M.,, Monday, April 26, 1976) in the Board..of Directors Room, City Administration Building, Fayetteville; Arkansas., MEMBERS PRESENT: Chairman Ernest Jacks; Bill Kisor; Keith..Newhouse, Jack Ray. MEMBERS ABSENT: Larry Wood. OTHERS PRESENT: David McWethy, Bobbie Jones, Janet Bowen, Clarence Young, Wade Fincher, Marshall Carlisle, E. L. Jorgensen, Frank Blew, Bryce Davis. The minutes of the March 29, 1976 Subdivision Committee MINUTES meeting were approved as mailed. SOUTHWESTERN BELL TELEPHONE Next was the Large Scale Development Plan Harold Street of Southwestern Bell Telephone to construct Large'Scale Development a SACD (Automatic Call Operators) building behind K -Mart, on the South side of Harold Street between Lee Avenue and Sheryl Avenue on property which is zoned R-0, Residential -Office District. Clarence Young and Wade Fincher were present to represent. In answer to Ernest Jack's question, Planning Administrator Bobbie Jones said that a minimum of 50 feet of right-of-way was needed on Harold and a survey by McClelland Engineers indicates there is already 60 feet of right-of-way. The telephone company indicated they were still planning to curb and gutter the South side of Harold Street all the say to Sheryl Avenue (even in front of the existing residence). She told Mr. Jacks that a notice had been published in the newspaper to notify ad- joining property owners. Wade Finches presented her with a copy of the notice for the files. Also the parking had been setback 25 feet as it should be. Mrs. Jones said she did not know whether or not the problem that belonged to Ozarks Electric had been resolved. Mr. Jacks felt this was not a question for the Subdivision There was no one present to oppose the development plan. Keith Newhouse moved to approve the Large Scale Development seD Bell Telephone on Harold Street. ,1 Bill Kisor seconded the motion which was approved unanimously. In answer to Administrative Assistant David McWethy's question, Bobbie Jones said this would not involve any right-of-way dedication. involving the guy wire Committee to consider. Plan for Southwestern The next item for discussion was the Large Scale Development Plan for the "Racket Club Apartments'." consisting of 164 units to be located on the North side of Wediington Drive (Highway 16 West) approximately h mile West of Highway 71 By-pass and approximately 1 mile East of Rupple Road., Chairman Ernest Jacks pointed out that since this property is now zoned A-1, Agricultural District, and is being petitioned for rezoning to R-2, Medium Density Residential, approval of this large scale development plan would have to be con- tingent on approval of the rezoning by the Planning Commission and the City Board of Directors. E. L. Jorgensen was present to represent. Bryce Davis. was also present as an interested party, Planning Administrator Bobbie Jones said that they did have a quit claim deed showing dedication of right-of-way along Highway 16 West executed by the RACKET CLUB APARTMENTS Highway 71 Bypass Large Scale Development • Subdivision Committee -2- April 26, 1976 property owners from whom Mr; Jorgensen was purchasing the 20 -acres, She had had a question as. to whether or.not she could clear a pro shop in that zone, depending on whether or not it would be a retail shop:, She said the parking and setbacks were alright. Mr. Jacks commented that this pro shop looked like it was pretty well within the development rather than being close to the highway. Mr. Jorgensen said it would not be for the general public, but would be limited to members and that tenants of the apartments would all be members. Mr. Jacks said they had had some problems with other pro shops becoming more of a retail store but that they had been located nearer the highway. There was no one present to oppose the development plan. Bill Kisor moved to approve the large scale development plan contingent on approval of getting the property rezoned as petitioned. The motion, which was seconded by Jack Ray was approved unanimously. VILLA NORTH Next was the discussion of a third access point for Additional Access Villa North, a proposed mobile home park to be located North of the existing Villa Mobile Home Park, West of College Avenue, the South of Appleby Road. The Planning Commission approved the conditional use request and preliminary plat March 15, 1976, but required additional access. Mr. Jacks said he and Planning Commission Chairman John Power had met with City Manager Don Grimes and came up with three proposed accesses. Attorney Marshall Carlisle said one of the alternate proposed accesses would have torn up. Bill Murphy's property (adjoining property owner to the North); and one of the alternate proposals would have run into the House of Honda on Highway 71 which would have to be torn down, plus there would have to be a tremendous amount of filling in done on the North end of Mr. Wilkinson's property because of a gully. Mr. Carlisle said there was a high pressure gas line that runs to Jack Wilkinson's property and they tied in with the right-of-way of it for a street. He said the gas compnay had a 60 foot easement and were going to allow them to come within 5 feet of their West high pressure line (there are tow lines in this easement). Mr. Carlisle said the proposed access would come off of Hacienda Street and go Southeast and then would come back so it could go into Highway 71 approximately 150 feet North of the Coachouse Restaurant. He said Mr. Murphy had agreed to give his half of the right-of-way of Hacienda Street. He also said they had met with Jack Wilkinson and went over this in detail with him and had asked him to give them a letter to the City saying at the time construction commences that he would grant a right-of-way to them (the City) in line with this drawing. He said Mr. Wilkinson had indicated that he would like to think about this and he should have an answer in time for the Planning Commission meeting. (April -26, 1976). If Mr. Wilkinson decided not to give them the right-of-way, Mr. Carlisle said they had some alternatives to propose to him and felt that they could work the problem out. Mr. Carlisle also brought out that there had been a proposal of joint expense as discussed with the City Manager .whereby Jim Ogden and Wade Bishop (Bishop Addition; adjoining this property to the North) would take the money that they would have spent to build a complete street withcurb and gutter for their adjacent property, and turn it over to the City for expense money, The City would then provide the labor and build a single 24 foot street (two lanes down the centerline) all the way to Highway 71, Ernest Jacks felt that this was a good compromise for the whole thing. Mr. Carlisle said this access would not only relieve traffic through Villa North but would also help relieve traffic flow through Appleby Road, which was a gravel street going up to Bishop's Addition. The motion, which -.was: seconded by Keith:Newhouse; was approved unanimously.. Keith .Newhouse left the meeting at this point., OLD WIRE ROAD NORTH Proposed Subdivision The next item was the proposed preliminary plat of Old.Wire Road. OldWire Road North Subdivision, a proposed subdivision to be located West of Winwood Estates, East of Old Wire Road, and South of Township Road extended, submitted by W. T. $ Roselyn Stewart, Developers. Frank Blew (Blew $ Associates) was present to represent. Chairman Ernest Jacks said that the big question concerning this item was getting Township through He said the developers were planning to dedicate a 30 foot right-of-way for the future extension of Township, at which time, if and when the City decided to put Township through, they would be willing to demolish and remove a house on Lot 5, Block 5 valued at $20,000. Bobbie Jones said she had not heard what Mr. Grimes' opinion on this was. She said Street Superintendent Clayton Powell was still wanting the developer to build half a street. Mr. Jacks said he remembered that City Manager Don Grimes had not gone along with this idea. She said the dedication of the 30 feet of right-of-way and the proposal to demolish the house had been an alternative if half of the street could be built. Frank Blew pointed out that the developer did not wish to construct any part of Township and pointed out the problems that would be involved in extending Township because of existing houses and a garage that would have to be moved, etc., but that they were willing to dedicate this 30 foot right-of-way now and remove the house in the future. In answer to Chairman Jacks' question, Mr. Blew said Planning Consultant Larry Wood had requested that one of the proposed streets be shortened so that it would eliminate one intersection on that side of Township. Mr. Wood had also recommended that there be "limits of no access" shown on the plat for those lots facing Township and Old Wire Road, which was shown on this drawing. The Subdivision Committee felt that "limits of no access" should also be shown on the plat.on Lot 5, Block 5, as well as those lots facing on the proposed Township except that the existing house on Lot 5 should be able to retain its present driveway for the life of the dwelling. Mr. Jacks said there seemed to be a precedent set already for dedications for future construction of streets, with Brookside East and other proposed subdivisions. In answer to Mr. Jacks' question, Mr. Blew said that they made a provision for access to Township for people to the South by leaving two street stubs to the South of this proposed subdivision. Bobbie Jones said there were a couple of instances where the distance between street lights exceeded 300 feet as required by ordinance. One place is between the street light shown at the corner of Creekwood Drive and Stewart Street and the one between Lots 4 and 5, Block 3. Another place is from the street light between Lots 6 and 3, Block 2 (South side of Terry Drive) and the Northwest corner of Lot 10, Block. 2. The third distance is the one between the cul-de-sac on Creekwood and the intersection of Creekwood and Stewart Street. These distances would need to be waived if they are left as they are shown. Ernest Jacks commented that the locations asshownseemed to be more logical than the requirements in this case. - Bobbie Jones said that sidewalks also needed to be all the way around the cul-de-sac,and sidewalks should be put along one side of both. of the two street stubs (Elmwood Drive and Creekwood Avenue). Subdivision Committee -4- April 26, 1976 Ssaid the present policy is that the person who builds on the lot builds the sidewalk., They should probably -be on.the same side of the street as the street lights but the street lights should not be put in the sidewalk., Bobbie Jones said she thought Mr, Blew had picked up all the easements that had been asked for at the Plat Review Committee meetings., After further discussion, Jack Ray moved to recommend approval to the Planning Commission of the proposed preliminary plat of Old Wire Road North subject to (1) Restricting access to Township and Old Wire Road; (2) Show sidewalks around cul-de-sacs and on street -stubs; (3) Waive street light spacing as shown on plat, as discussed at this meeting. Bill Kisor seconded the motion which was approved unanimously. WAIVER OF SUBDIVISION REQUIREMENTS The last item for discussion was a request Bill Bequette on behalf of for further waiver of subdivision re- George F. Blackwell quirements submitted by Bill Bequette on behalf of George F. Blackwell for property located outside the City, but inside the City Planning Area on an unnamed road South of Fayetteville -Farmington City Limits. Bobbie Jones explained that three lot splits had been granted by the Planning Office on this property and this request was actually one to divide the third tract of land. She said the access to these lots actually came from the direction of Farmington. She said the aerial photo indicated a gravel road that went up to a barn along the East side of this, and therefore, no dedication had been asked for there. She said most of the lots were 175 feet wide but that the narrowest was 165 feet. She said she did not have any basis for denial of the first three waivers although she did not feel it was the best way to divide the property. The Subdivision Committee agreed with this. Mr. Kisor and Mr. Ray remarked that under the circumstances, they felt they more or -less had to recommend approval. Bryce Davis was present and said he felt there were going to be problems in the 5 mile planning area and that it was fast coming to a head. Bobbie Jones said the only thing that was being asked for was dedication to bring it up to 30 feet of right-of-way from the centerline of the Northern East-West road. Bill Kisor moved to approve the waiver of subdivision requirements. The motion, which was seconded by Jack Ray, was approved unanimously. Concerning Rezoning Petition R76-16(on the Planning Commission OTHER BUSINESS agenda for this date) Bryce Davis said they petitioned for this property to be rezoned in 1973 at which time the Planning Consultant recommended approval. However, on this petition, he was recommended that the rezoning not be approved. Mr. Davis said he was wondering if Planning Consultant Larry Wood had this piece of property mixed up with another one. Mr. Davis felt that there would be a lot of petitions for rezonings coming before the Planning Commission in the future with the sewer going in out along Hamestring Creek. There was no further discussion. The meeting was adjournedat 10;05 A. M.
