HomeMy WebLinkAbout1975-04-08 - Minutes• • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Subdivision Committee to the Fayetteville Planning Commission was held at 3:45 P. M. Tuesday, April 8, 1975, in the Board of Directors Room, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: John Power, Ernest Jacks. MEMBERS ABSENT: Helen Edmiston. OTHERS PRESENT: Bobbie Jones, Janet Bowen. Waiver of The only item for discussion by the Subdivision Committee Subdivision Requirement was an appeal to the Planning Commission for a waiver of EARL P, JACK GIBSON subdivision requirements for property lying North of Highway 16 East Highway 16 East (Huntsville Road) and East of an undedicated roadway known unofficially as Cunningham Lane, submitted by Earl and Jack Gibson. Planning Administrator Bobbie Jones explained that Mr. Jack Gibson came to the Planning Office trying to get a building permit to remodel his carport and it was found that this property had been split off without acquiring a Waiver of Subdivision Requirements. Mrs. Jones said one person had owned all of this land at one time and had built houses for rental purposes; it is felt that these houses were built before this was annexed. Mr. Jacks noted comments from City Engineer Paul Mattke and Street Superintendent Clayton Powell. He said Mr. Mattke wanted 50 feet of right-of-way dedicated and Clayton Powell wanted the 50 foot of right-of-way dedicated and a City street constructed before the Lot Split is -approved. Mr. Jacks wondered about recommending approval of this provided Gibson dedicated the 50 foot of right-of-way. Bobbie Jones pointed out that the original owner of all this property had retained a 2 foot strip between Mr. Gibson's property and the road. Mrs. Jones said she could go ahead and issue a building permit on this without street dedication, but she didn't know if they would be overstepping their authority or not. John Power felt that this was already done and there was not much they could do about it. After some discussion the Subdivision Committee was ready to recommend to the Planning Commission the approval of the Lot Split and go ahead and maintain this as a private drive. Then if this area is ever properly subdivided, then they could request that a street be constructed. There was no further discussion. The meeting was adjourned at 3:55 P. M.
