HomeMy WebLinkAbout1988-12-19 MinutesMINUTES OF THE BOARD OF SIGN APPEALS A meeting of the City of Fayetteville Board of Sign Appeals vas held on Monday, December 19, 1988 at 3:45 p.m. in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Don Mills, Robert Davis, Gerald Boyd, Larry Tompkins and Dennis Becker MEMBERS ABSENT: Robert Waldren OTHERS PRESENT: Gerald Oney and Elaine Cattaneo SIGN APPEAL 8 SA88-19 - TACO BELL RESTAURANT GERALD ONEY - SOUTHWEST CORNER OF HOLLYWOOD & W 6TH ST The first item on the agenda was a request for a variance to the Sign Ordinance (Article 17, Section 17B-9) submitted by Taco Bell Restaurant and represented by Gerald Oney and located at the southwest corner of Hollywood and West 6th Street. Property zoned I-1, Light Industrial & Heavy Commercial. Mr. Oney stated that he is a registered professional engineer and he does a lot of the frontend work required to put together a Taco Bell project. He noted that his company is also the general building contractor.. -:Basically, Taco Bell has three major signs that they use including a 97 square foot sign, a 196 square foot sign and a 280 square foot sign. He added that they also have a 60 square foot sign. He stated that when he proceeded in submitting this to the City, he was told that he was in violation because the ordinance says 75 square feet is what is required. Then they looked at it and said the word "drivethru" is on there and that is considered "directional" so it wouldn't be included in the square footage. Therefore, they are really not that much in violation in all reality. He stated that he has actually measured the "drivethru" portion and they are 2.76 square feet in violation above the required 75 square feet. With that in mind and the fact that they are within the required setback and height limitations and in conversation with individuals in the Planning Department, he submitted for a variance to allow them to use their standard sign rather than having a regular sign made up. He advised that he submitted it with the sole intent of trying to use the standard sign that they would have shipped in. Mr. Tompkins asked Mr. Oney if he thinks that 60' square sign given the curvature going east from the Bypass will decrease that much from the purpose of the sign. Mr. Oney stated that in all honesty, that is a spatial -built sign. What they would like to do is put as much of a sign on there as any business would that they would be allowed. Mr. Tompkins stated that in other words the effective display of the sign is not going to hinder that much. Mr. Oney stated that they would only be 2.76 square feet less if they build a new sign. 53 Board of Sign Appeals December 19, 1988 Page 2 The Public Hearing was closed. Mr. Boyd stated that if they granted this, it would open the door to everyone in town. Then they would have to decide how much is fair. Mr. Davis agreed that they have to be consistent. Mr. Tompkins stated that the reduction of the 75' square itself isn't going to detract the effective display of the sign which is to encourage business. MOTION Mr. Tompkins moved to deny the request, seconded by Davis. The motion passed 4- 0-0. MINUTES The minutes of the meeting of November 21, 1988 were approved as distributed. There being no further business, the meeting was adjourned. • 59
