HomeMy WebLinkAbout1994-10-27 Minutes• • MINUTES OF A PLAT REVIEW MEETING A meeting of the Fayetteville Plat Review Committee was held on Thursday, October 27, 1994 in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. UTILITY REPRESENTATIVES: CITY REPRESENTATIVES: Dennis Burrack, Andy Calloway, Sonny Hudson, Chris Vaught, and Tim Johnson Alett Little, Don Bunn, Tim Conklin, Perry Franklin, Mandy Bunch, Mickey Jackson and Sharon Langley OTHERS PRESENT: Kurt Jones, Rick Pulverenti, Robert Brown, and LARGE SCALE DEVELOPMENT - DRY CLEAN SUPER CENTER KWIK INDUSTRIES - WEST OF COLLEGE, SOUTH OF APPLEBY The first item was a large scale development for a Dry Clean Super Center submitted by KWIK Industries for property located West of College, south of Appleby. The property is zoned C-2, Thoroughfare Commercial, and contains 34,379.74 square feet. This item is going through the large scale development process at the request of the Planning Commission. DENNIS BURRACK - SWEPCO Mr. Burrack advised there was an existing 3-phase line behind the site which contained adequate capacity for the subject development. He stated he did not need any additional easements. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway stated there was conduit under the KWIK Kar Lube parking lot to serve the subject development. In response to a question from Ms. Little, Mr. Calloway explained the conduit belong to KWIK Industries and was their responsibility. TIM JOHNSON - WARNER CABLE Mr. Johnson had no comments. SONNY HUDSON - ARKANSAS WESTERN GAS Mr. Hudson advised there was an existing 2 -inch gas line along College PERRY FRANKLIN - TRAFFIC DIVISION Mr. Franklin had no comments. Avenue. Ms. Little pointed out there would be a shared entrance off of College Avenue with KWIK Kar Lube and an additional entrance to the rear. TIM CONKLIN - PLANNING DIVISION Mr. Conklin had no comments. Ms. Little advised that, since a representative for KWIK Industries was not present, this item would be heard again at the next Plat Review meeting. Plat Review Meeting • October 27, 1994 Page 2 • • PRELIMINARY PLAT - HIGH POINT SUBDIVISION HIGH POINT DEVELOPMENT - S OF OLD FARMINGTON, N OF RUTLEDGE The next item was a preliminary plat for High Point Subdivision submitted by Rick Pulverenti on behalf of High Point Development for property located south of Old Farmington Road, north of Rutledge Lane. The property is zoned R-2, Medium Density Residential, and contains 3.03 acres with 12 proposed lots. Me. Little advised that, per the 9-1-1 Coordinator Jim Johnson, the name of the proposed street would have to be changed. DENNIS BURRACR - SWEPCO Mr. Burrack advised there was an existing overhead line running on the east side which appeared to run out of the easement. Ms. Little stated staff had asked that easement be adjusted. Mr. Pulverenti noted the developer did want underground service. Mr. Burrack stated he believed they could serve the property underground but he would have to do some checking. He requested a 10 -foot easement between lots 5 and 6 for a street light. He also requested that the 15 -foot easement shown around the perimeter of the lot be enlarged to 20 feet. It was noted the building setback at the rear of the property was 25 feet and the utility representatives requested 20 of the 25 feet be labeled as a utility easement. Mr. Pulverenti expressed concern noting the building pad on some of the lots were not very large. Ms. Little advised he could apply for a variance with the Board of Adjustment and recommended he request a variance for the front setback rather than the rear which would give room for the utility easement. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway stated his first concern was the easements labeled utility and drainage. Mr. Pulverenti advised those easements had been changed and stated the west side of lots 9 to 12 there was a 15 -foot utility easement (no drainage easement); a 15 -foot utility easement along the west side of lots 7 to 9; a 12 -foot drainage easement along the north boundary of lot 12; a 15 -foot utility easement along the east side of lots 1 through 4; a common drainage and utility easement or two separate easements along the east side of lots 5, 6, and 7 (the drainage easement would be for a swale); and a 15 -foot drainage easement between lots 3 and 4. Ms. Little noted Randy Allen, Street Division, preferred 15 -foot easements for drainage. She requested Mr. Pulverenti contact Mr. Allen and coordinate the drainage easements. In response to a question from Mr. Calloway, Mr. Pulverenti explained there was a gentle swale on the east side of lots 5, 6 and 7 which was narrow and shallow which would divert the drainage flow from the mini -storage. Plat Review Meeting • October 27, 1994 Page 3 Mr. Calloway expressed concern there would need to be two crossings under the driveways if the buildings were served from the front unless the developer agreed to limit the wiring to the ends of the units. He stated he would prefer rear lot service. He requested an easement on the west side of Lot 12 and the easement along the north side of the site be extended to across lot 1. He also requested a crossing. • Mr. Hudson also requested various crossings. TIM JOHNSON - WARNER CABLE Mr. Johnson stated the easements, as discussed, were fine. He noted the cost of installation of the cable would be 90 cents a foot if installed at the time of development. SONNY HUDSON - ARKANSAS WESTERN GAS Mr. Hudson advised he would need an easement between lots 11 and 12 and 4 and Ms. Little stated she believed they needed to resolve the utility easement on the south side of lots 7, 8 and 9. She pointed out there would be a 25 -foot setback there should be no problem in increasing the easement from 15 to 20 feet. PERRY FRANKLIN - TRAFFIC DIVISION Mr. Franklin had no comments. Ms. Little asked if he had looked into the complaint of traffic congestion on Rutledge. Mr. Franklin stated he had looked at the site and there was a very steep grade on the west end of Rutledge which he believed would be a problem. Me. Little noted there would not be a grade problem if the road went to the south but agreed the road could not go to the west. There was discussion regarding the purchase of Lot 6 in Rutledge Addition in order to connect High Point Trace with Rutledge. Ms. Little explained the residents of Rutledge Subdivision had forwarded a petition to Mr. Franklin (containing 8 signatures) complaining about accessing Highway 62. She stated Rutledge lined up with the east access line of Wal-Mart and the residents on Rutledge were unable to make left hand turns. MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson requested the fire hydrant located at the end of the cul-de-sac be moved to between lots 11 and 12. He further requested the fire hydrant on Old Farmington Road be shown on the plat. In response to a question from Ms. Little, he stated if they could get access to Rutledge they should do so. He explained it was always advantageous to have more than one way in and out of a subdivision. Mr. Pulverenti stated he did not believe the owner would want to add another access due to the cost. • Plat Review Meeting October 27, 1994 Page 4 Ms. Little suggested Mr. Pulverenti research the matter and do some preliminary work to see if the number of lots could be maintained if the street went through. TIM CONKLIN - PLANNING Mr. Conklin reminded Mr. Pulverenti the Parks Board had recommended money in lieu of land which was payable within 30 days of final plat approval. He also noted sidewalks were to be installed by the developer at the time 50% of the lots were developed and money for the sidewalks needed to be placed in escrow at the time of final plat approval. Ms. Little requested the sidewalks be shown on the plat (including Old Farmington Road. DON BUNN - CITY ENGINEERING Mr. Bunn stated he needed to talk with Mr. Pulverenti regarding drainage. He advised the developer had agreed to off-site improvements (curb and gutter along Old Farmington Road). • • • Plat Review Meeting October 27, 1994 Page 5 • LARGE SCALE DEVELOPMENT - WINDSOR SUITES HOTEL & PRELIMINARY PLAT - BHAKTA HOTEL PROJECT MAJOR INVESTMENTS - E OF HWY 71, S OF HWY 62 The next item was a large scale development for Windsor Suites Hotel submitted by Kurt Jones, Northwest Engineers, and a preliminary plat for Bhakta Hotel Project submitted by CEI Engineering to be located east of Highway 71 and south of Highway 62. The property is zoned C-2. The subdivision contains 11.34 acres with 3 proposed lots and the large scale development contains 5.15 acres. Ms. Little advised easements would be created as a portion of the Large Scale which would also need to be included as part of the preliminary plat. There was discussion regarding holding the preliminary plat for two weeks but it was determined the owner needed the preliminary plat approved due to financing. Ms. Little requested a street name for the east -west street. Mr. Jones advised they did not have a name as yet. Ms. Little noted the developer would only be constructing the street as far as the entrances. She also requested the property ownership shown on the plat be corrected as well as the legend on the 100 -Year and 500 -year Flood Plain. DENNIS BURRACK - SWEPCO Mr. Burrack pointed out the overhead power line along the north boundary. He asked for a projection of the loads. He also asked if there would be a restaurant in the hotel. Mr. Jones advised there would not be a restaurant in the hotel. Ms. Little noted a restaurant was planned for the adjoining lot to the south. Mr. Burrack stated there were numerous easements shown on the plat but they all belonged to the City of Fayetteville for sewer and water. He requested an additional 20 -foot easement along the east side of the property, adjacent to and west of the water and sewer easement. He stated the easement would have to be along the edge of the creek. Ms Little suggested an off-site easement to the east. Mr. Burrack was agreeable to that suggestion. In response to a question from Mr. Calloway, Ms. Little explained tract 1 of the subdivision was the large scale development. Mr. Burrack requested a 20 -foot easement the entire length of tract 1. He asked if the developer had a preferred point of service (he suggested the northeast corner). He noted the developer would need to provide the conduit and a concrete pad. He asked about lighting. Mr. Franklin stated one was needed at the intersection and one at the back of the driveway. Mr. Burrack stated he would not need any additional easements. • Plat Review Meeting October 27, 1994 Page 6 • • ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway requested that, parallel to the south side of the street the 25 - foot building setback be shown as a setback and utility easement. Me. Little advised this development was under the design overlay district which required a 25 -foot greenspace area. She suggested the utilities could use 10 feet with care. She asked why they could not use the 9 1/2 feet of the right-of-way. Mr. Calloway explained there was a problem with using city right-of-way because if the city desired to widen the roadway the utilities would have to be moved at the utility companies' cost. Ms. Little advised it was very doubtful the subject street would ever be widened. Mr. Calloway pointed out there was a 25 -foot water and sewer easement in the greenspace area. Ms. Little replied that line was existing. In response to a question, Ms. Little advised tract 1, lot 1 would not be further subdivided but tract 2 would be further subdivided. There was further discussion regarding the greenspace. Ms. Little explained she believed that to allow a utility easement within the landscaped greenspace would be putting a double burden on the landowner since he would be required to keep the greenspace landscaped, even if the utility needed to perform work on their lines. Mr. Jones suggested placing conduit under the greenspace. Ms. Bunch asked if Mr. Calloway would need the entire 25 feet. Mr. Calloway stated he would not but was concerned about access. He advised that, if the utility easement abutted the right-of-way, he could get by with a 10 -foot utility easement. He asked the City to agree that, if the lines needed to be relocated, the City would bear the expense of such relocation. Ms. Little asked what facilities were proposed above ground. Mr. Calloway advised there would be a small distribution terminals. Ms. Little suggested placing them 10 feet to the south, adjacent to the right- of-way in the 25 -foot green space. SONNY HUDSON - ARKANSAS WESTERN GAS In response to a question from Mr. Hudson, Mr. Bunn advised the easement requested by Arkansas Western Gas would just be a 10 -foot gas easement, not a general utility easement. Mr. Calloway asked about an easement parallel to the west side of the property. Mr. Jones stated there was an existing water and sewer easement at that location. • Plat Review Meeting October 27, 1994 Page 7 After discussion it was agreed the water and sewer easement could be shared with other utilities but the easement needed to be designated as a general utility easement. Mr. Calloway also noted he would need an easement along the south property line of the subdivision. He noted the easement was shown on the subdivision plat but not the large scale development plat. He further advised he would need conduit from the building out to some point. • TIM JOHNSON - WARNER CABLE Mr. Johnson stated there was an existing overhead line on the north line of the proposed street. He stated he would need conduit into the building. He also requested a wiring diagram and the location of the feed points. Mr. Calloway asked if the location of the equipment room had been established. Mr. Jones advised it had not. MICKEY JACKSON In response to buildings, Mr. - FIRE DEPARTMENT a question from Chief Jackson regarding sprinkling of the Jones stated he assumed the owner would do so. Chief Jackson requested a hydrant at the entrance off Futrell and one at the rear entrance off of the unnamed street. He further advised that, if the building would not be sprinkled, an additional hydrant would be required at the southwest corner of the property. He asked the square footage of the proposed hotel. Mr. Jones advised it would be 45,000 square feet on two floors. PERRY FRANKLIN - TRAFFIC DIVISION Mr. Franklin advised that, according to ADA regulations, one of the handicapped parking spaces needed to be van accessible. TIM CONKLIN - PLANNING Mr. Conklin noted there was 30% pervious surface and advised the Design Overlay required only 25% and the developer was providing trees in the parking lot and would be placing a berm. MANDY BUNCH - ENGINEERING Ms. Bunch advised there would need to be some sort of channelization along the back. She also advised that, for the city street crossing, engineering staff would want RCP DON BUNN - CITY ENGINEER In response to a question from Mr. Bunn, Mr. Jones stated the water and sewer easements shown on the plat were from recorded documents. Mr. Bunn stated he would like to see the easement documents. He noted he doubted the location of the lines were correct. He further advised he saw no problem in letting the utility companies use the existing easements once the lines were located. • Plat Review Meeting October 27, 1994 Page 8 • • He also requested Mr. Jones show how the 100 -Year and 500 -Year Flood Plain fit together. Ms. Bunch advised the FEMA map only showed Zone "X". elevation had not been established. Mr. Jones stated Zone "A" had also not been established. He explained he was concerned about the east side of the tract since the building was encroaching slightly into that area. He stated the actual definition for Flood Zone "X" (which he had labeled as a 500 -Year Flood) was areas of 500 -year flood, areas of 100 -year flood with an average depth of less than one foot or drainage areas of less than one square mile and areas protected by levies from the 100 - year flood. He stated he had done some modeling of basins and computed flows. He noted that, with channel improvements, he believed they could get the majority of the 100 -Year Flood Plain in the channel. She stated the flood Ms. Bunch stated she channelizing now and Mr. Bunn advised the floodways. Mr. Jones stated a floodway was not established. Mr. Bunn stated he believed the city would want an easement from top bank to top bank together with an easement for access. He advised he would defer to Randy Allen on whether a drainage easement would be required. Ms. Little advised the city would need a engineer's certificate as to the elevation of the 100 -Year Flood at the time of issuance of the building permit. Mr. Jones reiterated the tract was not in the flood plain. He advised he planned on widening the channel in order to contain the 100 -year flood. He stated there was not a detailed FEMA study on the flood plain. had discussed the matter with Mr. Jones earlier regarding possibility eliminating the riprap situation. city normally requested drainage easements along Ms. Bunch advised they needed to contact the Corps of they would want. Little further stated there would also have to be a drainage easement for the channel from the top of the bank to the top of the bank and also in places which were not next to access points a 15 foot easement was needed. Mr. Burrack requested a 20 -foot easement extend to the east side to join with the existing easement. • • • Plat Review Meeting October 27, 1994 Page 9 PRELIMINARY PLAT - NORTH VIEW ADDITION SECOND CENTURY INVESTMENTS - EAST OF HWY 71 B, N OF SHEPPARD LANE The last item was a preliminary plat for North View Addition submitted by Robert Brown of Development Consultants on behalf of Second Century Investments for property located east of Highway 71B, north of Sheppard Lane. The property is zoned A-1, Agriculture, (with a rezoning to C-2 being requested) and C-2, Thoroughfare Commercial and contains 12.22 acres with 6 proposed lots. Mr. Conklin advised the subdivision would have to be renamed since there was already a North View Subdivision. CHRIS VOTT - OZARK ELECTRIC Mr. Vott requested a 15 -foot easement between the lot lines. Mr. Brown stated they could accommodate some easements between lots but some of the buildings would be up to the side property lines. He suggested deferring those easements until the large scale development was approved. Mr. Vott stated he would like the perimeter easements increased from 15 to 20 feet. After discussion, he decided whenever there was an adjacent off-site easement the on-site easement did not need to be increased. He further asked for various 8 -inch crossings. ANDY CALLOWAY - SOUTHWESTERN BELL TELEPHONE Mr. Calloway requested various 4 -inch crossings. TIM JOHNSON - WARNER CABLE Mr. Johnson advised the easements shown were fine. SONNY HUDSON - ARKANSAS WESTERN GAS Mr. Hudson pointed out an existing gas line and advised that, if it had to be moved, Mr. Brown would need to contact the Gas Company. Mr. Brown agreed and noted there were numerous interior easements which would probably have to be abandoned. He advised that would be taken care of at the large scale development stage. He stated the two existing residential structures would be removed. PERRY FRANKLIN - TRAFFIC DIVISION Mr. Franklin asked if Sheppard Lane was to be blocked. Mr. Brown stated it would be block with one primary access to the shopping center from Sheppard. Ms. Bunch stated the Highway Department planned on lowering 71B by 16 inches in the area north of Sheppard and south of Zion. She advised the sight distance profile had been approved. • Plat Review Meeting October 27, 1994 Page 10 • • MICKEY JACKSON - FIRE DEPARTMENT Chief Jackson confirmed the water line was tied in at both ends. He advised the hydrant spacing appeared to be fine but an additional hydrant might be required at the time of large scale development review. DON BONN - CITY ENGINEER Mr. Bunn stated the engineer stili needed to file a grading plan and drainage report. Mr. Brown advised he wold be filing a conceptual grading plan with the large scale development. The meeting adjourned at 11:00 a.m.
