HomeMy WebLinkAbout1973-07-24 - MinutesADJOURNED MEETING OF A SUBDIVISION COMMITTEE The Subdivision Committee of the Fayetteville Planning Commission met in an adjourned session at 3:30 P.M., July 24, 1973, in the Office of City Planning, City Administration Building, Fayetteville, Arkansas. Members Present: Ernest Jacks Helen Edmiston Members Absent: Al Hughes Two additional items not covered in the previous meeting which are on the July 24, 1973 Planning Commission agenda were discussed in this meeting. A development plan for Grandma's Steak House to be located west of Johnson Road submitted by Kirk McClelland was discussed. This proposed develop= ment would be on the Mack S. Young property which was recently rezoned and the steak house would be located in the dwelling on that property. There was some question as to whether the road across the north side Kirk McClelland of this property is classified as a public road or a private drive. The developer wishes to leave it graveled and to have a low-water bridge crossing the creek. Clayton Powell, Street Superintendent, said that this could be done only if it is considered to be a private drive. If it is a public street, any work on the street would have to meet the minimum street standards and he would not accept a low-water bridge. Harold Lieberenz, Inspection Superintendent, has said that he considers a road a public road if it serves more than one building or more than one residence or place of business. He would regard this as a public road because it leads not only to this house but has been used also by the University Farm, and would ask if they wish to have it considered a private toad that some statement be submitted from the County Judge as to how this road has been considered in the past. In view of the £act that there is a $100.00 utility fee for crossing the railroad tracks, the developer and Clayton Powell had worked out a proposal to extend a short dead-end street from Johnson Road across the railroad tracks and end with a cul-de-sac in this property. Then the existing roadway, if it can be considered a private drive, would take off the cul-de-sac. Whether this is to be considered to be a public road or a private drive would also .affect the location of the parking on the property. Clayton Powell requested right of way ori the south side of this property for the future major street tie between Gregg Avenue and Garland Avenue and lie along the south side of University Farm. GRANDMA'S STEAK HOUSE • Mayor Purdy had asked -that the Subdivision..Committee„look at the Conditional Use request submitted by United Community Services to use property at 720 Stone Street for a "Youth Attention Home”. He said that Mrs. Orton had brought to his attention that this is in the area where the Major Street Plan shows the extension of Gregg and they were wondering if this would conflict with the Major Street Plan. Bobbie Jones said that she thought that the only buildings to be used at this time with this would be the existing buildings, and that there would be no immediate effect upon the Major Street Plan unless a new structure was proposed. In checking the recently adopted Major Street Plan Map she was unable to determine whether Gregg Avenue at this location would be on the east or the west side of the tracks. UNITED COMMUNITY SERVICES Helen Edmiston had submitted a request foi')the Planning Commission to review a strip of land 198 ft. wide and almost one-fourth a mile deep on the north side of Township Road as ---a possible PUD location. Minutes of an Adjourned Meeting of a Subdivision Committee Page 2 Mrs. Edmiston explained to Mr. Jacks that the question on this revolved around whether or not the lane which exists on the property already would have to be dedicated as a 50 ft. public street and improved to minimum street standards. Mr. Guy Berry who presently ownes the property does not wish to have the lane upgraded. If it is to be made into a public street, the full 50 ft. would have to come out of the 198 ft. wide strip. A request for a waiver of subdivision requirements had been submitted by Ralph Brophy. The Subdivision Committee had been provided with minutes of a Plat Review Meeting at which a subdivision plat on this area had been submitted. The Plat Review Committee had recommended that Mr. Brophy subdivide and file a plat on all the balance of this property at this time. Mr. Brophy had not pursued the subdivision plat further after this recommendation. The Planning Office had been contacted several times regarding a waiver of subdivision requirements and had been instructed by the Street Superintendent and others that a. waiver could not be issued"at this point.. 'A. building permit..had:been obtained by James A. Pennington, Pennington Construction Company, to build a house on Lot 18, Block 2, Brophy's Addition. Theowner of the lot had pointed out to Mr. Pennington the property north of Lot 18 and con- struction had been started before the error was found. Mr. Brophy would like to obtain a subdivision waiver and sell a lot (unplatted) lying north of Lot 18, in exchange for Lot 18. The meeting was adjourned at 3:50 P.M. RALPH BROPHY Subdivision waiver
