A meeting of the Fayetteville Board of Sign Appeals was held on
Monday, January 7, 1991 at 3:45 p.m. in Room 111 of the City
Administration Building, 113 West Mountain Street, Fayetteville,
Arkansas.

)(APPEAL NO. SA91-1 - VARIANCE FROM THE SIGN ORDINANCE
/\MARK RISK - 118 N EAST AVENUE
The only item on the agenda was Appeal No. SA91-1 for a variance
from the sign ordinance submitted by Mark Risk for property located
at 118 N East Avenue. The property is zoned C-3, Central Business
Commercial.
Mark Risk stated that he has been in the real estate business for
several years. He recently purchased a two-story brick building
at 118 North East Avenue and renovated it for his business. He
presented photographs of where his sign is currently located in
relationship to the building. He advised that a visible sign to
the public is required with a real estate business. What he would
like to do is put the sign on the existing metal free-standing arm
that has been there for a number of years. His major problem is
that the building and the sign, where it is currently located,
aren't visible from the street except from directly in front of it
because it is sandwiched in between two Southwestern Bell
buildings. He referred to the diagram included with the agenda
which gives the measurements. He is asking for a variance to put
a sign out where it will be visible. The existing arm sign sets
back 16' from the street curb and about 2' from the rock wall.
His particular sign would be approximately 3' from the rock wall.
He added that another problem he has is that there are three large,
beautiful trees in the yard, which he might have to cut down if he
isn't allowed a variance for his sign. He advised that his sign
is 5.5 square feet and he doesn't think it would be detrimental to
the area or the neighboring properties.
In answer to a question from Mr. Risk, Ms. Bryant stated that the
staff hadn't gotten any complaints about this variance application.
Mr. Risk stated that he hadn't ran in to any opposition to it with
the people he has spoken with in the neighborhood. He presented
some pictures of existing signs on East Avenue and Spring Street.
He noted that in a C zoned district, the setback is 15' for a sign.
However, a building can be built in a C-3 zoning in a downtown area
with a 5' setback. It seems that the sign ordinance is more
directed to the commercial district on North College Avenue and not

to the downtown areas. That encourages people to construct a
building and put up a wall sign which to him are more unsightly
than a free-standing sign. He talked about some existing
signs of businesses in the general location of his office. He
noted that he feels this is a hardship situation because his sign
on the porch isn't very visible.
In answer to a question from Mr. Tompkins, Mr. Risk stated that
his address sign isn't adequate for advertisement. Mr. Tompkins
stated that he is interested in the aesthetic aspect of the
property.
Ms. Wright stated that it is easy to miss the building and she
feels that he does need a more visible sign.
In answer to a question from Mr. Boyd, Mr. Risk stated that he had
not considered using a monument type sign because he wanted to use
the existing pole for cost purposes. He added that there is
metered parking on his side of the street and if a van parked
there, a sign mounted on the ground wouldn't be visible.
In answer to a question from Chair Mills, Ms. Bryant stated that
according to Richard Wilson, Sign Inspector, a variance was given
for the Tradition's sign several years ago by the Board of
Directors.
Ms. Wright stated that there are a lot of businesses in this
commercial district that have the same problem. She agrees that
there should be something written up specifically for that district
that allows some nice signage for properties built so close to the
street.
Mr. Tompkins stated that the sign character for that particular
street is basically free-standing, hanging signs with a certain
harmony to it. He stated that he thinks if this sign were
lowered, it would fit with the other signs in this area.
In answer to a question from Chair Mills, Ms. Bryant stated that
another option would be hanging the sign lower than the tree which
would provide more visibility coming from the south to the north.
Mr. Becker stated that he thinks there is a hardship because Mr.
Risk's building is blocked from view by the other buildings.
MOTION
Ms. Wright moved to grant the variance as requested provided the
sign not be larger than 24" x 29", seconded by Boyd. The motion
passed 4-2-0 with Wright, Becker, Boyd & Davis voting "yes" and
Tompkins & Mills voting "no".
There being no further business, the meeting was adjourned.
