MINUTES OF A MEETING OF THE
PLAT REVIEW COMMITTEE
A regular meeting of the Plat Review Committee was held on January 23, 1996 at 9:00 a.m. at the City
Administration Building at 113 West Mountain, Fayetteville, Arkansas, in Room 111.
MEMBERS PRESENT: Dennis Burrack, Rick Evans, Kevin Leflar, and
Andy Calloway
STAFF PRESENT:

Randy Allen, Mickey Jackson, Nancy Dugwyler, Jim
Beavers, and Perry Franklin.
PP96-1 - MARVIN GARDENS, PHASE I
ROBERT WESTPHAL - S OF MEANDERING, W OF CROSSOVER
The first item on the agenda was the preliminary plat of Marvin Gardens, Phase I submitted by Jorgensen &
Associates on behalf of Robert Westphal for property located south of Meandering Way, west of Crossover Road
and zoned R-1, Low Density Residential. The property contains 10.024 acres with 25 proposed lots.
Ms. Little stated that the Planning Commission had previously denied the plat.
Mr. Beavers noted the developer had failed to submit as built plans on other projects and in accordance with his
memorandum regarding same, he requested that the plat be pulled from the agenda.

LS96-1 - J.E. LINDSEY FAMILY LIMITED PARTNERSHIP
S OF JOYCE, E OF H W Y 71B
The next item on the agenda was the lot split for J.E. Lindsey Family Limited Partnership for property located on
the south side of Joyce, east of Highway 71B aka lot 10 of Vantage Square, Unit 2.
Ms. Little stated that the utility representatives had previously requested to review lot splits and staff was now
providing 'same for their review. Ms. Little stated there was an existing structure on the tract and requested that the
utility review sante to provide the necessary easements to provide service.
Discussion ensued regarding drainage issues.
Ms. Little stated the request should be placed on the Planning Commission agenda.

SOUTH SCHOOL AVENUE
The next item on the agenda was the property line adjustment submitted by Central Emergency Medical Service for
property located on South School.
Ms. Little stated the request was approved administratively and would not go before the Commission.
Ms. Little stated the property was located south of Sixth Street (Hwy. 62) along the west side of the road and there
were three buildings on the subject property. Ms. Little stated the property line would move 11.2' to the north.
Discussion ensued regarding the alley way and Arkansas Railroad right of way along the edge of the property. Ms.
Little stated the applicant intended to use same for access to Sixth Street and inquired if there were any serves in the
right of way area. Mr. Burrack noted the survey and the plat page did not reflect the same situation and Ms. Little
noted that it was not unusual. Discussion ensued.
Mr. Burrack with SWEPCO stated they had service in part of the right of way which had not been abandoned. He
noted they were serving overhead and that the line ran along the south property line and crosses the easement along
with west.
Ms. Little directed Mr. Lane to contact the applicant and request that they get the matter clarified and resolved
according to the requirements of approval for the previously approved conditional use.
Mr. Evans noted Arkansas Western Gas had a 2" underground line along the south side serving the subject property.
He stated any relocation would be at the expense of the owner.
Discussion ensued regarding proposed construction of a vehicle bay on the south side of the property.
Ms. Little further directed Mr. Lane to inform the applicant that no building permits would b issued until they met
the requirements of the conditional use including resolution of the issues set forth above by the utility
representatives.

PLA - SPENCER & MARTHA ALBRIGHT
J.D. SWEETSER SUBDIVISION
The next item on the agenda was the property line adjustment submitted by Spencer & Martha Albright for property
located in the J.D. Sweetser Subdivision.
Ms. Little stated the property line adjustment would be approved administratively and therefore would not go to the
Commission for consideration.
Mr. Burrack requested that the existing easement remain. He stated there was a 25' easement extending across the
property for underground service.
Mr. Beavers statedthe sewer easement had been dedicated for extension of the sewer line and he further stated that
all easements would remain unless they were vacated. He stated the reason for sewer extension was upon
requirement from the Arkansas Health Department.
Discussion ensued regarding development options for the subject tract and Mr. Calloway requested that something
be filed of record at the courthouse to assure the easements would remain.
Ms. Little requested that the survey reflect a 10' easement between lots 3 and 4 and a 10' offsite easement to the
west. Further Ms. Little stated that in light of the discussion regarding preservation of easements, she requested that
the applicant check to be sureathe easements were dedicated by separate instrument to preservetame.
Ms. Little stated the procedure of approving lot splits and property line adjustments prior to plat review would be
ceased in light of the discussions which previously ensued. Further, she directed staff to amend the application
check list to ensued that all easements be included in the survey.

LSD96-1 - NORTHWEST VILLAGE
SECOND CENTURY INVESTMENTS - EAST OF 71B, N OF SHEPARD, S OF ZION
The next item discussed was the large scale development for Northwest Village submitted by Second Century
Investments for property located east of Highway 71.
Ms. Little stated that the square footage of Anchor E had been increased to 1200 square feet but that parking
requirements were met.
Mr. Pitman stated this request to accommodate the Pet Care store.
Ms. Sandeen inquired if the landscaping had been amended to reflect changes to the parking. She requested that the
plans reflect 6 trees in the T separation between the parking and the street right of way.
Mr. Calloway inquired if the subject plat would supersede the prior one and Ms. Little responded that it would. He
noted that no easements were shown. Ms. Little explained that the final plat of which this large scale development
is a part of would not be required to reflect the easements because the easements were recorded as a part of the final
plat. Further she stated large scale development plats required that an easement plat be filed at the courthouse to
reflect the locations of the easements as an as built plat.
Mr. Beavers asked Mr. Pitman if he was awarethere had been a problem in obtaining as builts and easement plats
for the subject structures and Mr. Pitman statedhe was not aware of this problem but would make sure that the
requested plats were submitted. Mr. Beaver noted there were many concerns regarding water and sewer issues
which were not addressed and he noted the easement plat reflected easements which needed to be abandoned and he
was not aware that process had been initiate. Ms. Little requested that these issues be addressed and resolved prior
to Subdivision Committee on February 1, 1996 and if at that time there was not resolution, the large scale would be
pulled.
Mr. Calloway expressed concem regarding the easements and inquired as to what he was to approve today. Ms.
Little instructed that the applicant get with Andy Calloway and provide the Planning Department a letter stating all
the easement issues had been addressed and were approved by Southwestem Bell.
Mr. Evans with Arkansas Western Gas requested that the easements be shown on the large scale development. He
stated Anchor E had been served and they would need to be contact'(o move it and he stateeinY relocation costs
would be at the expense of the developer. He stated there was 1.25" line and requested the required gas load.
Mr. Jackson inquired if the building would be sprinklered and Mr. Pitman stated it would not be sprinklered.
Mr. Franklin requested that the entry throat be yellow striped along the entry point at Old Shepard Lane.
Ms. Little noted the plat reflected an area marked tree preservation but that it is not park land but right of way.
Ms. Little requested 37 copies of the plat by Monday, January 29, 1996 reflecting the following changes.
1. Easement locations.
2. Striping of the entry point at Old Shepard lane.
3. Letter of acceptance of easements from Mr. Calloway at Southwestern Bell.
