MINUTES OF THE BOARD OF SIGN APPEALS
A meeting of the Fayetteville Board of Sign Appeals was held on
Monday, November 19, 1990, at 3:45 p.m. in Room 111 of the City
Administration Building, 113 West Mountain Street, Fayetteville,
Arkansas.

APPEAL NO. SA90-17 - VARIANCE FROM THE SIGN ORDINANCE
KEN LAZENBY - 1015 NORTH COLLEGE AVENUE
The only item on the agenda was Appeal No. SA90-17 for a variance
from the sign ordinance submitted by Ken Lazenby on behalf of Ultra
Cuts for property located at 1015 North College Avenue. The
property is zoned R -O, Residential -Office.
Ken Lazenby, representing Ultra Cuts, stated that the roof of the
building is 40' x 15' and the sign is 4' x 8'. He presented
• pictures showing the existing signs. He noted that his sign he
is requesting the variance on doesn't obstruct any view or traffic.
It can't even be seen until you get right up to the building.
He noted that there is one sign on the mansard roof and a smaller
sign on the rock.
He added that he wants to keep the sign on the roof and the smaller
one on the rock.

Chairman Mills stated that even if they allowed roof signs, the one
on the roof is oversized. She noted that the ordinance states
that roof signs are not permitted. She added that one sign would
be allowed for each street. The sign that doesn't meet the
ordinance is the sign on the roof. She advised that there is a
sign facing Pollard, a sign facing College, and a roof sign.
Mr. Becker stated that they need to clarify whether or not this is
a roof sign. According to the building code and Richard Wilson,
they can issue a wall sign for any mansard roof where it is 45° or
greater(steeper). Rufino's has the same thing on its mansard
roof. He noted that the Building Department has been issuing wall
signs on mansards for 45° or greater. According to them, this
doesn't fall under roof signs.
Chairman Mills stated that they could take the sign off the rock
and cut the sign on the mansard roof down to meet the square
footage.

There being no one else wanting to speak, the public hearing was
closed.
Mr. Boyd stated that their approval may not be necessary for a 4'
x 4' sign where the 4' x 8' sign is.
Mr. Waldren stated that he would be allowed one sign for each
street that meets the square footage.
MOTION
Mr. Boyd moved to allow one sign placed on the mansard roof facing
College Avenue that doesn't exceed 16 square feet with the removal
of all other signs facing College Avenue, seconded by Waldren. The
motion passed 5-1-0 with Mills, Waldren, Boyd, Becker, & Davis
voting "yes" and Wright voting "no".
There being no further business, the meeting was adjourned.
