MINUTES OF A SUBDIVISION COMMITTEE MEETING
The Subdivision Committee of the City Planning Commission met at 4:30
January 24, 1977, in the Board of Directors Room, City Administration
Fayetteville, Arkansas.

Chairman Ernest Jacks called the meeting to order.
Keith Newhouse moved to approve the minutes of the January 17, 1977, MINUTES
meeting as mailed. Bill Kisor seconded the motion which was
approved unanimously.
The only item for discussion was the approval of Jerry D. Sweetser
the preliminary plat of Azalea Terrace, located AZALEA TERRACE
south of Old Wire Road at the end of Colette; S. of Old -Wire Rd. at end of Colette
Jerry Sweetser, Developer.
Chairman Jacks mentioned that although the Plat Review Committee had reviewed this
July 15, 1976, it never came to the Subdivision Committee. The Planning Commission
had approved a Preliminary Plat in 1973 but that approval has expired so they had to
go through the whole process again. He said there is a question about whether Mr.
Sweetser should build the sidewalks on Azalea Terrace between the subdivision and Old
Wire Road. He asked Bobbie Jones if the Ordinance requires the sidewalks to be ex-
tended out to Old Wire Road. Bobbie Jones said she didn't know. Jerry Sweetser said
he would extend them on out to Old Wire Road if he had to, but he would rather not.
Bobbie Jones said it is not actually answered in the Ordinance but that in street
improvement districts, sidewalks have been required. Chairman Jacks asked if this would
go to the Board of Directors and Bbbbie Jones said "no". Bill Kisor asked if Jerry
Sweetser would be required to pave Colette. Bobbie Jones said Mr. Sweetser did not
plan to do so.
Chairman Jacks said the easements for Arkansas Western Gas and Southwestern Bell Tele-
phone are shown. He said Mr. Mattke mentioned that they need a 50 foot easement
for drainage near the creek. Mr. Mattke felt the south boundary of the subdivision
should be extended to the center of the creek. Jerry Sweetser said he felt if this
land is in the flood plain they should be able to keep it as A-1 land. Bobbie Jones
said it is now R-1 and he said he would like to keep it as R-1, but unsubdivided.
Once this land is brought into the subdivision (the 10 acres near the creek), he will
be required to pay higher taxes on it.
Harold Lieberenz, Inspection Superintendent, said the flood plain program was initiated
in 1974. The City got a revision of the flood plain map on -June 28 of last year but
he wasn't aware of it until this Subdivision had gone through Plat Review. Even
though they have allotted some land for the flood plain, Mr. Lieberenz wants to point
out that there may be additional land in the flood plain. The regulations say that
the City should take any available information regarding the flood plain to work up
the elevation. The developer has to bring the lower floor level of a building two
feet above the flood plain level. He said he understands they are going to try to
widen the channel out to pull the water out and they will have to submit this to him
when it is finished. Mr. Lieberenz said he isn't sure if the City can accept this
or not. At this point the Committee can't really do anything about it but he did want
them to be aware of the fact that this is a problem.

Jerry Sweetser said the information furnished the City failed to give sea level
elevations on the flood map. Chairman Jacks asked if we could get this information
• from the Corps of Engineers in Little Rock. Mr. Lieberenz said "no". Mr. Sweetser
said the insurance companies are the ones who really made the flood plain. Mr.
Lieberenz said the Federal Administrator will provide data for the flood plain
management, but he doesn't know when he will receive it. He stated that if the Admini-
strator has not provided sufficient data for these regulations to be enforced, the
Committee should obtain information from any other Federal or State source pending
getting this data. The only thing is that Mr. Lieberenz, Mr. Sweetser, and the
engineer will have to work with this and they will have to furnish sectional contours
of how it is now and how it will be when it is finished. This will have to be
certified by the engineer and sent on to the government.
Chairman Jacks asked if channelizing the creek would change it very much and Mr.
Albright said it would. Mr. Jacks asked if they could issue a building permit to
Jerry Sweetser and Mr. Lieberenz said not until he gets the floor level approved for
the flood plain.
Larry Wood stated that they wouldn't be able to get an elevation from the Corps of
Engineers. He mentioned that a lot of different agencies have been working on the
flood plain.
Mr. Sweetser said he feels that he has a competent engineer who can determine the
flood plain. Mr. Lieberenz said if whoever buys the lot gets flood insurance he will
have to have an engineer certify the floor level in relation to the mean sea level.
He said he is in agreement with the developer that there could be a flood plain
problem with some of these lots. They will have to be worked out before anyone can
build on these lots.
Chairman Jacks asked if the Subdivision Committee would be all right with the City
to approve this subdivision showing these lots going to the centerline of the
• creek. Mr. Lieberenz said he wasn't sure.
Planning Consultant Larry Wood said he would think Mr. Sweetser would want to dispose
of the land along the creek either as a drainage easement or sell it to the lot
owners. Mr. Sweetser said he plans on eventually selling whoever buys the lots the
land along the creek. Larry Wood said he should show it lotted to the center of the
creek with a drainage easement across it. Mr. Sweetser said he wants to get stuck
with this land along the creek. He plans on straightening out the creek and selling
the top soil from the creek. Mr. Sweetser said he will continue to own this land as
R-1.
Larry Wood said it is not a good development plan to lock in a piece of property.
Normally, it would be disposed of one way or another. The normal procedure is to
throw the burden of the flood plain back on the developer. Jerry Sweetser said if
this land has to be brought in, he wants it brought in as one lot.
Bobbie Jones directed the Committee's attention to Ordinance 2293 dated December 7, 1976
which says a subdivider may be required to construct off-site improvements (which
included streets, sidewalks, and street lights) when the need for such improvements
is created in part or in whole by the Subdivision.
Chairman Jacks said the Subdivision Committee would recommend the approval of the
Preliminary Plat on the conditions that (1) they show the land along the creek as
another lot; (2) they recommend approval on waiving street light spacing to 330 feet
instead of the required 300 feet in one instance; (3) change the street right-of-way
between Lots 35 and 36 to a normal width with the balance now shown going into the new
flood plain lot, (4) waive the maximum length of a dead-end street to permit one street
550 feet long and another 650 feet long; and (5) to refer to the Planning Commission
whether the sidewalks and street lights are to be required on out to Old Wire Road.
