HomeMy WebLinkAbout1993-10-05 MinutesA special 5, 1993, Building, PRESENT: MINUTES OF A POLICE PENSION BOARD MEETING meeting of the Police Pension Board was held on October at 2:00 p.m. in Room 326 of the City Administration 113 W. Mountain, Fayetteville, Arkansas. Eldon Roberts, Hollis Spencer, Clint Hutchens, Dr. James Mashburn, Mayor Fred Hanna, City Clerk Sherry Thomas, and City Treasurer Glyndon Bunton ABSENT: Jerry Friend CALL TO ORDER • The meeting was called to order by Mayor Hanna. He stated the purpose of this special meeting is to discuss the medical retirement request made by Don Kilgore. DON KILGORE MEDICAL RETIREMENT REOUEST Bunton asked if Don Kilgore's medical problem was originally noticed and brought to the attention of the Police Department in February of 1991. Kilgore stated that was correct. He stated that was when he had surgery on his shoulder. Roberts stated on August 19, Kilgore filed for disability retirement. He presented the Board with medical information from his family doctor and from a physical therapist. Dr. Mashburn requested Kilgore be examined by an orthopedic surgeon and also provide the Board with a copy of his neurological evaluation. Mr. Kilgore has done all of the things he was requested to do. Dr. Mashburn stated he would like for Don to tell the Board about his problems. Don Kilgore stated he has had a problem with tendinitis in his elbow for some time and had shoulder surgery in February of 1991. Since the surgery, he has never had the confidence in the strength of his arm. The first night back to work after surgery, he lost hold of a man he was arresting. In March or April of 1993, his elbow flared up again. He has done everything possible he knows to do to rehabilitate himself. He has had over 20 therapy treatments and various drug treatments as well to try and help his shoulder and arm. Dr. Mashburn asked if he could do things around the house, for example, yard work. Kilgore stated his wife has had to get a job, and he now stays home and babysits. He stated his doctors have told him that he will not be able to do repetitive work like factories, etc. • • October 5, 1993 Dr. Mashburn stated he did not want to retire Kilgore from police work and then find out later on that he has gone back to work at a job that might even be more difficult that police work. Roberts asked Kilgore how long he has been off this time with his shoulder and arm. Kilgore stated he has been off work since June 19 or 21 of this year. Roberts asked how much sick leave time he had left. Kilgore stated all of that has been exhausted, and he has no pay left. Spencer asked Dr. Mashburn if he had any medical observations. Dr. Mashburn stated in the report from Dr. Moore, he has lateral epicondyle of the right elbow. All of this ties in together. He has had a history of these types of problems for a long time. The injuries are not job related. Kilgore has had surgery to his shoulder, but his original strength has not returned. He agrees with Dr. Moore's disposition when he states that he does not feel Don could recover enough to return to police work. Dr. Mashburn stated he called and talked with Dr. Moore about this case. Dr. Moore stated there were really no bad findings of anything wrong with Kilgore. However, in talking with Dr. Moore, he felt Don would have some problems on his job. Dr. Moore stated there were some things that might be done to help improve Don's shoulder, but he stated Don feels in his own mind that he has done everything possible to help, and has not had good success. If Don does not feel that he would be any better with any more surgery, etc., he would not be. Dr. Mashburn, seconded by Spencer, made a motion to grant medical disability retirement to Don Kilgore. Mayor Hanna stated he is not qualified to`do anything but rely on the doctors' opinions. Dr. Mashburn stated he did so as well, and he feels even more sure of granting this retirement after he talked with Dr. Moore. Mayor Hanna stated the Board has two options: retire him or deny the retirement. If they deny the retirement, the Board is asking. him to come back to work with a medical problem that Kilgore does not feel will let him perform his job adequately. • Spencer asked if Kilgore could get clearance from his doctor so he could come back to work at the Police Department. •
