drainage on the south side. He said they wanted to leave
a space there to properly drain the property. Both drainage ditches flow toward
Porter Road. One goes toward the east and the other goes toward the west to Porter
Road.
Mr. Jacks asked if the surrounding property owner's were notified and Bobbie Jones
said they were notified when this came to the Planning Commission for a conditional
use.
Donald Nickell said there is one house to the south but it is blocked off by greenery
and shrubs. Donald Nickell said the church building will be setting directly in the
center of the property (north -south) so they will have a 55 foot setback from the
south property line for both the Church and the Family Life Center instead of the 30
feet shown. He said that dimension shown on the plat is incorrect.
Ernest Jacks said he would like the owners on Lawson to be aware of the large scale
development Donald Nickell reminded Mr. Jacks that they will be further away now
than they would have to be if they had rezoned the property to P-1 and most of those
people signed the petition asking to change the property to P-1.

Keith Newhouse made a motion to recommend approval of the large scale development of
the Church withthe stipulation§ that 1) the Planning Commission waive the setbacks on
the Family Life Center and on the softball diamond, and 2) the Church give the 10 feet
additional right-of-way on Porter Road
Bill Kisor seconded the motion, which passed unanimously.
The second item for consideration was the Large
Scale Development for a professional office complex
located on the Northwest corner of Green Acres
Road and Poplar Street; Dr. Floyd Harris, developer.

Mr. Jacks said the Planning Commission may require off-site improvements. Bobbie Jones
mentioned that the newly passed Ordinance 2337 says the "developer at his expense shall
install street paving, curb, gutter and sidewalks where needed". She said this is an
amendment to Chapter 18-47, streets and sidewalks maintenance and construction policies.

Chairman Jacks said the building setback on Building 2A to the north needs to be 25
feet. Chad Kumpe said they have changed this since Plat Review.
Ernest Jacks asked if the 15 foot setback on the west is dimensioned and Chad Kumpe
said there will be a 15 foot setback and screening material will be put there.
Bobbie Jones said there needs to be a note on the plat saying the parking lot will be
paved. It will need to be at least double chip and oil sealed.
Ernest Jacks said they would take this on to the Planning Commission to discuss what
improvements they should require under Ordinance 2337.
Bobbie Jones said Jim McCord had declined to define what is meant by "development" in
Ordinance 2337 for her so she isn't sure what developments to require the off-site
improvements on.
Next was the approval of the Preliminary Plat MILLERS ADDITION
of Millers Addition located east of Highway 71 South Preliminary Plat
and North of Willoughby Road; Arthur Miller, developer. Willoughby Road
This was tabled at the May 23 Planning Commission meeting
at the request of the developer.
Ernest Jacks questioned if the easement problems have been worked out and Bobbie Jones
said "yes". Mr. Jacks asked if the Planning Commission has approved the tandem lots
and Bobbie Jones said "no". Mr. Jacks asked if the Planning Commission should take this
up as a tandem lot and Bobbie Jones said they should. There is an application in
the file.
Ernest Jacks said the right-of-way needs to be dimensioned and shown as right-of-way.
He said they need the signatures of the adjoining property owners and Bobbie Jones
said this had been taken care of. Ernest Jacks said the sidewalks and street lights
are not shown yet.
Bill Kisor asked what they were going to do about the septic tanks.
Bobbie Jones noted that Lots 1-8 cannot be further subdivided without a public street.
Bobbie Jones said this note needs to be put on the plat so if someone buys one of
those lots, they will be aware thatthey can't further subdivide it without putting in
a public street.
Chairman Jacks asked if they would need to require the improvements or get a waiver
from the Board of Dlrectors and Bobbie Jones said this was submitted for Plat Review
before the Ordinance was passed.
Ernest Jacks asked if the people could allow the sanitation trucks to go on their
property and Bobbie Jones said the Ordinance says they can allow the trucks to go
onto the lots in the back.
Ernest Jacks said they would take this on to the Planning Commission along with a
conditional use request for the tandem lots and let the Planning Commission decide if
they would require the off-site improvements.

Next was the approval of the Preliminary Plat of Colt COLT SQUARE
Square located West of North College Avenue and South Preliminary Plat
of Township Road; Bassett Properties, developers. W. Of College & S. of Township
Gary Carnahan, Lindsey & Associates, was present
to represent.
Gary Carnahan said they have submitted drawings of the flood plain and proposals of
how they will be cleaning out the channel to Mr. Lieberenz and Clayton Powell. Gary
Carnahan said they plan to develop and then sell the commercial -lots.
Mr. Jacks mentioned that Larry Wood asked the developer to work toward a continuous
flow of traffic from Highway 71 to Highway 112 by developing a street from the south-
west corner of this property curving through to Township Road near where the creek
crosses Township. There is already some dedication on the south side of the University
farm between Leverett and Gregg.
Chairman Jacks asked if the developer wants to do this and Gary Carnahan said Mr.
Bassett thinks the flow from Gregg to Township will be adequate and doesn't want
this subdivision to have this major traffic flow through it. He said they have
designed this as a modified type of mall arrangement and that is the way Mr. Bassett
wants it.
Chairman Jacks said they will need a 5 -foot sidewalk on both sides of the street,
all the way around. Gary Carnahan said he has corrected the plat and it shows all
the corrections mentioned in Plat Review.
Gary Carnahan said they feel they should not be required to improve the State Highway
(Township). He said they only have 1,000 feet of frontage on one side of Township
Road and they don't feel that their development will generate enough additional
traffic to require them to upgrade the street. He acknowledged that there is already
a traffic problem on Township, but did not think this development would aggravate
the situation. He did not think it fair to require Mr. Bassett to improve part of
the street unless the other property owners along Township would do the same.
Gary Carnahan asked that they approve the preliminary plat and bring the widening of
Township up at another time.
Chairman Jacks asked if there is a problem about the right-of-way on Township. Gary
Carnahan said they will give adequate right-of-way.
Ernest Jacks questioned if the 5 foot sidewalk is shown and Mr. Carnahan said he had
put a note on the corner of the plat saying there will be 5 feet sidewalks on each
side. Mr Jacks asked if the legal description has been corrected and Gary Carnahan
said "yes". Ernest Jacks asked if the street light spacing still needs to be waived
and Gary Carnahan said that from the intersection at Township to the lower left
corner of Lot 5 it is 325 feet and the requirement is 300 feet.
Bobbie Jones also mentioned that they may want to require street lights on Township
and Gary Carnahan said there are no street lights on Township now.
Bobbie Jones said where Colt Square Drive terminates (up the east side of Lot 21)
there is a note about "reserved property". She said this property was first shown
as 25 feet for future street with the understanding that people who own the property
to the east would at some future date give 25 feet and build a street on out to
Township. Bobbie Jones said they will need a note to the effect that this reserved
property to the east may be developed as a street at the expense of those property
owners and dedicated as a street after being built to street standards. The property
owners to the east would pay for the building of the street and dedicate their half.
Mr. Bassett has already set aside the right-of-way for their benefit.
Bill Kisor asked if the drainage is worked out and Gary Carnahan said Clayton Powell
said he would have to improve the existing drainage swales so the CIty would maintain
the easements.
Chairman Jacks said there are three stipulations: 1) the off-site improvements either
be required or be waived by the Board of Directors; 2) waive the street light spacing
to 325 feet in one instance; and 3) put the note on the plat about the "reserved"
property.

The last item for discussion was the approval of the CENTURY ESTATES
• preliminary plat of Century Estates located Preliminary Plat
North of Township Road and West of Old Wire N. Of Township P, W. Of Old Wire Road
Road; Harris $ Muncy Real Estate; developer.
Rick Cowdrey, Taylor Engineering, was present to represent.
Ernest Jacks said there would be no access to Township Road from Lots 1 and 14.
Rick Cowdrey said that is shown.
Chairman Jacks asked if the 40 feet right-of-way from Old Wire Road from the centerline
is shown and Rick Cowdrey said "yes".
Mr. Jacks asked if the easement on the south side is shown for Warner Cable and Rick
Cowdrey said it is. Mr. Jacks noted that the R-2 notation on the plat had been
changed to R-1.
Mr. Jacks mentioned that they would need to waive the street light spacing to 400
feet in two cases and Bill Kisor said he felt they should put in one more street light.
Ernest Jacks mentioned that the intersection is very close to the intersection of
Stanton Avenue. Larry Wood said the exit is about as far south as they could put it
without losing a lot. Ernest Jacks said the Planning Commission would have to waive
. the distance between street intersections since it is not the required 400 feet.
