HomeMy WebLinkAbout1974-11-12 - MinutesMINUTES OF A SUBDIYIS1ON COMMITTEE MEETING A meeting of the Subdivision Committee of the Fayetteville Planning Commission was held at 3:00 P. M., Tuesday, November 12, 1974, in the Directors Room, City Administration Building, Fayetteville, Arkansas, MEMBERS PRESENT: Ernest Jacks, Helen Edmiston MEMBERS ABSENT: Al Hughes, OTHERS PRESENT: Bobbie Jones, David McWethy, Larry Wood, Janet Bowen Final Plat of The first item to be discussed was the final plat of the SEQUOYAH WOODS Sequoyah Woods Subdivision, Phase 1, located South of Subdivision, Phase 1 Highway 45 East and West of Joe Fred Starr Road. It was noted in the Plat Review notes that there is not sufficient right-of-way on Joe Fred Starr Road to meet the Major Street Plan, and that the subdivider felt they could not do anything about the right-of-way because of a prior easement of SWEPCO's. Bobbie Jones, Planning Administrator, said there was a letter from the City Attorney to the Planning Office to have the developer execute the right-of-way grant subject to SWEPCO's easement. Mr. Jacks said there was an area designated on the drawing that lies between the main body of the subdivision and Highway 45 which is labled "common property" and the utility companies want certain usage of it. It was felt that the Subdivision Committee should recommend to the Planning Commission approval of the final plat of Sequoyah Woods Subdivision, Phase 1 with the provision that (1). "Common property" on the East side of Whippoorwill be shown as "common property and utility easement." (2). That 30 feet of right-of-way from the center line of Joe Fred Starr Road be obtained subject to SWEPCO's prior easement. There were no more comments. CLIFTON GABBARD Large Scale Development The second item for discussion was the Large Scale Development Plan of Clifton Gabbard to develop a scrap metal processing and auto salvage South of the end of Ray Avenue and between the West Fork of the White River and the Industrial Park. Ernest Jacks reviewed the Plat Review notes and thought that it would be better if Mr. Gabbard could purchase additional property to extend Ray Avenue and dedicate it or he could go ahead and build it as a private drive and maintain it himself with a notorized agreement that the City would not be responsible for maintaining the drive and that he would not block the natural drainage. It was decided thatthe Subdivision Committee would recommend to the Planning Commission the approval of the Large Scale Development of Clifton Gabbard contingent on Mr. Gabbard either extending Ray Avenue and building it to minimum City street standards or construct it as a private drive and maintain it himself with a notorized agreement acknowledging this. There was no further discussion. 01, r" !1 pg l0 Subdivision Committee -2- Noyemher 12; 1974 CALVARY ASSEMBLY OF GOD CHURCH The next item discussed was the Large Large Scale Development Scale Development Plan and Conditional Use Request of Calvary Assembly of God Church, 2070 North Garland Avenue, to construct an addition connecting two separate structures. The only problem that the Subdivision Committee found was that sufficient right-of-way on Garland should be provided for the City to have an 80 foot street. However, there was a question about how much right-of-way there actually is, since Clayton Powell, Street Superintendent, had asked for 10 feet and the plat book shows 75 feet already existing; the Subdivision Committee felt that this should be pointed out to the Planning Commission and settled as to the amount. There was no further discussion. The Subdivision Committee was ready to recommend the Large Scale Development of Calvary Assembly of God Church on the above provision. "SHONEY'S" RESTAURANT 'JR The next Large Scale Development was that submitted Large Scale Development ') for a "Shoney's" Restaurant on General Growth Properties North of the Northwest (1Arkansas Plaza, on North College Avenue. ) There was some discussion as to whether or not the service road would be constructed all the way to the North property line. Mr. Jacks said they had i) offered to post a performance bond so that at a future date when this was ready to go on, they would construct a service road across the front of the property; right-of-way from the service road should be dedicated. It was also brought out that the parking would need to be screened if it was not set back 20 feet from the North property line. Helen Edmiston inquired as to why they planned to construct a service road when it would not be going anywhere. Larry Wood, Planning Consultant, pointed out that in the future this road would more than likely go on through to Johnson Road. There was no further discussion and it was decided that the Subdivision Committee would recommend to the Planning Commission the approval of the Large Scale Development to construct a "Shoney's" Restaurant with the provision that (1). They post a performance bond for the future construction of a service road all the way to their North property line. (2). They provide the right- of-way for the service road. (3). All easements required by the appropriate City officials be subject to their approval. UNIVERSITY BAPTIST CHURCH The last item for discussion was the proposed Proposed revision to approved revision to the approved Large Scale Development Large Scale Development Plan Plan and Conditional Use for University Baptist Church, 315 West Maple Street. The Church wants to locate some temporary educational buildings on their property as an interim measure. Mr. Jacks said there should be a time limit set on just how long "temporary" should be; it was suggested that 2 years should be the limit. Street right- of-way was also needed. After some discussion Mr. Jacks and Mrs. Edmiston felt that this was not really a Conditional Use and they were uncertain as to what they should present to the Planning Commission. There was no further discussion. Meeting was adjourned at 4:00 P.M.
