The Subdivision Committee of the Fayetteville Planning Commission met
at 10:00 A.M., Tuesday, January 26, 1971, in the Directors Room, City
Administration Building, Fayetteville, Arkansas.
Present: Roy Clinton, Helen Edmiston, Harold Lieberenz.
Absent: Ernest Jacks.
Others Present: N. F. Totty, Gene Garrett, J. F. Whiteley, J. D.
Neill, Brian Vanciel, Mrs. Benny Winborn.
As a preliminary explanation, Mr. Lieberenz told the two Committee
members he had checked with the City Attorney about how the City
is to enforce the Major Street Plan. He said in his opinion it
is questionable whether the City can demand dedication or improve-
ment of the proposed Township Road. They can demand setbacks.
Mr. Lieberenz said he hoped to schedule a meeting between the
City Attorney and the Planning Commission members before Feb. 2.

The first matter before the Committee was a proposed Large Scale
Development Plan submitted by Fayetteville Baptist Church to locate
North of Wirnrood Estates. Mr. Lieberenz said the Planning Commission
must decide on the location and width for the extension of Township
Road. Roy Clinton remarked that in view of the recommendations of
Larry Wood at the previous Planning Conmmi.ssion meeting, the width
• for Township would probably be reduced to 60 ft.

The Committee discussed the proposed plot plan with Mr. Totty,
Mr. Garrett, Yr. Whiteley, and Mr. Neill. Zoning setback requirements
were discussed.
Mr. Clinton said he saw no problem with obtaining Planning Conadssion
approval if the Church is willing to set back and allow for Township
Road. He felt they would be asked to set back 50 ft. and that only
10 ft. would be required of Mr. Winborn on the South. Mr. Garrett
and Mr. Totty remarked that if 10 ft. is all that is required of
the Winborns and they give the 10 ft. they claim by adverse possession,
they are in effect giving nothing.

churches in the "RI' districts on a
Large
Scale Development.
The next item studied by the Committee was a proposed Large Scale
Development Plan for the First Church of the Nazarene to be located .
on the ?Jest side of Old Missouri Road and South of where Oakcliff FIRST CHURCH OF THE
Street would extend through. Brian Vanciel was present. There are NAZARENE
basically two matters to be settled: (1) 25 ft. has been dedicated
to extend Oakcliff Street to Old Missouri Road at an earlier date.
Must the church dedicate the additional 25 ft. and who is to improve
the street? Or, should the church merely increase their setback 25 ft?

1 (2) The Major Street Plan calls for a 60 ft. collector street
• to cut through the West portion of this property. Larry Wood
recommended this collector street be moved to the present Old
Missouri Road and Old Wire Road. The County has already required
ROW of Old Missouri Road be increased to 60 ft. according to
one source. The Committee agreed with Mr. Wood's recommendation
and foresaw no problem on these plans.
The third item for study was the preliminary plat for proposed
Eastgate Subdivision Pio. 2 lying between Wood Avenue and Washington
Avenue and between Huntsville Road and Fifteenth Street. Mr. Lieberenz
told the two members that in the past 20 ft, has been dedicated for
ROW for an extension of Willow Avenue. The Plat Review Committee EASTOATE SUBD. # 2
recommended changing the proposed street pattern to eliminate lots Preliminary Plat
with double frontage, to provide right of way for Willow Avenue and
to dedicate 25 ft. off the South side of the property for the future
extension of 11th Street. There were some drainage problems. Wood
Avenue Baptist Church feels that they could dedicate 25 ft. off
their property for a street if these developers are willing to do the
same. Mr. Barrett does not wish to improve Willow Avenue. The Major
Street Plan calls for Willow to be 60 ft. collector. Roy Clinton
said he felt 50 ft. was sufficient. East-West streets are needed
more here. The Committee felt the Planning Commission should ask
for 25 ft. for Willow Avenue and 25 ft. for 11th Street and allow
the developer to retain the remainder of his street pattern.
The fourth item for study was a proposed plat to replat Lots 1, 29
and 3, Block 7, and a part of Lot 2, Block 6, Meadowlark Addition.
Mr. Lieberenz said the Plat Review Committee recommended reversing
four lots which front on Cato Springs Road. Paul Mattke wants
a 6 -inch water line to provide fire protection. There is
in the area to reducing lot sizes. The City Attorney
will have to hire their own attorney and settle this*
not regulate private covenants. All the streets are

Roy Clinton felt perhaps the City should delay approval until the
matter of private covenants was settled. He said he felt the Planning
Commission had an obligation to try to maintain the area since it has
developed. Bronson Abstract is to be contacted concerning covenants.
Mr. Lieberenz said all the problems have finally been ironed out on
