MINUTES OF A PLAT REVIEW MEETING
A meeting of the Fayetteville Plat Review Committee was held on Thursday,
October 6, 1994 in Room 111 of the City Administration Building, 113 West
Mountain Street, Fayetteville, Arkansas.

FINAL PLAT - OWL CREEK
MIKE PENNINGTON - E OF DOUBLE SPRINGS, S OF HWY 16
The first item was a final plat for Owl Creek Subdivision submitted by Mel
Milholland on behalf of Mike Pennington for property located east of Double
Springs Road, south of Highway 16. The property is zoned R-1, Low Density
Residential, and contains 10.22 acres with 33 proposed lots.
Ms. Little noted Arkansas Western Gas Company had requested a 20 -foot easement
north of the flood plain.
Mr. Evans, Arkansas Western Gas, advised they had changed that request. He
explained they would be serving the property from the front.
Ms. Little stated the name Houston Drive was unacceptable since there was
already a Houston Drive.
TIM JOHNSON - WARNER CABLE
Mr. Johnson stated the existing easement looked fine. He advised it would
cost 90 cents a foot to install cable at the time of development.
Ms. Little stated she did want a notation on the plat if cable was not going
to be installed by the developer.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans stated the easements were fine. He requested the crossings be
shown.
CHRIS VAUGHT - OZARK ELECTRIC
Mr. Vaught asked how far Houston Drive would be paved past lots 12 and 13.
Mr. Milholland stated it would stop at the easement line.
Mr. Vaught stated he would like to serve the property from the front and go
between lots 12 and 13. He advised he did not want to get into the private
access easement.
After discussion, Mr. Milholland advised the access easement was a filed
easement of record.

PERRY FRANKLIN — TRAFFIC DEPARTMENT
Mr. Franklin had no comments.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson had no comments.
ALETT LITTLE - CITY PLANNER
Ms. Little advised the Parks Department had requested money ($7,420.00) in
lieu of land. She also noted the sidewalks needed to be shown on the plat
but, since the preliminary was approved prior to the adoption of the new
sidewalk ordinance, the developer was not responsible for constructing the
sidewalks. She also requested the right-of-way dimensions of the new streets
be shown. She pointed out there was an error in the legal description and
advised it needed to be reconciled with the drawing. She explained the
drafting department did want the legal description tied to the State Plane
Coordinates. She requested the new signature block be put on the plat. She
also requested a notation on the plat that lots 4, 5, 6, 7, 8 and 9 were
partially located within the 100 Year Flood Plain and would require individual
grading permits and Certificates of Elevation. She further advised the city
would need a letter listing all uncompleted improvements (including street
lights) in order to prepare the contract for the developer's signature.
Mr. Milholland advised he believed all improvements would be complete by the
time the plat when to the Planning Commission.
Ms. Little also requested a barrier, with reflective markers at the end of
Houston Street. She pointed out sidewalks would also be required along Double
Springs Road. She asked that a copy of the protective covenants be filed with
the final plat. She went on to note the zoning was not shown on the plat.

PRELIMINARY PLAT — CRYSTAL SPRINGS, PHASE II
JED DEVELOPMENT — E OF SALEM, N OF MT. COMFORT
The next item was a preliminary plat for Crystal Springs, Phase II, submitted
by Mel Milholland on behalf of JED Development for property located east of
Salem Road, north of Mt. Comfort. The property is zoned R-1, Low Density
Residential, and contains 35.32 acres with 104 proposed lots.
TIM JOHNSON — WARNER CABLE
Mr. Johnson advised the existing easements were fine. He stated it would cost
90 cents a foot to install cable at the time of development.
RICK EVANS — ARKANSAS WESTERN GAS
Mr. Evans stated the easements shown were fine.
CHRIS VAUGHT — OZARK ELECTRIC
Mr. Vaught requested additional easements for street lights: one between lots
125 and 126 and another between lots 122 and 123. He advised he would prefer
a 15 -foot easement but could reduce it to 10 feet if necessary. He also
requested various crossings. He asked how far Crystal Drive would extend.,
Ms. Little stated staff was asking that it turn north at Lot 161.
MICKEY JACKSON — FIRE DEPARTMENT
Chief Jackson had no comments.
RANDY ALLEY — STREET DEPARTMENT
Mr. Allen had no comments.
LISA COR — PARKS DEPARTMENT
Ms. Cox advised the Parks Department had requested land, which had already
been dedicated.
Me. Little stated staff had discussed making the park land an outlot so it
would show on the plat.
After discussion, she reiterated if the land was not to be developed, it
needed to be shown as an outlot.
Mr. Milholland advised the developer had no intention of developing the area
under discussion.
Ms. Little requested a notation on the plat as to the ownership and use of the
land.
PERRY FRANKLIN — TRAFFIC DEPARTMENT
Mr. Franklin advised the developer needed to contact Jim Johnson, 9-1-1
Coordinator, regarding street names. There was discussion regarding tie-ins
to other streets. Mr. Franklin asked how long before there would be another
ingress/egress to the property.

Mr. Milholland stated the third phase was scheduled for the end of the next
summer.
Mr. Vaught requested the street light between lots 160 and 161 be moved.
Ms. Little stated there needed to be a cul-de-sac between lots 158 and 159.
She advised if they could get the cul-de-sac off-site, a temporary would be
fine. There was discussion as to alignment of the cul-de-sac.
She further noted the legal description needed to be corrected and tie to the
State Plane Coordinates. She also requested placement of the sidewalks to
provide access to the school, by placing the sidewalk across the retention
wall to the south of lot 135, across Pyrite and across the south side of Lot
120. She pointed out the sidewalks would need to be constructed by the
developer and set back 4 feet from the curb. She noted the engineering
department was requested "as builts" for Phase I and a drainage report for the
current phase. She also requested a tree preservation plan.

PRELIMINARY PLAT - KANTZ PLACE
E. J. BALL - N OF HWY 45, W OF HWY 265
The next item was a preliminary plat for Kantz Place submitted by Crafton,
Tull & Associates, Inc. on behalf of E. J. Ball for property located north of
Highway 45, west of Highway 265. The property is zoned C-2, Thoroughfare
Commercial, and contains 15.22 acres with 7 proposed lots.
There was discussion of a joint drainage/utility easement shown on the plat.
David Cox, Crafton, Tull Associates, advised they would remove the utility
easement and make a 10 -foot drainage easement.
DENNIS BORRACK - SWEPCO
Mr. Burrack advised there was an existing overhead line and facilities were
already in place. He advised they needed a 20 -foot easement along the north
side of the tract.
Mr. Cox stated he would change the building setback to a setback and easement.
Mr. Burrack requested the developer contact SWEPCO when they determined their
load needs.
TIM JOHNSON - WARNER CABLE
Mr. Johnson had no comments.
RICE EVANS - ARKANSAS WESTERN GAS
Mr. Evans stated he had existing lines along Highway 265 which was within the
50 -foot easement. He stated the 15 -foot easement on the south side needed to
be enlarged to 20 feet.
Ms. Little advised Mr. Cox did need to contact Andy Calloway, Southwestern
Bell Telephone, since he was not present at the meeting.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson had no comments.
RANDY ALLEN - STREET DEPARTMENT
Mr. Allen advised there was a 36 -inch CMP coming in along Lot 1 and there was
only a 10 -foot drainage easement for a 3 -foot pipe.
Mr. Cox explained he had tried to separate the drainage easement from the
utility easement containing the sewer line.
Mr. Allen stated it would be fine as long as there was a utility easement
adjacent to the drainage easement. He asked where the pipe was in relation to
the five foot sidewalk.
Mr. Cox stated it was almost under the sidewalk.
Ms. Little stated the sidewalk could be placed at the back of the right-of-way
so it would be approximately 10 1/2 feet from the street.

ALETT LITTLE - CITY PLANNER
Ms. Little advised notification of the property owners across Highway 265 was
required. She reviewed notification requirements. She also requested the
sidewalks along Highway 265 and Highway 45 be shown on the plat. She advised
all curb cuts and the sidewalk required permission from the State Highway
Department.
Mr. Allen confirmed the drainage ditch on the west side would be concrete.

LARGE SCALE DEVELOPMENT - CHEROKEE VILLAGE SHOPPING CENTER
KEITH CEARLEY - SOUTHEAST CORNER OF HWY 45 AND HWY 265
The next item was a large scale development for Cherokee Village Shopping
Center presented by Laleh Amirmoez, Hailey & Associates, on behalf of Keith
Cearley, for property located at the southeast corner of Highway 45 and
Highway 265. The property is zoned C-2, Thoroughfare Commercial, and contains
14.74 acres.
Ms. Amirmoez presented a revised plat and

Mr. Burrack advised the adjoining residential property had underground service
and he was not sure if they would protest the overhead service. He stated if
there would be a conflict, it would be possible to serve the property
underground. He explained the route and the easements necessary for
underground service. He requested the developer contact SWEPCO when they knew
the necessary loads.
TIM JOHNSON - WARNER CABLE
Mr. Johnson advised they would work out service conduit at the time of
construction.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans advised they had discussed coming around the property along Highway
265. He stated he needed the same easements requested by Mr. Burrack. He
requested an additional easement.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson noted 5 hydrants. He asked if the property would be circled
with a water line.
Me. Amirmoez advised she was not sure.
Chief Jackson stated he believed a 6 -inch line would work.
In response to a question from Mr. Bunn, Chief Jackson advised he would need
3,000 GPM.
Mr. Bunn advised that would take an 8 -inch line.
Chief Jackson confirmed the supermarket would be sprinklered but the shopping
center would not.

PERRY FRANKLIN - TRAFFIC DEPARTMENT
Mr. Franklin pointed out there would be a problem with left turns into the
shopping center.
Ms. Little asked if he wanted to require a traffic impact study.
Mr. Franklin advised he would request the State Highway Department consider
extending the left turn lane.
ALETT LITTLE - CITY PLANNER
Ms. Little asked the proposed width of the curb cut.
Ms. Amirmoez stated the plat showed 30 feet but it might increase to 40 feet.
Ms. Little advised the sidewalk would need to be 5 feet wide a minimum of four
feet back from the curb. She noted the beat location for the sidewalks would
be at the rear of the right-of-way. She stated the developer would need to
coordinate any drainage structures with the Highway Department. She also
stated the developer would need to file an easement plat after approval by the
Planning Commission together with an "as built". She noted the landscaping
plan would suffice for the tree preservation plan. She advised screening
would be required between the development and the residential area. She noted
a drainage report had been filed with the City Engineer.
• In response to a question from Mr. Conklin, Me. Amirmoez advised Mr. Clery
planned on retaining ownership of the entire tract.
Ms. Amirmoez advised there was a possibility of a name change for the project.

PRELIMINARY PLAT - KEE CORNER SUBDIVISION
LARGE SCALE DEVELOPMENT - KEE CORNER PLAZA
KIRK ELSASS - S OF ZION, W OF HWY 265
The next items were a preliminary plat and large scale development for Kee
Corner submitted by Dave Jorgensen on behalf of Kirk Elsass for property
located south of Zion Road, west of Highway 265. The property is zoned C-1,
Neighborhood Commercial, and contains 3.82 acres with 4 proposed lots.
There was discussion regarding the alignment of the street into the
subdivision. Mr. Jorgensen explained the developer desired to keep a large
tree and the alignment shown would allow the retention of that tree.

Mr. Johnson had no comments.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans advised there was an existing 2 -inch line along Highway 265.
CHRIS VAUGHT - OZARK ELECTRIC
Mr. Vaught stated he also had an existing line on Highway 265 and underground
service to Charter vista.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson had no comments.

ALETT LITTLE - CITY PLANNER
Me. Little advised the sidewalks would be constructed by the developer and set
back a minimum of four feet from the curb. She also requested a drainage
report and a tree preservation plan.
Mr. Jorgensen advised the developer wanted to move the building back 10 feet.
Ms. Little asked Chief Jackson how wide of a circulation path he would need to
the back of the buildings.
Chief Jackson stated he would need a minimum of 15 feet. He asked if the
buildings would be sprinkled.
Mr. Elsass stated he was not planning on sprinkling them.
Ms. Little asked if additional street lights were needed.
Mr. Franklin stated there was sufficient lighting.
Ms. Little also requested the developer contact Cheryl Zotti regarding
dumpster location.

FINAL PLAT - THE MASTERS
DEE GE DALLAS WRIGHT AND ELDON & DRYDEN PENCE- S OF COUNTRY CLUB, E OF S.
COLLEGE
The next item was a final plat for The Masters submitted by Bill Rudasill on
behalf of Dee and Dallas Wright and Eldon and Dryden Pence for property
located south of Country Club Drive, east of South College. The property is
zoned R-1, Low Density Residential, and contains 20 acres with 15 proposed
lots.
Mr. Rudasill advised he had adjusted some of the easements after meeting with
Don Bunn and Randy Allen and presented new plats.
DENNIS BURRACK - SWEPCO
Mr. Burrack asked about the size of the sewer lift station.
Mr. Rudasill explained it was a duplex station with single phase motors.
Mr. Burrack pointed out there was a hillside at the site of the lift station
and asked about access.
Mr. Rudasill stated there would be a driveway access to the station.
Mr. Burrack requested the driveway also be shown as a utility easement.
Mr. Rudasill advised he would add 10 feet for the utility easement since the
access was currently a right-of-way and drainage easement.
Mr. Burrack stated he would need to loop his line. He reviewed the easements
he would need.
TIM JOHNSON - WARNER CABLE
Mr. Johnson advised the easements as shown were fine. He noted that
installation of cable at the time of development would cost 90 cents a foot.
Ms. Little stated that, if cable was not to be installed by the developer, she
wanted a notation on the plat.

Mr. Evans stated the easements were fine. He pointed out there was a utility
easement which was not labeled. He further noted he was planning on serving
the properties from the front.
Ms. Little advised that, due to the terrain, the sidewalks would be setting
one foot behind the curb and the street lights would be located behind the
sidewalks.

LARGE SCALE DEVELOPMENT - RIDOUT LUMBER
RIDOUT CONTRACTOR OUTLET - W OF GREGG, N OF POPLAR
The next item was a large scale development for Ridout Lumber presented by
Neal Albright on behalf of Ridout Contractor Outlet for property located wet
of Gregg, north of Poplar. The property is zoned I-1, Heavy Commercial -
Light Industrial, and contains 4.68 acres.
DENNIS BURRACK - SWEPCO
Mr. Burrack advised there was an overhead power line which stopped in the
vicinity of the county shop. He asked the load amount and where the point of
service would be located. He stated he did not believe they would need any
additional easements.
TIM JOHNSON - WARNER CABLE
Mr. Johnson had no comments.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans stated he also had a line which descended at the old county shop.
He advised there would be no additional easements needed.
MICKEY JACKSON - FIRE DEPARTMENT
Chief Jackson asked if they planned to sprinkle the building.
Mr. Albright stated they did not plan to sprinkle.
Chief Jackson stated they might have to sprinkle since it would be 12,000 feet
of plywood; he would have to check. He recommended two additional hydrants.
He noted they would have to find a way to extend the water line to the
hydrants. He advised they would need a minimum of an 8 -inch line. He later
advised he had checked and a sprinkler system would not be necessary.
ALETT LITTLE - CITY PLANNER
Ms. Little noted there was right-of-way on the south end of the tract and Easy
Street was immediately south of the project as well as Birch.
Mr. Franklin advised he was concerned that late at night it would appear Gregg
would go directly into the parking lot.
Mr. Albright pointed out the street was Old Gregg, where it made a jog over
the railroad tracks.
Ms. Little noted th�ng_needed-to-be-changed on -the -plat. She advised
they would nee to contact Jim Johnson, 9-1-1 Coordinator, to get an address.
She also stated that, if there were any additional easements required, they
would need to file an easement plat. She requested the setbacks from the
property lines be shown on the plat. She further advised they were showing a
dumpster pad of 10 feet and, per ordinance, it would need to be 12 feet on not
less than 6 inches of concrete. She recommended they contact Cheryl Zotti for
assistance.
In response to a question, Mr. Albright stated their future plans were to use
the railroad spur to unload. He explained a railroad car could back into the
yard.

In response to a question from Ms. Little, the Ridout representative explained
they planned on a metal building (grey in color) with a front on the building
so it would not appear like a metal building. He stated it would be similar
to the building in Rogers or the one in Conway.
Ms. Little asked what they were willing to do to make their site appear other
than just a storage yard to be seen by everyone going up and down Gregg.
The Ridout representative pointed out only the top third of the buildings
would be visible from Gregg due to the railroad tracks between the site and
Gregg.
In response to a question from Me. Little, Mr. Albright advised they were
comfortable with only one access. He noted they might make the entrance to
the property wider. He noted they would pave the parking but the remainder of
the tract would remain gravel.
There was discussion regarding the entrance to the property and possible tie
ins to other streets in the area.
Ms. Little asked how they would handle the drainage on the site.
Mr. Albright responded all drainage was directed to the northwest corner of
the tract.
Mr. Bunn stated a drainage report had been received.
• Ms. Little noted the flood plain needed to be shown on the plat. She asked
what type of fencing would be used.
The Ridout representative stated they planned on using chain link.
Ms. Little stated screening would be required between the tract and any
residential zoning. She also noted they would need to dedicate 25 feet of
right-of-way along the west side of the tract since the city already had 20
feet. She explained that would be adequate right-of-way for a road, if it was
ever decided a road was needed.
The Ridout representative advised they had considered requesting the right-of-
way be vacated.
Ms. Little stated she did not believe city staff could recommend the right-of-
way be vacated. She explained it was generally recommended that tracts of
this size have two accesses. She went on to say staff had talked about an
off-site assessment to complete the road. She explained staff needed to
decide whether or not there was a need to work more on the streets and
connections and take the development out of the current plat review cycle.
she suggested staff work with the Ridout representatives and make a decision
by the Subdivision Committee meeting.
In response to a question from Mr. Albright, Mr. Bunn advised that, if they
could get the sewer onto the tract and access it with a service line, it would
be sufficient.

FINAL PLAT - PINE VALLEY, PHASE III
BNP DEVELOPMENT - S OF MT. COMFORT, W OF PORTER
The next item was a final plat for Pine Valley, Phase III submitted by Harry
Gray on behalf of BMP Development for property located south of Mt. Comfort
Road, west of Porter Road. The property is zoned R-2, Medium Density
Residential, and contains 8.7 acres with 26 proposed lots.
In response to a question from Ms. Little, Mr. Gray advised the developer was
in the process of finishing the streets.
DENNIS BURRACK - SWEPCO
Mr. Burrack advised they would be staying out of the flood plain and serving
the properties from the front. He explained the territory line between SWEPCO
and Ozark Electric ran through lots 45, 46, 47 and 48 but an agreement had
been made that SWEPCO would provide the service.
TIM JOHNSON - WARNER CABLE
Mr. Johnson advised the easements were fine. He noted an agreement had been
reached regarding the installation of the cable.
RICK EVANS - ARKANSAS WESTERN GAS
Mr. Evans stated the easements and crossings shown were fine.
PERRY FRANKLIN - TRAFFIC DIVISION
Mr. Franklin requested the street light on lot 52 be moved to lot 63. He also
requested they check the spacing on the lighting.
ALETT LITTLE - CITY PLANNER
Ms. Little requested the plat contain the new signature block and a notation
on the plat that lots 41 through 46 required a separate grading permit and
were in the flood plain.
DON BUNN - CITY ENGINEER
Mr. Bunn requested a letter on the cost of the improvements remaining.
Ms. Little also advised the sidewalks were to be developer constructed.

Mr. Gray explained to put the plat on State Plane Coordinates at this stage
would take a great deal of time. He stated he would prefer to start
preliminary plats tied to the State Plane Coordinates. He suggested a
memorandum stating all new projects would be tied to the State Plane
Coordinates.

LARGE SCALE DEVELOPMENT - STERLING ANDERS
STERLING ANDERS - W OF SHILOH, S OF POINT WEST STREET
The next item was a large scale development for
Harry Gray for property located west of Shiloh,
property is zoned I-1, Heavy Commercial - Light
acres.
Sterling Anders submitted by

Mr. Gray stated Chief Jackson wanted a fire hydrant on the north side of Point
West Street and he had agreed. He advised he had a letter stating the Overlay
District did not apply to the subject tract.
Ms. Little stated the dimensions of the right-of-way from the centerline
needed to be shown on the plat.
PERRY FRANKLIN - TRAFFIC DIVISION
Mr. Franklin asked why the ADA spaces were at the back of the building.
Mr. Gray stated the ADA spaces were closest to the office.
None of the utility company representatives had any comments.
Ms. Little advised the sidewalks needed to be five feet wide, set in four
feet.
Mr. Gray stated the sidewalks would be as shown on the final plat.
Mr. Bunn requested a grading plan.
Ms. Little stated there needed to be a statement regarding the tree
preservation plan since there were no trees on the tract.

LARGE SCALE DEVELOPMENT - INDUTEC
JAMES PENNY - INDUSTRIAL PARK
The last item was an informal presentation of a large scale development for
Indutec.
Ms. Little explained Mr. Penny had purchased the subject tract but the city
did have some problems with his plans. She stated the water line appeared to
go under the building in a southwest direction.

Mr. Burrack stated there was an overhead line in the area but it appeared it
would clear the building.

Mr. Conklin pointed out there was a 55 foot setback from the gas easement. He
stated he had requested Chester Dean contact Arkansas Western Gas to address
the setback. He advised neither the developer nor the city was sure where the
line was located.
Mr. Evans stated he would have to locate the lines on the property.
