HomeMy WebLinkAbout1976-09-13 - Minutes• • MINUTES OF A SUBDIVISION COMMITTEE MEETING The Subdivision Committee -of the City Planning Commission met at 4:00 P. M., Monday, September 13, 1976, in the Board of Directors -Room,. City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Chairman Chairman Ernest Jacks, Bill Kisor, Keith Newhouse, Larry Wood. Jack Ray. David McWethy, General Bruce Kendall, Frank Blew, Bill Graue, Neal Albright, Harriet Jansma, Buddy Coleman, Clay Robinson, Bobbie Jones, Robin Northrop. Ernest Jacks called the meeting to order. The minutes of the August 23, 1976 Subdivision Committee Meeting were approved as mailed. Chairman Jacks opened discussion on the Final Plat of Rolling Meadows, Phase I, located North of Rolling Hills Drive and West of Old Missouri Road Mr. Clay Robinson was present to represent. MINUTES ROLLING MEADOWS, PHASE I No. of Rolling Hills Drive Final Plat Chairman Jacks noticed that Ozarks Electric had written a letter asking to have some easements widened. Mr. Jacks also mentioned that Bobbie Jones wanted to show dedication on Old Missouri Road more clearly. Mr. Frank Blew said that Mr. Stubblefield still owns the 30 ft. right-of-way on the West side of the centerline of Old Missouri Road. Chairman Jacks said that they need to get a dedication from Mr. Stubblefield Larry Wood said that he really sees no problem if the developers are going to pay for the paving of that portion. However, if they aren't going to pay for the paving, and meet the paving requirements, he said that someone is "sneaking" out of this pretty neatly. Bobbie Jones said that they should probably talk with City Attorney, Jim McCord, on how this should be handled. Mr. Clay Robinson said that they have got to get those streets, in the Stubblefield Addition, closed. He proposes to prepare a street closing application. He said that he has talked with Mr. McCord, and has figured out how to do it Chairman Jacks said that he sees no problem with this. Bobbie Jones said that they need to, either: (1) Have a performance bond; (2) cash bond; or (3) enter into a contract Mr. Robinson said that he thinks they will probably enter into a contract, with respect to improvements. Mr. Kisor moved that this be accepted, contingent on two things: (1) Satisfying Ozarks Electric, as far as easements are concerned; and (2) Get with Mr. Stubblefield with respect to the 30 ft. right-of-way on the West side of Old Missouri Road. Mr. Newhouse seconded the motion, which was approved unanimously by a vote of 3-0. Subdivision Committee -2- September 13, 1976 Chairman Jacks opened discussion on the Final Plat of Jerry D. Sweetser Subdivision, to be located East of Winwood Estates and South of the Township Line between Towhships 16 and 17. Mr. Neal Albright was present to represent. JERRY D. SWEETSER SUBDIVISION East of Winwood Estates Final Plat Chairman Jacks said that Clayton Powell said that he wanted to know whether they will put a "T", a cul de sac, or a barricade, at the end of Bois de Arc Lane. Mr. Albright said that he had a letter from Street Superintendent C. Powell approving the street and drainage plans. Chairman Jacks read into the minutes, the letter, which follows in its entirety: "September 7, 1976 Mr. Neal Albright P. 0. Box 1202 Fayetteville, Arkansas Re: Engineering Plans de Arc Lane). Dear Mr. Albright: 72701 for Jerry D. Sweetser Subdivision (Extension of Bois These Plans and profiles are approved contingent upon incorporating the following recommendations. 1. Bois de Arc Lane, Station 5 + S0: Construct a concrete swale across the intersection of Primrose Lane. 2. Station 7 + 20: Construct side inlets in lieu of the concrete swale to empty drainage off the street as per our phone conversation of September 3, 1976. 3. Station 8 + 20: Construct the street to the east property line instead of terminating it at Station 7 + 90, as discussed in the Plat Review Committee Meeting on September 2, 1976. 4. Rip -rap the floor of the drainage easement running North from Station 7 + 20 as discussed by phone, September 3, 1976. General comments regarding construction are attached as enclosure 111. "Sincerely Clayton Powell Street Superintendent" Bobbie Jones said that Mr. Mattke checked water and sewer, and it is o.k. She said that fire hydrants are required as a matter of course. lu� • • • Subdivision Committee -3- September 13, 1976 Bobbie Jones said that where there is a 30 ft. street utility easement on Lot 4, Block 2, it needs to be shown as a dedication for street and utility easement. David McWethy said that he talked with Mr. Sweetser about the right-of-way, and Mr. Sweetser has no objections to changing the easement to right-of-way. Bobbie Jones said that she needs protective covenants. Chairman Jacks said that it looks o.k., except for Clayton Powell's four comments, protective covenants, and changing one easement to right-of-way. Mr. Kisor moved that they approve this, contingent on three (3) things: (1) Satisfying Clayton Powell on his four comments; (2) protective covenants; and (3) changing one easement to right-of-way. Mr. Newhouse seconded the motion, which was approved unanimously by a vote of 3-0. Chairman Jacks opened discussion on the Final Plat for Mildred Lee Estates, located outside City Limits, on the South side of Highway 16 West. Mr. Bill Graue and Mr. Frank Blew were present to represent. MILDRED LEE ESTATES South side of Highway 16 West (Outside City Limits) Final Plat Mr. Graue said that he told Paul Mattke that he would put in a 6 -inch water line. He said that he can give the easements requested on the East side --he cannot give them on the lot on the West side --that is already deeded off. The parties involved have not been contacted on the easement; but they already have a house started and it is too close to the line to give a 25 ft. wide easement. Chairman Jacks said that they could probably approve this, contingent on getting signatures on the plat. Chairman Jacks said that this is being looked at as a Final Plat. Bobbie Jones said that they still need to show highway right-of-way; needs covenants, if any, and if not, it needs to say "None." Mr. Graue said that they will have no covenants. Bobbie Jones said that they need to submit the application and fee. General Kendall said that the road situation is worked out. The County approved the plat, as far as the road is concerned. Mr. Kisor moved to approve this Final Plat of Mildred Lee Estates, contingent on three (3) things: (1) Installing a 6 -inch water line; (2) Getting easements worked out with the utility companies; and (3) Working out whatever technicalities Bobbie Jones has. Mr. Newhouse seconded this motion, which was approved unanimously by a vote of 3-0. Chairman Jacks opened discussion on the Final Plat of Old Wire Road North Subdivision, located East of Old Wire Road and South of the proposed Township Road Extension. Mr. Frank Blew was present to represent. OLD WIRE ROAD NORTH SUBDIVISION East of Old Wire Road Final Plat Mr. Blew said that he doesn't feel that the driveway for Lot 5, Block 4, should be on Stewart Street, and Clayton Powell agrees with this. He said that Old Wire Road is much better. Larry Wood said that if Clayton Powell says it is safer to come out on Old Wire Road, then he has no objections. Bobbie Jones said that the utilities are alright, and that they are going to • • Subdivision Commission -4- September 13, 1976 leave Elmwood as it is shown. Mr. Grimes had said that they can just leave it alone. Bobbie Jones said that one easement needs to be extended to the street right-of- way line. Mr. Kisor moved that they approve this, contingent on working out the easement extension. Mr. Newhouse seconded the motion, which was approved unanimously by a vote of 3-0. There was no further business to be discussed. OTHER BUSINESS The meeting was adjourned at 4:45 P. M. ‘12-
