A meeting of the Fayetteville Plat Review Committee was held on Thursday,
December 8, 1994 in Room 111 of the City Administration Building, 113 West
Mountain Street, Fayetteville Arkansas.

FINAL PLAT - TAMMY SUBDIVISION
DALE YOUNGMAN - N OF ZION, E OF HWY 265
The first item was a final plat for Tammy Subdivision submitted by Dale Youngman,
for property located north of Zion and east of Highway 265. The property is zoned
A-1, Agricultural and contains 7.74 acres with 2 proposed lots.
ALETT LITTLE - CITY PLANNER
Ms. Little requested that Mr. Youngman, per the in-house plat review comments,
ask his surveyor to add four items: a 200 foot setback line; a dedication form;
zoning to be shown on the plat; and the use of the property to be shown on the
plat. She pointed out Mr Youngman had initially wanted to do a lot split but,
because there had already been three previous lot splits creating four lots, the
city was unable to split the lot further.
DAVID REESE - ARKANSAS WESTERN GAS
Mr. Reese stated that they had a main line on the opposite side of the road and
they would bring service over to the subdivision.
Ms. Little stated it was her understanding the subdivision was all electric.
Mr. Youngman agreed.
TIM JOHNSON - WARNER CABLE
Mr. Johnson had no comments.
CHRIS VAUGHT - OZARK ELECTRIC
Mr. Vaught had no comments.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway had no comments.
JOHN HILL - SWEPCO
Mr. Hill stated there was a transmission line on Tract 2 which appeared to be
drawn incorrectly on the plat. He explained the line was actually 58 feet on the
north side and 52 feet on the south side of the fence line. He noted there should
be a 100 -foot easement.

ALETT LITTLE - CITY PLANNER
Me. Little informed Mr. Youngman he needed to show the easement on the plat. She
further stated there would be a parks fee assessed against the new lot in the
amount of three hundred dollars.

LARGE SCALE DEVELOPMENT - ARKANSAS WESTERN GAS COMPANY
ARKANSAS WESTERN GAS COMPANY - SOUTH OF BORICK AND EAST OF ARMSTRONG
The next item was a large scale development for Arkansas Western Gas Company
submitted by Gary Rawl, Hight Jackson Associates on behalf of Arkansas Western
Gas Company for property located south of Borick Street and east of Armstrong
Road. The property contains 1.25 acres and is zoned I-2, General Industrial.
ALETT LITTLE - CITY PLANNER
Ms Little explained the dimensions on all of the streets adjacent to the
development needed to be shown on the plat. She also pointed out that, just
north of the Administration Building, there appeared to be a new 1.5 inch water
service line. She explained the fire chief had requested the line be at least six
inches in size and the fire hydrant be located at the northeast part of the
building.
Mr. Rawl inquired whether the hydrant could be located on the street.
Ms. Little stated Mr. Rawl could discuss the matter with Mickey Jackson, the fire
chief.
Ms. Little stated contour lines were shown but additional work was needed to get
a preliminary grading plan. She requested Mr. Rawl contact Jim Petty in
Engineering to work on any potential problems. She also asked why the parking
areas were not connected.
Mr. Rawl responded the unconnected side was a service access for utility
personnel and additional traffic in that area was not desired by the Gas company;
that the building in that area would not be open to the public and would only be
accessible to utility and construction personnel through a security gate.
Ms. Little said she understood it would not be a public building but that they
still might want to consider connecting the parking for convenience.
Mr. Rawl replied that it was not a major issue and the road could be connected
if the city desired it.
Ms. Little also expressed concern regarding the lighting since there was a single
family residence across the street from the subject property. She noted the
facility was planning on power poles with flood lighting in two locations. She
advised the city requested only high pressure sodium lighting be used and that
it be downlighted.
Mr. Rawl agreed.
Ms. Little advised that, prior to subdivision meeting, Mr. Rawl would need to
notify adjoining property owners of the subject development and add their names
on the plat with their property lines indicated. She further noted that, as a
part of the process, an easement plat would have to be filed. She also asked if
there would be dumpster site at the new location.
Mr. Rawl explained the existing dumpster site would be sufficient for the entire
complex.

JOHN HILL - SWEPCO
In response to a question from Mr. Hill, Mr. Rawl advised the pole and
floodlights shown on the plat were new.0
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway requested a 15 foot utility easement along the west and south
property line parallel to Armstrong and Black Oak. He explained Southwestern
Bell currently had an entrance cable to the construction maintenance building at
the new location and an inside building terminal. He stated that would
constitute one point of entry and a demarcation point. He went on to say
Southwestern Bell could not serve the building unless Arkansas Western Gas wanted
to pay for relocation of the demarcation point so that all of the buildings could
be served from one point of entry. He also noted the cable was not sized to
serve the new project and that they would need to talk about ultimate
requirements and the expense of reinforcing the new cable.
MANDY BUNCH - CITY ENGINEERING
Ms. Bunch advised a grading application and drainage report were required She
also asked if the parking lot was going to be curbed.
Mr. Rawl responded they planned to curb the lot and would also be improving the
ditch existing on the east side of the property by paving it.
Ms. Bunch noted the slopes looked extreme and the contouring looked preliminary.
Mr. Rawl stated there would be an extreme drop on the north side.
In response to a question from Ms. Bunch, Mr. Rawl advised they had additional
contour information but it was not shown on the plat.
Ms. Bunch advised the developer could use the right-of-way to grade out if
needed. She explained the right-of-way could be used to minimize their slopes
since it appeared some of the slopes were 2:1.
TIM CONKLIN - CITY PLANNING
In response to a question from Mr. Conklin, Mr. Calloway advised the easement
requested by Southwestern Bell would be a general utility easement.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway stated that he needed a four inch conduit across the new entrance.
He also noted there was an existing buried cable which it could be relocated at
owner expense.

LARGE SCALE DEVELOPMENT - SHILOH MOTEL
LAWRENCE HONG - WEST OF SHILOH ROAD, NORTH OF OLD FARMINGTON ROAD
The next item was a large scale development for the Shiloh Motel
Dennis Becker on behalf of Lawrence Mong for property located west
north of Old Farmington Road. The property contains 2.86 acres and
Thoroughfare Commercial.
There was discussion regarding the overhead electric lines being placed at the
rear of the property. Mr. Becker reviewed the plans and pointed out the area the
lines would be underground.

Mr. Becker also noted that, after talking to Jeff Jones of the State Highway
Department, the developer had decided to change the entrance, with possibly two
access roads, maximum 24 feet each with a 25 foot island.
Ms. Little noted the developer would have to apply for a waiver since that did
not comply with the overlay ordinance.
Mr. Conklin suggested having one access be an entry and the other being an exit.
Mr. Becker also noted the plans had changed from 61 units to 96 in two phases
with the first phase having 64 units. He noted the second phase would be
constructed within two years. He requested approval of both phases so they would
not have to go through the large scale development process again in two years.
ALETT LITTLE - CITY PLANNER
Ms. Little explained the city currently had no length of time for which an LSD
approval was valid but she expected that, within the two year time frame, there
would be a time limit. She expressed her belief that, if Mr. Becker submitted an
LSD two years from now which exactly matched the current one and the changes
in the city rules were not significantly different, she could not imagine he
would be required to go through the large scale development process again.
DAVID REESE- ARKANSAS WESTERN GAS
Mr. Reese advised his closest line to the development was at the corner of Old
Farmington Road and Shiloh. He further noted he planned on running the service
on the front of the property.
Mr. Becker stated he had been informed service would be from the back of the lot
but acknowledged there was a 35 -foot easement on the front.
In response to a question from Ms. Little, Mr. Reese advised the meters would
probably be set in the green area

Mr. Calloway advised he planned to bring his line along the front but he could
place his line wherever the easement was located.
After discussion, Mr. Becker advised he would show a 25 -foot easement on the
south all the way to the wall.

TIM JOHNSON - WARNER CABLE
Mr. Johnson advised he would follow SWEPCO's route into the building or into the
pole if a pole was set. He noted he would need a two inch conduit from a control
room to the easement.
Ms. Little asked the location of the control room.
Mr. Becker replied that it would be located between the two units.
Mr. Johnson advised the owner would need to contact his office to set up an
agreement for cable service.
In response to a question from Me. Little Mr. Becker said that they would be
relocating the stairs so the unit could go under them.
JOHN HILL - SWEPCO
Mr. Hill advised the developer could determine the location of the transformer
but, if he would need a vault if there was a right angle turn. He noted he would
assume the developer would want the transformer set due south of the control
room.
Mr. Becker agreed and noted it could be placed in one of the parking spaces which
would be screened with vegetation.

Mr. Calloway requested a 2 -inch conduit from the control room to the easement
together with a 4 -inch conduit under the driveway. He noted the plat showed a
50 -foot easement and building setback along the east property line.
Mr. Becker explained the easement was 35 feet and the building setback was 50
feet.
PERRY FRANKLIN - TRAFFIC
Mr. Franklin advised he did not see a problem with traffic at the site but was
concerned regarding a variance for the driveway since the development would be
96 unit motel.
Ms. Little expressed her belief the configuration that Mr. Becker had in mind
was a wider drive with separated lanes for entry and exit, which would be
considered as one driveway. She noted a variance request would not be needed.
Mr. Becker advised the State Highway Department would not allow separation
between drives be less than 25 feet. He also noted the only signage could be
"in" and "out".

Ms. Little requested the location of the dumpster be noted on the plat.
Mr. Becker indicated the location and advised it would be enclosed.

Ms. Little clarified there would be no gates on the dumpster just screening. She
noted the city solid waste division prohibited gates on dumpsters but understood
there was a federal policy requiring gates. She advised the city would be
looking more closely at this policy.
TIM CONKLIN - CITY PLANNING
Mr. Conklin noted the right-of-way scale needed to be changed from 80 feet to 60
feet
Me. Little noted that the slope on the property would have to be stabilized.
Mr. Becker explained they were in the process of soil testing and, when it was
completed, they would submit a grading plan and stabilize the slope.
MANDY BUNCH - ENGINEERING
Ms. Bunch noted the slope looked more extreme during on-site inspection than it
did on the plat. She further noted there was some erosion on site.
Mr. Becker gave her a contour report from WBI.

FINAL PLAT - BROOKHAVEN ESTATES
BMP DEVELOPMENT - N OF STUBBLEFIELD, W OF OLD MISSOURI RD.
The next item was a final plat for Brookhaven Estates submitted by Mel Milholland
on behalf of BMP Development Inc. for property located north of Stubblefield and
west of Old Missouri Road. The property contains 32.75 acres with 57 lots and is
zoned R-1, Low Density Residential.
ALETT LITTLE - CITY PLANNER
Ms. Little noted Lot 43 was a tandem lot and the access had changed since the
preliminary plat. She advised the 25 -foot utility and access easement was
difficult to find on the plat. She requested the notation on the plat be made
larger.
There was then discussion regarding the location of the electric lines and the
height of the lines.
Tim Johnson, Warner Cable, explained that, whenever a line was cut through, the
relocation of the line would be at the owner's expense if they had to raise the
pole or go underground.
Mr. Milholland then reviewed the quad locations with the utility company
representatives.
DAVID REESE - ARKANSAS WESTERN GAS
Mr. Reese requested a quad at the entrance to Brookhaven Drive between lots 1 and
55 on the far east side and on the middle of Lot 52 over to lots 57 and 56. He
asked if the gorge would be filled in.
Mr. Milholland explained the gorge would be left intact.
Mr. Reese requested a crossing from lot 32 to lot 45. He noted they would serve
lot 42 and lots 50 to 54 from the front.
TIM JOHNSON - WARNER CABLE
Mr. Johnson advised the easements shown were fine.
JOHN HILL - SWEPCO
Mr. Hill advised the easements and crossings were fine. He noted they would
serve lots 39 to 45 and lots 50 to 54 from the front.
There was then discussion as to whether the sewer line could be crossed.
Mr. Milholland explained the sewer line was five feet over on private property
with a 15 foot utility easement.
PERRY FRANKLIN - TRAFFIC
In response to a question from Mr. Franklin, Mr. Milholland advised the developer
had discussed placing some non-standard street lighting.
Mr. Franklin advised the developer needed to contact him.
There was some discussion regarding the boundary between Ozark Electric and
SWEPCO being in the middle of the subdivision since they did not have the same

type of light fixtures. Mr. Milholland advised he was sure the developer would
want the same lights throughout the subdivision.
The representatives from the electric companies said they would work something
out
Mr. Franklin noted the 25 -foot easement between 45 and 44 was not labeled. He
also requested the street light between lots 14 and 15 be moved to between lots
41 and 42. He also advised there was no street light at the intersection with
Old Missouri Road.
Mr. Milholland advised there would be work done on that corner.
Ms. Little said she felt it was important there be a street light on that corner.
Mr. Milholland advised he believed the developer planned on lighting the corner.
He further advised there was a street light across the street on Sweetbriar in
the center island. He said he would talk to the developer to verify his plans.
ANDY CALLOWAY - SOUTHWESTERN BELL
Mr. Calloway noted that, in addition to the crossings already requested, he
wanted one on the south end of Lots 1 and 2 across Southridge and also on the
south ends of Lots 26 and 27 across Brookhaven. He also requested the 20 foot
utility easement be extended across the south property line of lot 27. He noted
that, from lots 32 through and including lot 45, there were different dimensions
of utility easements. He requested the easements be a minimum of 20 feet along
the length of those lots.
Ms. Little commented the length of the easement was 15 feet from lot 45 to lot
34 and then jumped to a 30 foot easement.
Mr. Calloway noted the easement then dropped back to 15 feet. He advised there
were off-site easements being discussed on Yorktown Square.
Mr. Milholland noted there was an existing 25 -foot easement along Yorktown
Square.
Mr. Calloway suggested a 10 -foot easement on the subject subdivision and 10 -foot
easement on Yorktown Square.

Mr. Vaught requested the easement between lots 16 and 18 be extended to the cul-

TIM CONKLIN - CITY PLANNING
Mr. Conklin explained the city would need a separate easement document for the
right-of-way access.
Ms. Little pointed out the off-site easements would also need to be by separate
document if not incorporated into a subdivision.
In response to a question by Mr. Conklin, Mr. Milholland advised the sidewalks
would be on the south side the street throughout the subdivision.
Mr. Conklin reminded Mr. Milholland that, before the final plat could be filed
with the County Clerk, the city would require the sidewalk construction funds be
placed into an escrow account. He also requested a vicinity map be placed on the
plat.
In response to a question by Ms. Little, Mr. Marquess advised the bridge should
be complete in approximately 2 weeks, depending upon the weather.
There was then discussion regarding the drainage easements to be assumed by the
POA for maintenance.
Mr. Conklin asked if there had been an agreement made regarding the construction
and maintenance of the cul-de-sac.
Ms. Little requested the developer talk to the City Engineer regarding the cul-
de-sac.
